If a teacher teacher is hospitalized due to an incident at a high school and is assaulted in the process and thats how she ends up in the hospital and she also facebook she ends up in the hospital gets fired because of it is that violating her First Amendment right . Im sorry, the teacher. Im sorry wasnt really clear. The teacher was the teacher was assaulted in an incident at school. She was hospitalized because of it. While the hospital she posted on social media site that she was in the hospital. Can hospital. Can she be fired for that . It depends. The law will be different depending on where she lives because the Appellate Courts are not entirely agreement but there are some limits to what Public Employees including teachers can say about their work. So a lot would depend on whether this was considered a matter of public concern or not.
