Especially, for antitrust. What is your take on that . Speak to one of the important factors is the california ag is not one of the 48. Only two states declined in california is one of them. It could be and i have not had the conversation with the attorney general about it but google is a google based company and if we want to look at how its doing its Business Practices is important to do it in the a thoughtful way and i know that the department of justice and the federal trade Commission Also talking about doing investigations in competitive practices with these companies. Its good to look at this and investigate it and make sure committees are behaving. Im not sure bringing companies up is a good idea and these are Big Companies with a lot of tentacles and a lot of employees and if you break the company up like that and managed to do it there will be unintended consequences. For example, what will happen to the data that these companies own how will be parsed that up and coming people will be displaced. Will it have an effect on the overall economy . Regulatory approach might be better than antitrust, in my opinion. Host does your district in california have a tech presence . Guest there is a tech presence. Basically we are i dont want to say were a suburb of Silicon Valley but we are affected by Silicon Valley, i think. Maybe about 40000 people for my district commute to the bay area for their jobs. Not all our tech but quite a few are. Its a long hard swab i dont envy the people that have to do that and i go back and forth to washington so there is a tech a number of people at work in the tech sector live in my district. It sounds like they were reluctant to go forward of breaking up the companys a given its entered that sphere how do you view that now . It may be a popular issue to talk about but if you look at the details of what it will take and who will be affected by it and its important to look at all possible ways to manage these companies. They clearly have run off the rails in some instances and ill be glad to talk with those with you but it might be better to look at how to contain those with regulation than regular breaking the companies out. The talks should be more moderated the mac one issue you did a lead of the summer was the issue of the faith which is digital forgeries and that came up in a big way when it was rudimentary version of that made of Speaker Pelosi and its slow down her words and make her look intoxicated when she in fact, was not. What have you heard from the companys consent and how concerned are you about this issue of the fake with the 2020 election . These are entirely digitally forged videos to make people look and say things they not been at all and its created quite a stir in recent months but what have you been hearing from space bar specifically given they were front and center in the conversation from Speaker Pelosi and the deeper fix their. Guest there is a distinct distinction between the fakes we completely fabricate statements or views and what happened on the altar video but they might have the same effect. If they are used to alter the electorate in front of the election thats dangerous. We need to be careful about that and we remained aware that there was facebook was monetizing that video and so that is what set me off and wait to see videos like that become viral because you never know what the final impact will be. I initiated a letter in facebook to Mike Zuckerberg in a regular and has almost all the democrats on the committee find that letter and they were willing to do so including the chairman and the letter was received and when we got back the response from facebook was that it was a very simple terse letter did not give me any comfort that they are taking the steps they need to take to protect our elections from false information from extreme you point. Host have they followed up any other way . Guest they talk about these things since then and they had recent announcement referring to a hundred Million Dollars investment there trying to make part of a fake detection competition which they do not know if there have been anyone else to reassure you or that remains a strong concern going in to next year and the election. I think they have not satisfied my concern at this point and id like to see them id like to see them in certain ways to gives me comfort that they are doing something and they havent committed the resources that are needed to do this. Host congressman mcnerney, he mentioned that there were times where these Tech Companies have run off the rails. If you could cite an example of that the concerns you along with what john was talking about with the defense but also is there a role for congress in some type of legislation if youre hesitant to seed the antitrust movement go forward . Guest yet, there is. Cambridge analytical comes to mind immediately but just the way they been using data whether they been willing to sell it and im not at all comfortable that theyre taking the care they need to of data in American People are concerned and they feel like theyre losing control of their data what are they using it for . Will affect them when they tried to make a loan . Will affect their Health Records . Will they try to use that to sway them in a political manner . These are things americans are rightly concerned about and weve seen case after case where these betas are not being taken care of in a way that is needed. For example, facebook takes a thought of data that they do not need. We should have a requirement maybe allegedly the requirements of privacy that requires data minimization. If you dont need data dont store it. Also, Data Security. Are we going to require them to use encryption or other sorts of very strong methods to protect data