Every individual charge in the indictment is charged with one count of violating georgias Racketeer Influenced And Corrupt Organizations Act through participation in a criminal enterprise in Fulton County, georgia and elsewhere, to accomplish the illegal goal of allowing donald trump to seize the president ial term of Office Beginning on january 20th, 2021. It is an interesting indictment because part of the indictment is based on words spoken by the conspirators and the actions that the people undertook, the breach of the voting machines, the harassment of the workers, the filing of false documents. All of those acts cannot be defended that this was political speech or First Amendment protected. It is those things that will be the hardest to defend against. In a rico indictment of this sort, all they need to prove is that two or more of these acts took place by the conspirators, if so, theyre all legally liable. I think it will be a difficult defense for the trump team to make here. The defense has brought successful rico cases. She knows how no do this. It is complex. It took two and a half years. That may be much more of a priority. But this indictment is the fourth. And that means there are others, the two federal indictments and then the one in manhattan here in new york. Well see what gets tried first and if anything comes to the other, if jack smith calls and says let me try my cases first. But this will take a significant amount of time to try, for sure. It is a fiveyear mandatory minimum, maximum of 20 years. So with a mandatory minimum, what will be tricky for fani willis, the District Attorney, let them plead out of the case and let it get skinnied down to the top tier departments so you have a much more manageable trial. Like the state, you make a great point, if he becomes president again, he cannot get rid of a state conviction. And in Georgia Neither can the governor on their own. It has to go to a pardon door . I think it goes to the fact that these were not victimless crimes. This was not just about paperwork. It wasnt just about an election. They are just are just two of the Election Workers in georgia of that been harassed, intimidated and the subject of some of these indictments. Everyone knows his comments about finding 11,000 plus votes, essentially one vote that he was losing by at that point. The defense from trumps supporters and some legal officials that are tide to his operation has been, you can not prove that he meant to familiarsly to falsely find fake votes or ment to find legitimate votes. Is that viable . It is viable you can make in the court of law without it being called frivolous. I think what they will say is that he did not undertake these phone calls with criminal intent or wilfulness because he was doing this in good faith because he honestly believed that he won the election and it was stolen from him. That is the nature of their defense. This indictment as we talked about, other things beyond that phone call, that are not speech protected. They are actions and those actions have no First Amendment overlay to them and they are not easily defended. As we talk about the ruby freeman stuff, Rudy Giuliani was sued for the statement. He admitted they were lights and not true. He said that he didnt believe he owes her money. This is an acknowledgment that will come in in evidence in this case.
