Welder suffers back, neck injuries from lifting steel plates, suit claims

HOUSTON A welder claims he suffered serious back and neck injuries due to repeated lifting and carrying of steel plates while working aboard a vessel.  Alberto Camarillo filed a complaint May 11 in Harris County District Court against Westport Orange Shipyard LLC, Kirby Corporation and Kirby Inland Marine LP alleging negligence.  According to Camarillo s complaint, he was working as a welder for Westport at its shipyard in Orange. He claims while working on a vessel which was owned by Kirby, he had to lift and carry steel plates repetitively and did not have proper safety equipment or personnel which caused him to injure his back and neck. Carmarillo alleges he has required extensive and ongoing medical treatment for his injuries and that Westport was a non-subscriber under the Texas Workers Compensation Act. 

Worker crushed to death after man bucket detaches from crane, suit alleges

HOUSTON The estate of a worker who was crushed to death when a crane s attached bucket fell 100 feet to the ground is claiming negligence.  Raquel Spahn, individually and as personal representative of the Estate of John Thomas Spahn, Debra Spahn, Joseph Robert Spahn and Raquel Spahn as next of friend for Palona Spahn filed a complaint May 12 in Harris County District Court against Mesa Line Services, Craneworks Rentals LLC and The Manitowoc Company Inc., alleging negligence and product liability.  John Thomas Spahn was working for Mesa Line Services as a journeyman lineman on March 21, 2021, and was using a crane with an attached man-bucket while working on an electrical distribution pole in Mt. Belvieu, according to the plaintiffs complaint. They allege that the man basket suddenly became disconnected from the jib and came crashing down to the ground and fatally crushing Spahn. 

Wedding guests fall off ledge, sue Dukessa

HOUSTON Guests at a wedding event who fell off a ledge and suffered injuries are claiming the event organizer s negligence.  Cynthia Boyd and William Russo filed a complaint May 12 in Harris County District Court against Dukessa Catering LLC alleging negligence.  According to their complaint, the plaintiffs were guests at a wedding at Dukessa on Sept. 21, 2019. They allege that as Boyd was walking into the ceremony, she fell off a ledge because she could not see the drop-off and suffered a broken ankle.  The plaintiffs further allege that later that night, Russo was taking photos at the wedding when he fell off the same ledge and suffered a laceration on his leg. They claim Dukessa was negligent in failing to maintain the floors and walkways in a reasonably safe condition and failed to install a hand rail. They also claim Dukessa failed to use contrasting colors or lighting on the step to prevent falls or to warn of the dangerous condition. 

Houston CVS Pharmacy fills woman s prescription with wrong dosage, suit claims

HOUSTON A woman alleges a CVS Pharmacy in Houston filled her prescription with the wrong dosage which caused her to ingest double the amount of medication she was prescribed.   Edith Johnson filed a complaint May 11 in Harris County District Court against CVS Pharmacy Inc., CVS Pharmacy Inc., doing business as CVS Pharmacy Store #6238 and others alleging negligence.  Johnson alleges in her complaint that she was given a prescription from her doctor for 500 milligrams of Metformin HCL which was sent to the CVS Pharmacy on West Fuqua Street in Houston on May 14, 2019. She claims her prescription was mistakenly filled for 1000 milligrams of Metformin HCL which is twice the dosage her physician prescribed. 

Customer slips at Houston McDonalds, sues

HOUSTON A Houston area McDonalds is facing a suit after a customer fell on slippery, wet floor and suffered injuries.  Lovelance Sagay filed a complaint May 11 in Harris County District Court against H.K. Smith Management Inc., doing business as McDonalds and McDonalds alleging premises liability.  According to the suit, the plaintiff was at the McDonalds on West Sam Houston Parkway in Houston on May 16, 2019, and slipped and fell on a slippery substance that was on the floor of the restaurant. The plaintiff alleges that there were no warning signs posted about the dangerous condition and that the fall resulted in serious and permanent injuries.
