Judge weighs what to do with Daley case (1/13/2021)
After a years-long regulatory and legal saga, a judge is set to rule in the coming weeks on the Daley Farm’s bid to expand its Lewiston dairy and get an exception to Winona County’s limit on farm size.
Olmsted County District Court Judge Kevin Mark ruled last month that members of the Winona County Board of Adjustment (BOA) who actively opposed the farm expansion just before they supposed to serve as impartial judges of it were biased, violating the farm’s due process right to a fair hearing. Now the question is, what should the court do to correct the situation? The attorney for the Daley Farm, Matt Berger, argued this week the judge should order the county to approve the farm expansion, while the county’s attorney, Paul Reuvers, wrote that the court should send the issue back to the BOA for fresh decision.

A 21-year-old year Rochester man was stabbed in the buttocks and another man was arrested late Monday night after police said there was a large fight at a Northwest Rochester apartment complex.
Rochester police were called about 11:35 p.m. to The Gates of Rochester apartment complex, 2015 41st St NW, for a report of about 20 men fighting. A caller reported that someone may have been stabbed and that someone was heard saying they were going to get a gun, Capt. Casey Moilanen said. Callers also reported that vehicles were ramming each other in the parking lot and that two vehicles a gray vehicle and a black vehicle were trying to leave the area.

A Rochester man was ordered held on $50,000 unconditional bail after he allegedly repeatedly sexually assaulted a woman experiencing homelessness.
Scott Wade Ramey, 56, is charged in Olmsted County District Court with first-degree criminal sexual conduct and third-degree criminal sexual conduct. Both are felonies.
At his first appearance Friday morning, Judge Pamela King set unconditional bail at $50,000. She did not set conditional bail. Ramey s next court appearance is scheduled for Jan. 20.

A Stewartville man was arrested Thursday night after Olmsted County Sheriff s deputies say he pulled a gun on another man and assaulted him.
Shaun Whitney, 24, is charged in Olmsted County District Court with second-degree assault with a dangerous weapon and terroristic threats, both of which are felonies. He is also charged with misdemeanor counts of domestic assault and fifth-degree assault.
He made his first appearance in court on the charges Friday morning when Judge Pamela King ordered Whitney released on conditions including that he not use of posses any firearms or dangerous weapons and that he has no contact with the alleged victims in the case.
