We are still waiting for assurances of the enforceability in it because you can have all the good provisions but if you cannot enforce them you just have a conversation and there are some concerns will china really honor any commitment they make . What about the other considerations that hurt americas manufacturing base. With this is for the People Agenda legislation that we have. So legislate and investigate he will report on some of that how proud i am of him and the members of the Intelligence Committee with valuable legislation that they have done. And in terms of litigation in terms of congresses authority under the constitution and today another decision came down in their favor to emoluments. Again another recognition our founders had very deep suspicion of foreigners interfering in our government and elections in emoluments was put there specifically for that purpose to protect us from any influence of Foreign Government. So the fact we would be here with the inquiry that we made to the president asking a Foreign Government to help the president and his reelection by granting or withholding military assistance voted on by congress has so many violations in it and it undermines our National Security with military assistance because ukraine meeting that all roads lead to putin with the president. And then undermining the integrity of our elections and with the oath of office to preserve the constitution of the United States to the best of his ability. So in any event the ruling we won last week that three of them preventing public charge from taking effect in the National Emergency declaration we had a case led by chairman cummings with the Oversight Committee that reaffirms the authority and responsibility to conduct oversight to consider legislation on behalf of American People and the court ruled the following in the case, contrary to the president s argument the committee possesses authority under both the house rules in the constitution to the measures and the measures must comply. So again five victories on friday and one today with the emoluments. Now that just happened. We just had a meeting with our caucus to brief where we are on the legislative agenda. As i mentioned we are legislating and litigating and investigating with a very distinguished chair of the Intelligence Committee mister schiff. The speaker doesnt vote unless it is a tie. And if you have any questions of our legislative agenda . [inaudible] we spoke about some sanctions bills and having legislation with a joint resolution to oppose the president s decision about syria. Hopefully we will take some of that up this week and mister angle is leading the way for us under the committee. I am hopeful and i think senator graham fell back a little bit with his language but hopefully he is where he was in the conversation that we had with a bipartisan bill to a one oppose the president s very dangerous decision and have legislation with strong sanctions against turkey. The president gave the green light to turkey to go in and do a humanitarian disaster making as an untrustworthy ally and then with the sanctions are just not up to the task so thats where we are. Thank you madam speaker we want to give you a brief update on the investigation we have made dramatic progress in answering some of the questions surrounding the july 2012 telephone call where the president sought to coerce a vulnerable ally into conducting what can be contrived as a sham investigation with his opponent and with the 2016 election. We have learned that was not in isolation there was preparatory work done before the call. A lot of followup work that was done after the call. And we have learned much of this thanks to the courageous testimony of the state Department Officials who have been put in an impossible situation by the administration and that is urge not to comply with the law or with a lawful subpoena by the u. S. Congress. They are doing their duty. People should make no mistake. They are doing exactly what they are required to do. And showing enormous courage. I think we owe a great debt of gratitude to those who have to have been so many false smears on your character but continue to show the courage to come forward to speak to the committee we are also learning the conditionality to condition a meeting that was desperately sought by the uk ukraine president in order to get a commitment from the president to do these political investigations on behalf of the president of the United States. We are learning about the conditionality of the meeting and just to underscore how it was for ukraine. For those to have a meeting with the president but most particularly true for a country invaded by its neighbor russia is still a very hot conflict to show that the new president had a Good Relationship with the president of the United States. So that gave enormous leverage to President Trump to coerce what he wanted from the president of ukraine. At the very time the state department is trying to urge ukraine to follow the rule of law the president of the United States is preaching that president to engage in political investigations. You cannot have a message more contradictory from the statement than what we saw in that call. So we had bringing witnesses in at a furious pace that has accelerated with a very busy few days and weeks ahead but we are running into what we expected in one aspect is a complete effort by the administration to stonewall. Today it is long past due when the state department was subpoenaed to provide documents. The state department has requested of those we have contacted instead of giving them to us give them to the state department under the expectation that they would turn them over to congress but thus far they have refused. And were it not for the fact we would not know there is a paper record of efforts to condition this meeting and perhaps condition military support itself on these political investigations. Those documents would have been completely bottled by the state department. We know from the witnesses that have come forward there are additional documents may have provided that have not been given to congress. So the evidence of obstruction continues to mount. Today was the deadline for omb and the pentagon to provide documents. The secretary of defense on sunday stated he