OVERVIEW
On April 16, 2021, California Governor Gavin Newsom signed Senate Bill (SB) 93 into law, a rehiring and retention law which requires employers in certain industries to make written job offers to employees who were laid off because of the impact of COVID-19. The law takes immediate effect and will remain in effect until December 31, 2024. Previously, some California cities adopted their own versions of local ordinances providing for a right to be recalled, including Carlsbad, Long Beach, Los Angeles, Oakland, Pasadena, San Diego, San Francisco and Santa Clara.
SB 93 is limited in application to certain industries and to certain covered employees. The bill gives California’s Division of Labor Standards Enforcement (DLSE) the right to enforce the law and the DLSE may remedy a violation by ordering hiring and reinstatement, granting front or back pay, as well as benefits the employee would have received under the employer’s benefit plan. SB-93 was signed by Governor Newsom on April 16, 2021 and is effective immediately. The new law requires certain employers to recall eligible workers who were laid-off for reasons related to COVID-19 if their prior positions become available. Covered Employers: SB-93 only applies to employers who operate an “enterprise,” which is defined as a
“hotel, private club, event center, airport hospitality operation, airport service provider, or the provision of building service to office, retail, or other commercial buildings” regardless of the number of employees.
