Live blog: Europol testifies at Yorgen Fenech murder compilation

State witness Melvin Theuma is testifying in the compilation of evidence against Yorgen Fenech on Tuesday The wealthy businessman is accused of conspiring to murder journalist Daphne Caruana Galizia in a car bomb on October 16, 2017. Earlier a Europol expert took to the stand. It is not the first time the EU law enforcement agency has testified in the case - last year its data extraction experts testified about data from what was dubbed 'Operation Blue Elephant'.   The sitting comes weeks after Fenech made his latest bail request - the eighth since he was arraigned in November 2019. The accused was last in court in April, when the deputy attorney general outlined an alleged escape plan that would have seen Fenech sail from Malta to Sicily and on to Nice.

Magistrate strikes down Adrian Agius's request for bail The seriousness of the offence provided enough ground to refuse bail outright 25 May 2021, 4:52pm by Matthew Agius A court has denied bail to Adrian Agius, one of the tal-Maksar brothers, who stands accused of the murder of lawyer Carmel Chircop, dismissing arguments made by his legal team. Agius was charged alongside his brother Robert, George Degiorgio and Jamie Vella earlier this year. Robert Agius and Jamie Vella stand accused of supplying the bomb that was used to kill Daphne Caruana Galizia, while Degiorgio and Adrian Agius have been charged with Chircop’s murder.

Ta' Maksar brother Adrian Agius denied bail

Ta’ Maksar brother Adrian Agius was denied bail by a court on Tuesday, one day after his lawyer argued that all civilian witnesses had testified in the case against his client.  Agius stands accused of ordering the murder of lawyer Carmel Chircop, who was found gunned down in a Birkirkara garage in October 2015. He is pleading not guilty.  In a decision delivered on Tuesday, Magistrate Caroline Farrugia Frendo refused Agius’ bail application, saying that while the accused was presumed innocent, bail was not an automatic right.  While civilian witnesses had testified in the case, a magisterial inquiry into Chircop’s murder was not concluded and a copy of it had not yet been filed in the compilation of evidence in the case.

Murder suspect Adrian Agius requests bail

Ta’ Maksar brother Adrian Agius is seeking bail, with his lawyer arguing that all civilian witnesses in the case against him have testified and that there exist no reason for his client to continue to be held in police custody.  Agius stands accused of commissioning the 2015 murder of lawyer Carmel Chircop, which prosecutors say was carried out by Agius’ associates Jamie Vella, George Degiorgio and Vince Muscat.  Appearing in court on Monday morning, Agius’ lawyer Alfred Abela argued that arguments against granting Agius bail were now non-existent.  Abela noted that the prosecution had advanced the case briskly and that all civilian witnesses had now testified. His client had cooperated throughout, from the moment he was arrested, he noted, arguing that the prosecution had to prove that its concerns were well-founded rather than just state them.

Theuma pardon includes 2010 HSBC heist Middleman was granted pardon for a host of other major crimes, among them to provide information on the 2010 HSBC heist  23 May 2021, 8:50am by Matthew Vella The middleman in the assassination of Daphne Caruana Galizia was granted a pardon for what could have been an indirect role in the heist of the HSBC bank in 2010.  Melvin Theuma is believed to have put up one of his properties as a safehouse for the men involved in the shoot-out with police, in what was a daring heist on the HSBC security vault in Qormi.  Theuma’s role in the heist is included as one of several major crimes for which he was pardoned, MaltaToday has learnt, in return for any information he had on the heist.

Police officer recalls lawyer's angry phone call, days before his murder

Updated 12.30pm A senior police officer had overheard lawyer Carmel Chircop in a heated conversation on his mobile days before he was gunned down, a court heard on Tuesday. Emanuel Scicluna, a sergeant major stationed at the Birkirkara police station at the time of Chircop’s murder in 2015, testified about his chance encounter with the lawyer while on his way to a shopping mall in Sliema on a Saturday morning.  Scicluna knew Chircop by sight since the lawyer was the president of a band club in the town where the officer spent his working days. On that off-day, Scicluna was out shopping when he spotted Chircop, wearing a white shirt, visibly “very angry” as he spoke on his mobile.
