On May 5, 2021, Governor Cuomo officially signed the New York Health and Essential Rights Act (HERO Act) into law. The HERO Act effectively imposes
significant obligations on covered employers to provide and maintain a safe workplace in the face of the ongoing COVID-19 pandemic, and for future airborne infectious disease outbreaks. As previously reported, the HERO Act amended the New York Labor Law by adding two new sections: (1) Section 218-b, which governs development and adoption of an airborne infectious disease prevention policy; and (2) Section 27-D, that requires employers to permit the creation of workplace safety committees. Both sections only apply to private sector employers. However, Section 27-D specifically only applies to private employers with at least 10 employees.

the Marihuana Regulation and Taxation Act (the MRTA ) into law, making New York the latest state to
legalize recreational marijuana. The MRTA allows adults aged
21 and older to possess, purchase, display, obtain, and transport
marijuana in limited quantities. The MRTA takes effect
immediately, although the sale of recreational-use marijuana is not
expected to become legal for at least another year. The
legalization of marijuana will have significant effects on many
aspects of society in New York, including in the workplace.
New York Attorney General Moves to Dismiss Amazonâs Preemptive COVID-19 Practices Lawsuit

On Monday in the Eastern District of New York, New York Attorney General Letitia James filed a motion to dismiss and a supporting memorandum in Amazon.com Inc.âs âanticipatory federal actionâ against the state filed shortly before the stateâs lawsuit contesting Amazonâs COVID-19 practices in its warehouse.
Amazon preemptively sued the New York Attorney General (NYAG) in February seeking relief from Attorney General Jamesâ alleged unlawful attempts to subject Amazon at its Staten Island Fulfilment Center, JFK8, to New Yorkâs oversight and regulatory enforcement activities. Additionally, Amazon was trying to preempt legal action from the Attorney General regarding the tech giantâs handling of COVID-19 conditions at JFK8.
