Law360 (January 5, 2021, 3:01 PM EST) -- A First Circuit panel on Tuesday pushed back on a request by privacy advocates to require U.S. border officials to obtain a warrant to search mobile phones and laptops, with one judge saying the risk to the travelers bringing the case may be overstated.
During oral arguments, Circuit Judge Bruce M. Selya repeatedly raised concerns that attorneys with the American Civil Liberties Union and the Electronic Frontier Foundation were focusing more on hypotheticals than concrete issues in seeking what would be a first of its kind decision.
