It is alleged the brothers had stolen two Ford Courier utes from Taupō on June 8, 2017. Storm told crown prosecutor Jacob Bourke he had been patrolling the highway when he heard a report about a sighting of a stolen ute. While heading towards where the stolen vehicle was last seen, Storm spotted two utes matching the description and began to follow them. Not long after Storm had begun chasing the utes, the one allegedly driven by Regan pulled over while Matthew continued driving. Storm claimed the ute driven by Matthew stopped about a kilometre down the road and he pulled in behind it, but the driver reversed into his patrol car as he was getting out before speeding off again.
