This morning we are tracking several developments as donald trump faces Felony Charges for trying to overturn his 2020 election loss in georgia. This is whats new overnight. The sheriff says the former president will be arrested and booked at the county jail when he surrenders. The District Attorney has given trump and his codefendants until noon next friday to turn themselves in. Trump says he will be holding a major News Conference on monday to prove the election was somehow rigged in georgia, even though multiple recounts and court cases have proven over and over and over again joe biden was the winner and trumps lawyers withdrew every one of those cases. Rudy giuliani, one of trumps coconspirators says he will surrender and hes slming the da for using racketeering charges. The same type of charges he used to prosecute mafia leaders in the 80s. Hes a politician and not a lawyer. Not an honest, honorable lawyer. This is a ridiculous application of the racketeering statute. Theres probably no one that knows it better than i do. This is not meant for election disputes. This is ridiculous what shes doing. Also, i dont know if she realizes it because she seems like a pretty incompetent, sloppy prosecutor. Another codefendant, mark meadows, is fighting to move his case from State Court To Federal court to try to get it dismissed. Thats the most fascinating part of it for me. Lets bring in senior legal analyst elie honig. We know these new things out of georgia. What does this tell us . All four indictments are in. Lets take a moment and assess where we are and whats next. Fulton county is the newest one. Whats happening in that case . The judge has given the parties until august 25th to surrender. Thats the easy way. If they do that, they come in themselves and are processed. If anybody does not surrender, then the dad. A. Has the right to send out Law Enforcement officials to make an arrest. The other big issue, and we just said this, removal, get ready for a lot of talk about removal. Mark meadows is trying to do this. Donald trump will try to follow. In a nutshell, this means if a federal official gets charged with a state crime that relates to that federal officials official job duties, you can get the case moved over to Federal Court and then potentially dismissed. So these are really important motions. Mark meadows has already done this. Trump is sure to follow. The other thing that were watching for here is we have 19 defendants in this case. Thats a lot. And a lot of these folks are facing criminal charges for the first time. Are people going to try to save themselves, cooperate and flip. If so, are they going to be able to take prosecutors up this hierarchy chart. Watch and see if anyone pleads guilty or if theres Cooperation Agreements or an information. A lot of whats in the indictment is part of jack smiths most recent indictment talks. Walk us through those three outstanding cases. Now were into the federal cases. This is jack smiths 2020 election interference case. The big issue there is what will the trial date be. Doj put in a brief asking for january 2nd. Pretty aggressive timeframe. Trump is not responding yet. His response is due later this week. Maybe never. Certainly after the election, and the judge is holding a hearing to decide the trial date and other sklking issues on august 28th, a week from monday. The other jack smith federal case, now were talking about the maralago classified documents case, they are going through how are we going to handle classified documents. Doj returned a superseding indictment, a version 2. 0 where they added this other defendant and added three charges against donald trump. The question is that going to come promiez the may 2024 trial date . The dynamic, trump is going to want to push back. Doj is going to want to say lets keep it. The first of the cases, the ma manhattan case, they are going through pretrial motions and they have a date of march 2024. Calendar . Look how wide open it is. We have an election in november of 2024. New york, the hush money case, their trial is scheduled for march. Thats going to go through april. Maralago, the florida case, that is set for trial starting in may. Thats going to go into july. Now where are the other cases going to fit . Lets take jack smiths case. They want to start it in january. They do not have enough time to get that in before the new york case. Then we have fani willis case. Theres no place for that. You cant so close to the election. If they start a trial in august, theres no way. Especially a rico case. I dont see any room for fani willis case before the election. Even jack smiths case, someone has to get rid of this. The d. What she suggested is she maybe forced to preserve the sanctity of the jury pool, she maybe forced to move the trial date up sooner if this continues. So well see if the government tries to suggest a that he has reached that. Youre going to see a pretty aggressive defense in that case. They are trying to lay down a marker this ought to be in Federal Court. Im not surprised it was only him. I dont think in a rico case where defendants are arguing they want to move together. I think that meadows is going to make a specific argument as a former chief of staff. But as you note, med does is the focus of specific attention for a lot of people. For people around trump because people have wondered what he said, for prosecutors because hes one of the people who knew a lot. Now he has clearly was not especially help ful to investigators in georgia. You can just read the indictment and see that. But i think you are going to see him try to argue very ex extensively he should not have to face trial in a state court in georgia. I dont want to speculate about what he may or may not have done in other cases. With january 6th, house select committee, he partially cooperated. He would not give an interview. You think about generations of history on that island that has now been ruined. So were going to continue to be there not just for the shortterm, not just for the shortterm, but for the longterm. And sadly, this president has had to deal with many disasters in the past two years. He has shown up and he has been there and we have federal assistance continuing in those certain other states and cities that are still doling with their disaster.
