The Biden administration has been relying heavily on a Trump-era Title 42 rule to quickly deport a majority of those who attempt to cross the southern border, but it has made exceptions for unaccompanied children and some families.
Texas’s suit argues that the administration’s “abandonment of their authority” under the law means “more Texans will be exposed to Covid-19, more Texans will contract Covid-19, more Texans will die of Covid-19 and Texas will incur significant costs in terms of health care and law enforcement resources.”

In March alone, the Biden administration used its Title 42 authorities to expel more than 100,000 of the 172,000 people who crossed the southwest border, many of them single adults. Another 68,000-plus were expelled under Title 8, which allows deportation of those who violated immigration law by entering the country between ports of entry.
The America First Policy Institute (AFPI) describes itself as both ânon-profitâ and ânon-partisanâ. Critics, however, regard it as a cash cow for alumni of the Trump administration whose stained reputations make it hard to find gainful employment.
Despite Trumpâs campaign promise to âdrain the swampâ, the AFPI reportedly has a first-year budget of $20m, which it hopes to double to $40m next year, and plans to expand beyond its current headquarters in Arlington, Virginia, to locations that include a spacious office on Washingtonâs Capitol Hill.
The AFPI unveiled a website this week replete with images of the Stars and Stripes and Mount Rushmore. It profiles 35 team members with, in most cases, an inspirational quotation from a famous person.
Stephen Miller Pursues White Nationalist Agenda With State Lawsuits
Stephen Miller, a white nationalist and senior aide in the Trump White House, is working behind the scenes through his organization America First Legal to assist Republican attorneys general who are suing the Biden administration over immigration issues.
Miller was responsible for designing some of the Trump administration s key policies targeting immigrants, including the separation of immigrant children from their families at the U.S.-Mexico border and the ban on travelers from Muslim-majority countries entering the United States.

A well-funded new group formed by former senior aides to then-President Donald Trump launched on Tuesday with the goal of permanently fusing the ex-President’s “America First” agenda with the Republican Party.
The newly minted nonprofit is called the America First Policy Institute and boasts a staff of 35 former Trump aides, including former Cabinet secretaries, top national security advisers and members of the former President’s evangelical advisory board.
The group’s launch was first reported by Axios.
Trump’s daughter Ivanka and her husband, Jared Kushner, both of whom served as White House policy advisers, are also involved in the project as informal advisers, according to two people familiar with the arrangement.
