Solid Waste/Stormwater Enforcement: Arkansas Department of Energy and Environment - Division of Environmental Quality and Little River County Solid Waste Transfer Station Enter into Consent Administrative Order | Mitchell, Williams, Selig, Gates & Woodyard, P L L C

The Arkansas Department of Energy and Environment – Division of Environmental Quality (“DEQ”) and Little River County (“Little River”) entered into a February 3rd Consent Administrative Order (“CAO”) addressing alleged violations of the Arkansas Solid Waste Management Code (Arkansas Pollution Control and Ecology [APC&EC] Regulation 22) and a Stormwater Clean Water Act National Pollution Discharge Elimination System (“NPDES”) permit. See LIS No. 21-013. The CAO provides that Little River operates a solid waste transfer station (“Facility”) located in Ashdown, Arkansas. The Facility is stated to have held a solid waste permit from August 17, 2007, to May 23, 2011. A DEQ solid waste inspector is stated to have conducted a routine inspection at the Facility on November 27, 2018. The following violations of Arkansas Pollution Control and Ecology Commission (“APC&EC”) Regulation 22 were allegedly identified:

The Arkansas Department of Energy and Environment – Division of Environmental Quality and Tri County Regional Water Distribution District (“Tri County”) entered into a February 3rd Consent Administrative Order (“CAO”) addressing alleged violations of a Clean Water Act National Pollution Discharge Elimination System (“NPDES”) permit. See LIS No. 21-012. The CAO provides that Tri County operates a municipal wastewater treatment plant (“Facility”) located in Yell County, Arkansas. The Facility is stated to discharge treated wastewater to Sally Spring Branch which eventually flows to the Arkansas River. Such discharge is regulated pursuant to an NPDES permit. DEQ is stated to have conducted a review of certified Discharge Monitoring Reports (“DMRs”) submitted by Tri County. The review is stated to have indicated alleged violations of the permitted effluent discharge limits detailed in Part I, Section A of the Permit from June 1, 2017, through October 30, 2020, wh

As previously noted, House Bill 1261 (“HB 1261”) was introduced on January 25th which would authorize the Arkansas Water Control Agency (i.e., Arkansas Department of Energy and Environment – Division of Environmental Quality [“DEQ”]) to seek and accept delegation of the Section 404 Clean Water Act program. (See previous post here.) The bill would add an additional section to Arkansas Code § 8-4-207(1) referencing the state water pollution control agency that would provide the DEQ Director authorization to: . . . require conditions in permits issued under this chapter regarding the dredge and fill permitting program established in Section 404 of the Clean Water Act, as amended, 33 U.S.C. § 1251 et seq. and regulations promulgated under Section 404 of the Clean Water Act . . .
