UP-RERA fines homebuyer for repetitive complaints despite relief, impacting justice delivery. Misuse of legal process observed by NCR Bench Chairman. Sanjay Bhoosreddy stresses deterring unscrupulous complainants with heavy costs to ensure justice for genuine allottees.

Uttar Pradesh RERA took strong objection to the fourth complaint by this allottee and imposed a cost of Rs 5,000 upon him.

Uttar Pradesh RERA: RERA has also directed the promoters to file an affidavit to the effect that the project land is free from encumbrances and to disclose the same if there is any encumbrance on the land of the project.

It also directed agents also to send their applications of registration and extension to the head office in person or by post, according to an official statement.

Since 2019, developers and homebuyers have successfully resolved 1,350 cases through the NCR conciliation forum of Uttar Pradesh Real Estate Regulatory Authority (UP RERA). This led to dispute-free assets valued at approximately Rs 550 crore. Dinesh Gupta, Secretary of CREDAI Western UP, attributed the success to collaborative efforts by CREDAI members, RERA officials, and home buyer representatives.

In doing so, UP RERA not only simplified the process of filing of complaints, but made it more comprehensive also, it said in a statement. "Now the process has become more user-friendly and will be conducive to early listing and speedy disposal of complaints. This facility is available from Monday (January 15, 2024) on UP RERA portal," the regulatory authority said.

Uttar Pradesh RERA: Sanjay Bhoosreddy, chairman, UP-RERA said that while reviewing the progress of the projects, it was seen that many of the promoters are not filing the QPRs of their projects in time and some of them have filed the subsequent QPRs without filing the pending QPRs.

The Real Estate Regulatory Authority (Rera) in Uttar Pradesh has reminded developers and buyers about the payment module for projects. According to UP-Rera Act, developers are not allowed to take more than 10% advance payment before the sale agreement is executed. The sale agreement should include project details, payment dates, and possession information. Additionally, developers have been directed to sell units based on carpet area only, not super area.

In the regular course, the QPRs are required to be filed within 15 days of the closure of the given quarter.

Not updating quarterly progress reports of projects amounts to violation of the relevant provisions of the RERA Act, UP RERA Chairman Sanjay Bhoosreddy said.
