The accused, who allegedly shot and killed Andrew Lenahan on Oct. 14, 2022 when she was 17, was waived from juvenile to adult court.

"Defendant is ordered to appear at all hearings dates," the judge said. "Failure to appear will result in an arrest warrant being issued."

"The gun fired and struck Andrew, who immediately fell to the ground," the allegations read. "Dakota became hysterical and passed out from the shock."

Recently released court documents in the case of a teen girl charged with shooting and killing Andrew Lenahan, 18, in October in Union Township provide additional details about what reportedly happened that night, a gathering of young people that included alcohol and firearms.

"As I have said from day one this was a tragic accident not a reckless act," defense attorney Ken Elwood said.

The delay was sought by defense attorney Ken Elwood, who said more time is needed to collect evidence in the case.

The waiver petition filed Thursday morning says, "It is in the best interest of the safety and welfare of the community that the child stand trial as an adult."

Porter County Juvenile Probation Officer Julie Jozwiak opposed the girls release saying not enough of the details have yet been provided by police.

The accusations are that on Oct. 14, the teen pointed another persons handgun at the head of Andrew Lenahan and shot him, resulting in Lenahans death, the petition reads.

"His smile lit up a room," mom said.
