Coastside residents Thomas and Daniel Gearing are suing the city of Half Moon Bay after the city exercised eminent domain to take the Gearingsâ six parcels of land near Railroad Avenue.
The Gearings filed a lawsuit in the U.S. District Court of Northern California on March 15, and it was served to the city on March 22, the day before it filed the eminent domain action in San Mateo County Superior Court. The Gearings allege that the cityâs development process is unconstitutional.
The move comes as property owners spent decades protesting the planned use of the âWest of Railroadâ land between the Coastal Trail and Railroad Avenue. The city says the claims have no merit, and that its purchase of the parcels falls in line with its Land Use Plan by aligning with the publicâs best interest to deal with erosion, manage the retreat of the Coastal Trail and protect natural habitats.
The high-profile 20-year-old conviction of a California man accused of murdering his pregnant wife and dumping her body in San Francisco Bay, may yet be aired anew. Scott Peterson, who was convicted of murdering Laci Peterson, then 27, already had his death sentence overturned by California’s highest court last summer. Prosecutors are still trying to get that reinstated, even as the push continues for him to get a new trial.

SAN FRANCISCO (CBS SF) A former Modesto police detective says nothing has changed in his mind in the years since Scott Peterson was convicted by a San Mateo County jury of killing his pregnant wife, Laci, and the couple’s unborn son, Connor, in 2004.
CBS 48 Hours took a new look at one of the most famous spousal murder cases in U.S. history on Saturday. The case is back in the news as the California Supreme Court tossed out his death sentence, saying the trial judge made procedural errors.

REDWOOD CITY, CA Convicted killer Scott Peterson will return to court in June for two new hearings, one on the penalty phase of his murder conviction and a second to petition for a retrial following allegations of juror misconduct in his original trial.
San Francisco Superior Court Judge Anne-Christine Massullo on Tuesday set a June 28 hearing date on the penalty phase in a hearing in San Mateo County Superior Court. Peterson appeared via Zoom from San Quentin State Prison and waived his rights to a speedy trial for the penalty phase.
