Justices Law360 (December 17, 2020, 5:20 PM EST) -- The Illinois Supreme Court on Thursday affirmed the revival of claims by a group of tenured faculty members at a southern Illinois community college who say the school laid them off but then unlawfully hired adjunct instructors to teach the same courses they'd been teaching. In a 5-1 decision, the state's top court held that those adjunct professors count as the kind of "non-tenure faculty member or other employee with less seniority" who the Public Community College Act prohibits from being named to positions within two years of a tenured faculty member's layoff.