once they have it . Those are couple of things we could do on legislation. Host how far along are some of the conversations regarding data privacy legislation at this point . I feel like at the beginning of the year people pointed to that is one of the big potential unifying topics that can Bring Congress together and spend conversations with senate and house but we are now approaching middle of september and it still hasnt been any bigger proposal put forward by either congress committee. Is that something that concerns you in any way . We think the reason for that is and what have you been seen by the scenes in terms of those conversations . Guest what i forgot to say when we started is these are issues that are propagated and they often have a nuance in both sides of the story with regard to privacy, yes, the Consumer Protection subcommittee is working on actual legislation and my focus has been on the areas i mentioned with data minimization and Data Security but the committee is moving forward on developing legislation. We are getting closer and closer to californias own roles going into effect. Is that something that you are pretty open to . Will a federal bill should go into effect before then . How did the california delegation balance that . Thats an interesting thing to consider because he sees sos people in industry and republican lawmakers saying we need federal bills so we can put that in place before californias rules actually go into effect. Guest im proud of the state to put together a strong Consumer Protection on privacy. Of course, it follows the european cd pr bill but or gdp are, excuse me. The bill is strong in the California Law is strong and looking forward to seeing it go into effect. I think theres been concerns one way or another but on the federal level we need something thats also very strong. One of the concerns is will we have federal bill of premiums or california will it have its own bill and so on. I think it remains to be seen how that issue gets worked out. Again, i would not be able to go home to my constituents and say i voted for federal preemption that weakens our own protections so there will have to be negotiation on this. Host do you hear from your constituents on this issue . Guest i certainly do with this issue i hear considerable amount and i also hear a lot about neutrality. Host what you hear from th them . Guest books want to have that neutrality protections. The big throttling, blocking, state prioritization though things are pretty clear and we need to protect consumers from those land right now the federal mitigation is basically advocated abdicated in the authority so the companies are free to do whatever they want. That will lead to problems. I dont know how long that will be before problems start cropping up but they will. The house we passed a pretty strong Net Neutrality act this year and its not going anywhere in the senate and thats a problem for my republican colleagues is that americans want Net Neutrality protections and i think the republicans need to step up and move this forwa forward. Host do think that will be salant as an election issue with using Democratic Candidates mentioned that neutrality and their problems so far. I think virtually all the major candidates possibly the exception of joe biden refer to Net Neutrality in their platforms and how do you think voters typically view that issue . Will that be something you see is the animating force or less lesser . It is an animating force. Theres a subset of my constituents or of any district constituents that feel strongly about this and it will be a single issue for a lot of those folks and rightfully so. They need to know that information is not being blocked and that something that one of the Big Companies does not want to see out there is box from these throttles. This is a significant issue with a small subset of my electorate but i want to serve all my district, not just the subset or that subset. They dont take their issues into consideration im not doing my job. Host congressman mcnerney, to hear from your constituents on the share of global cause . Guest i certainly do. Thats an issue that is driving people crazy. We were having a hearing and people were on the committee getting robo calls as we have hearings. Its an issue that has technical solutions. Not only that but an issue that has bipartisan support in the house passed the bill and the Senate Passed the bill and we will get something done that. Host talk about a technical solution but is there a First Amendment issue at play here as well . Guest i really dont know how to answer that one. If we allow robo calls to continue you know what will happen connect people get call after call and they stop answering their phones and phones become obsolete. We have to do something to protect that Critical Infrastructure of ours. Host seems like you see that as potential victory that could come together. I know there was a hearing recently in commerce on broadband it was almost a three hour hearing about the bipartisan frustration with the state of data and the fcc right now. Is that something that you see coming together in the next few months maybe and in a bigger legislative way . Guest absolutely i do. We considered several pieces of legislation and all of those or maybe at least all but one were bipartisan and they had a cosponsor on the other side of e aisle. There is a clear need for better maps. The maps we have out there theres a lot of holes in them and the granularity for the revolution in my terminology the latency and these are issues that need to be improved. It is widely accepted in the technology is out there been a couple of witnesses were very clear that we can move forward in this and try it in virginia and in missouri and