would comply with a congressional subpoena. Apparently his willingness to comply has been countermanded by a Higher Authority we must presume the president has instructed the Defense Department not to comply or through the white House Counsel. Notwithstanding the defense secretary willingness to comply with lawful process the office of omb had a pivotal role in the suspension of Ukraine Military assistance they refused to provide the documents that would give evidence as to why that was being done. And so the case of obstruction of Congress Continues to build but even as that case continues to build, we are nonetheless continuing to get good and Important Information from these courageous witnesses. [inaudible] thats an important question to understand the fundamental difference of where we are today with ukraine investigation and how the russia investigation was conducted and the watergate investigation and clinton investigation were conducted. Each were independent counsel are special prosecutors doing the investigation, the initial investigative work that was all done behind closed doors. And it was done behind closed doors for a reason by the special counsel that there is a profound investigative interest to make sure that one witness does not have an opportunity to read another witnesses testimony to hide the truth or color the truth or how much they can give or conceal im sure the president would like Nothing Better than to have witnesses have the advantage of what others are saying brickle there is a reason why special counsel mother line special counsel mueller did his investigation in private and others in like manner. There is no special investigation going on with the conduct through ukraine but congress has to do that because the Justice Department said there is nothing to see here. And we dont even want to look because the fundamental attitude of the attorney general is the president is above the law. The president is not above the law. But it has forced congress to do the initial investigative work that normally a special counsel would do. There are good and sound reasons brca know i should tell you that each of these Committee Interviews and depositions in open hearings, come on republicans are completely represented all members of the three committees have been invited to attend and ask questions their staff have been invited to ask questions and indeed we have alternating onehour majority minority they have been largely staff conducted interviews and we go until the questions are exhausted. So they can ask whatever questions they want in a process of which they have as much opportunity as the majority to ask questions. Some people need to understand that there was full participation by the gop in each interview and deposition and there will be with the open hearings. We do anticipate a time when we are releasing transcripts when we may call back some of these witnesses and those in open session but we will do so giving the gop members at opportunity to ask questions also mindful of the needs of the investigation because we are not unconscious of the fact people have come before our committee and lie to our committee. One has pled guilty, one is in trial. We want to make sure we get to the truth and this is the process early in the investigation that makes the most sense. If you keep witnesses from testifying you say theyve all come before you are they able to answer every question and not being prohibited to do so quick. They have been fully cooperative they understand their legal obligations. They have often sought guidance from the white house. Are you invoking privilege . Where is the doj opinion that accompanies privilege to set out specifically what questions you believe would call for the elicitation of privileged information. The white house doesnt want to do it and they havent so theyre not giving guidance to the witnesses. Part of this is designed to intimidate the witnesses to say were not going to tell you we want you to take the risk its a way to chill them from cooperating. Its not working but i think thats the goal. We have seen a white House Counsel take the unprecedented position that not only is the direct conversation privileged but with donald trump that was not even in a conversation with someone who never worked with the president is privileged or could be or even a conversation which two people neither are there are privileged. It is unrecognizable our conversation may be privileged according to the white House Counsel. [laughter] but it goes to show legally the position of the white house is not supportable you see this reflected in Court Decision after Court Decision after Court Decision where judges have said the arguments legally hold the water. But they are succeeding to build a case with obstruction of congress. The white house says is not cooperating because there hasnt been a formal impeachment inquiry so why not call their bluff quick. I will let the speaker respond to that but the constitution is very clear. The house has the sole power of impeachment and no court will find otherwise. But they dont want to discuss the president s conduct they would much rather discuss process because they cannot defend his conduct and every time they are asked you can see just how difficult or impossible it is to justify the unjustifiable. It is a requirement that we have a vote so at this time we will not have a vote so with the thoughtfulness of our caucus to be in support of the path we are on with fairness and seeking the truth and upholding the constitution of the United States. But that is a key point. So if youre not ready to have a vote then why not call the bluf bluff. Because we are here to find the truth of the constitution this is not a game. This is deadly serious and we are on a path that is taking us to a path of truth that respects the constitution. Mind you on september 17 on constitution day. Constitution day the day our constitution was adopted 1787 and found the president violated his oath of office to preserve the constitution of the United States to the best of his ability we are honoring our responsibilities we are honoring the constitution that is not what they are doing. Are you concerned about the president. Im not concerned about anything. They have no substance they cannot defend the president.
