This is about a Pressure Campaign on georgia lawmakers about the illegal accessing of voting data in the rural county. And it was and overall Pressure Campaign by trump and his operatives to overturn the election here in georgia. [ no audio ] there are several pillars that are laid out in the charges that led it together. What was your sense after reading the indictment about the case that was actually brought here . It is an interesting indictment because part of the indictment is based on words spoken by the conspirators and the actions that the people undertook, the breach of the voting machines, the harassment of the workers, the filing of false documents. All of those acts cannot be defended that this was political speech or First Amendment protected. It is those things that will be the hardest to defend against. In a rico indictment of this sort, all they need to prove is that two or more of these acts took place by the conspirators, if so, theyre all legally liable. I think it will be a difficult defense for the trump team to make here. The defense has brought successful rico cases. She knows how no do this. It is complex. It took two and a half years. Shes going to try to try trump and 18 defendants in six months. Reporter do you intend to try all of these defendants together . Do i intent to try the 19 defendants in this indictment together . Yes. That happened, that many folks . The Defense Attorneys persistently make motions for severance. What does that mean. When youre embroiled in an indictment like this, where there is so many, were talking about indictments that are speaking indictments, this indictment is singing. It has so much specific information relative to the criminal enterprise and the criminal activities. What happens . What happens is that there individuals that have individual lawyers im going to move to sever my case because i should be tried separately and independently and there may be acts that may inform criminality to me that i should not be charged with. I think theyll they will try to sever and separate the cases. Were not there yet. The reality is that some defendants may say take priorities. There is one person, donald john trump. That may be much more of a priority. But this indictment is the fourth. And that means there are others, the two federal indictments and then the one in manhattan here in new york. Well see what gets tried first and if anything comes to the other, if jack smith calls and says let me try my cases first. But this will take a significant amount of time to try, for sure. Following up on poppys county and rico charges. It is on a state level and not a federal level. It carries a level of threat to the former president that we have not seen in such in in an accute sense as the others. Can you talk us about that . There are a lot of people in this indictment that are going to seek pleas frequently, some seeking severance, for sure. Rico charge carries mandatory minimums. You must spend time in jail. It is a fiveyear mandatory minimum, maximum of 20 years. So with a mandatory minimum, what will be tricky for fani willis, the District Attorney, let them plead out of the case and let it get skinnied down to the top tier departments so you have a much more manageable trial. Like the state, you make a great point, if he becomes president again, he cannot get rid of a state conviction. And in Georgia Neither can the governor on their own. It has to go to a pardon door . Yes. That is significant. We have the two federal documents and there will be an open question, if he becomes president. Does he pardon himself . Does he have the ability to pardon himself. And you look at the indictment in georgia, you dont have the ability as a federal official even if youre president because the states are so lens sovereigning themselves. If he becomes president , it delays it further and does he go to trial after he serves in office. If he becomes president will this actually stick then will be the question. And now they have to turn themselves to the federal people in georgia. How he may use that to his advantage. That is straight ahead. And there he is. Chaz. This is Fulton County in atlanta where the charges were brought by fani willis. There is Surveillance Video showing a official working were trump attorney inside, you see it here, over a restricted election office. And this feet taken by a journalist said that he walked in on a secret meeting between fake electors that gathered to sign a illegal certification for trump and there is trumps infamous phone to georgia Secretary Of State Brad Raffensperger, which trump himself called perfect. Joining the conversation is patricia murray. I dont think patricia has slept in two years as of this time. I want to talk about the element that make up the indictments and that is the case of ruby freeman and shane moss. I think that sometimes that gets lost in everything. The human. Yes, the Human Element of this h i want to play some sound what Ruby Freemans life has been like. There is nowhere i feel safe, nowhere. Do you know how it feels to have the president of the United States target you . The president of the United States is supposed to represent every american, not to target one. But he targeted me. There has been so many moving parts, not just this case, but the different indictments that the former president is facing. Can you walk people through Ruby Freemans reel here and why it is a central piece of the indictments . Absolutely. Ruby freeman and her daughter shea moss were two Election Workers in 2020 during the elections. And there was video, Surveillance Video taken of the vote counting process. And at certain point during the evening, the owe Election Workers were told by the state office to stop counting and go home. But he changed his mind. That was caught on video. They began to count the votes again. But that video then game the subject of Conspiracy Theories here in georgia and the aftermaths the elections, including run by Rudy Giuliani and donald trump, they both named ruby freeman and shea moss and they say that this has mostly been destroyed by this process. I think it goes to the fact that these were not victimless crimes. This was not just about paperwork. It wasnt just about an election. They are just are just two of the Election Workers in georgia of that been harassed, intimidated and the subject of some of these indictments. Former President Trump on that famous call to the secretary of georgia, he called her a scammer and hustler. And then Rudy Giuliani had something to say. Ruby freeman and Shea Freeman Moss and one other gentlemen started passing around us about ports saying they were vials of heroin or cocaine. It is obvious they are involves in illegal activity that day. As of a week ago, theyre still Walking Around georgia lying. They should have been questioned already. Theyre places of work and homes should have been searched. He is accusing them of crime. The words are used to charge him with the crime. As they should be. Words have consequences and conduct has consequences. And when you have someone who propagating a narrative that knows that it is false and theyre doing in conjunction with the criminal enterprise with other people surrounded by them, all engaged in a concerted effort to overturn an election, that is problematic. You cannot go and say things in public. Well, you can but if they are harming and not true, they can come back. You can say that Rudy Giuliani can legally say things like that explain how it becomes a crime. Explain how it becomes a rico when it is furtherance of and in coordination with the, with the other actions . Lets talk about rico. In the rico statue, which is a broad ranging statue which points to a criminal enterprise. You need at least two. You can talk about the pattern accounts with respect to the computer tampering. You can talk about them in in terms of mr. Rudy giuliani intimidating witnesses. The indictment speaks to a lot of that. So there are pattern acts that deal with that and then you have, in terms of the conspiracy, which are two or more people that degree to an agreement. You can conspire with a team and criminal enterprise to do some nasty things with verbal conduct. The Text Messages and other communication that led to that. You mentioned the call between the former president and the former georgia Secretary Of State Brad Raffensperger. Everyone knows his comments about finding 11,000 plus votes, essentially one vote that he was losing by at that point. The defense from trumps supporters and some legal officials that are tide to his operation has been, you can not prove that he meant to familiarsly to falsely find fake votes or ment to find legitimate votes. Is that viable . It is viable you can make in the court of law without it being called frivolous. I think what they will say is that he did not undertake these phone calls with criminal intent or wilfulness because he was doing this in good faith because he honestly believed that he won the election and it was stolen from him. That is the nature of their defense. This indictment as we talked about, other things beyond that phone call, that are not speech protected. They are actions and those actions have no First Amendment overlay to them and they are not easily defended. As we talk about the ruby freeman stuff, Rudy Giuliani was sued for the statement. He admitted they were lights and not true. He said that he didnt believe he owes her money. This is an acknowledgment that will come in in evidence in this case. It proves this aspect of the indictment. That is a very good point. Stay with us. Well have you back with the next panel. There is a lot to dig into here, including the names that you very much home in at this pointed, Rudy Giuliani, meadows, east man, powell. But there are others that you may not have heard of.
