UP RERA directs builders to register agreement for sale before demanding more than 10% money from homebuyer

The agreement must cover the particulars of development of the project including the construction of building and apartments along with specifications and particulars of internal and external development works. The agreement shall provide the dates and the manner of the payments toward the cost unit and specify the date on which the possession shall be handed over to the allottee.

The Uttar Pradesh Real Estate Regulatory Authority (UP RERA) has instructed developers to sell apartments based on carpet area only, as there is no justification for selling on super area. The RERA Act and other legal agreements/contracts state that buying and selling apartments are only legal on carpet area. Developers must consider carpet area as the actual area of the unit/apartment and pay the promoter accordingly.

Sale of units/ apartments on this basis will be considered illegal and according to the provisions of RERA Act, buying and selling of apartments is legal only on the basis of carpet area, said the UP RERA.
