In reference the South Carolina Mining Act, specifically Section 48-20-250, which states the following: âNo provision of this chapter supersedes, affects, or prevents the enforcement of a zoning regulation or ordinance within the jurisdiction of an incorporated municipality or county or by an agency or department of this State, except when a provision of the regulation or ordinance is in direct conflict with this chapter." As demonstrated by the South Carolina Mining Act, oversight of the day-to-day operations of a mining operation rests with DHEC and other relevant state and federal agencies. However, it is the right and the responsibility of Horry County Council, as illustrated by the Mining Act, to determine where mining operations can be established, to ensure that they do not become a public nuisance, to ensure that they do not cause harm to our waterways and to our environment, and to allow mining operations to meaningfully contribute to our county.