we were successful. I think we can before with our legislation to make sure that happens in that the fcc takes over this and makes it happen on a national scale. Host any concern about a broader kind of congressional slowdown in productivity . Always feel that conventional wisdom was you closer to the auction it becomes much harder to do these things versus prioritization in terms of dumping in their and how much is that going to be a factor . Guest i think we have government funding is always an issue but beyond that these two issues that we talked about robo calls, broadband mapping there is a number of issues like that but theres a good bipartisan will to move forward. Host just to follow up on johns question then do you see any legislative action in the next two or three months in congress . Guest i personally would love to see some action in infrastructure and the lift america act is an excellent example. We find the will and way to do that and build out our broadband infrastructure but we need to have the maps first as we know where the weaknesses are and then we can start rolling out. Following that we have whether broadband is widely adopted so we have a number of on that particular and researcher issue. I think there are a couple of milestones we need to keep in mind. Host congressman, have you been briefed yet on jim watkins, founder of [inaudible] when he was in Congress Just fine and a closed hearing . Has he been briefed on that as yet . Guest no, i havent. Its certainly an area of concern. If there are websites out there that people are using to incite violence or hatred then i think we need to look at ways to control the ability of that. Obviously, those things are protected to a certain degree by free speech but you cant go into a theater and yell fire but there has to be some guardrails but the real crux of this is how do we keep that from the viral and how do we keep those hateful violence inciting messages from going to a wider public that will cause action that would be harmful . Host does your background as a mathematician and form your views spark your interest in these issues . Guest it certainly does. I love math and science and being able to work in progress on tech issues is a pleasure for me and its almost like im not at work but having fun out there doing something i enjoy. You been able to step up and cochair of the Artificial Intelligence and the wifi caucus so how do you approach some of the issues like that especially with ai . What should the government be doing on ai and other specific steps maybe is not happening that you think should . Guest speaking of ai when pete olson the other cochair asked me to be his cochair to this term i open up the books and started studying ai. Its a fascinating area but the purpose of the caucus in my mind is to put information out there so there are colleagues can understand what ai means. Is it as scary as it might sound and will create jobs that will transform society in some way. We need to use the caucus to inform. Other members in congress of staff and thats what we try to do. Weve had forums and summits that i can tell you when we have a forum a few ai experts the rooms are crowded and there ending so people are interested. Ai histamine is potential to transform society in a positive way. We can make our city safer in our streets a lot safer for driving and it can help with agriculture and certainly in healthcare and there are a lot of areas that can be helpful and we have concerns. Will it be or can we put standards that prevent the bias problems that might occur with ai . Will be allowed ai to bias financial records or healthcare records in weight that might be harmful to people . We need to establish standards for that. Will it be an important part of our National SecurityInternational Defense . What about the employment issue . Will be be able to use ai to create jobs and you think ai will eliminate but that will not happen. Most any job that someone has has several [inaudible]s with a tapestry. You want to find the complements that will work with ai and replace the ai and put those together in a way that makes people more productive and does not eliminate jobs. Host how have we used ai already today in our daytoday basis . Where do you see ai going in the next fiveten years . Guest i think healthcare is the most obvious. You can have ai trained to look at the xrays and radiography and its more accurate than radiologists so i think thats an important application. Also, i see youre getting closer and closer to self driving cars and thats a lot of Artificial Intelligence that goes into those circuits to know how to react to different stimuli. I dont know will ever be perfect but we could easily be better than humans. I dont know when that will happen but its not too far off. Those are a couple of ways in terms of traffic patterns how we can use Artificial Intelligence to make our cities less congested. There is a lot of opportunity out there and it will be coming down the line pretty quickly. Host what do you think is the best role for washington when it comes to the development and implementation of Artificial Intelligence . Guest you may know this but i proposed and ai in Government Act and basically what it does will create a center of excellence within the gsa for ai and that means it will have experts and they will have the resources in computers and the training methods and also to help other agencies within the United States government to adopt ai in positive ways into bill implement roles with ai is very hard to hire people in the government because of fight you can make more money. Lets put it that way. How can we bill the government posts with these important positions . Thats the first step, i think, but i would like to see a litt
