HOUSTON Home Depot is facing a negligence claim after a boom lift fell on a worker s foot at its store in Katy.
Gabriel Xavier filed a complaint April 16 in Harris County District Court against Home Depot U.S.A. Inc., alleging negligence.
Xavier alleges in his suit that on Aug. 5, 2019, he was working at the Home Depot on North Fry Road in Katy and was attempting to secure a returned boom lift when the lift fell on his foot. He claims he suffered serious and permanent injuries and that Home Depot negligently failed to provide a reasonably safe working environment.
HOUSTON A woman is suing Harris County after she was injured on a broken chair at the Harris County Courthouse in Houston.
Louvenia Johnson filed a complaint April 5 in Harris County District Court against Harris County Texas alleging negligence and premises liability.
Johnson was at the Harris County Criminal Justice Center in Houston on April 17, 2019, according to her complaint. She alleges she was sitting in a metal chair in the hallway outside of a court when the chair went back and hit a wall.
Johnson claims she suffered significant physical and debilitating injuries as a result of the defective chair and that the defendant failed to check the assembled chairs which posed an unreasonably dangerous condition.
HOUSTON A woman claims she twisted her foot and suffered other injuries after slipping at a Fiesta Mart in Houston.
Cecilia Cerna filed a complaint April 16 in Harris County District Court against Fiesta Mart LLC doing business as Fiesta Mart #07 and 2ML Real Estate Interest Inc., alleging negligence.
According to her complaint, Cerna was shopping at the Fiesta Mart store on Bellaire Boulevard in Houston on July 10, 2020. She alleges that while inside the store, she slipped in one of the store isles, twisted her foot and suffered serious bodily injuries.
Cerna claims the floor was not slip resistant or adequately maintained. She also claims Fiesta Mart is negligence for allowing its premises to become dangerous and for failing to keep the store in a reasonably safe condition including keeping its floors free from slippery conditions. Cerna alleges the store also failed to warn of the dangerous condition and that Fiesta Mart should have known of the potential for
HOUSTON A couple claims a Houston event venue breached their contract by not allowing them to reschedule their wedding date due to COVID-19 pandemic capacity limits.
Jamie Rovira and Justin Jacquez filed a complaint April 16 in Harris County District Court against The Springs Events LLC alleging breach of contract and violations of the Texas Deceptive Trade Practices Act.
According to their complaint, the plaintiffs entered into a contract with The Springs Events on Nov. 1, 2019, to use the defendant s venue for their wedding scheduled for Nov. 7, 2020, for a price of $8,450. They claim that due to the COVID-19 pandemic and restrictions placed on the defendant s venue, they wanted to reschedule their wedding.
HOUSTON A Houston law firm which settled a case without their clients knowledge or consent and which failed to pay the whole settlement amount to their clients is facing a suit.
Rosa Maria Pacheco and Juan Pacheco filed a complaint April 5 in Harris County District Court against The Guidry Law Firm alleging breach of contract.
According to their suit, the plaintiffs hired the defendants in March of 2013 to handle the wrongful death case they filed after their daughter Amy was killed by a drunk driver. Also according to the Pacheco s complaint, the defendants and two other attorneys who were representing two other severely injured parties agreed to split the insurance policy limits of $1 million with each of the three claimants receiving one-third or $333,333.
