And Commerce Committee are going to determine americas leadership in the world. My goal is to make sure that we are leaving on energy and climate and healthcare and technology 5g, Driverless Cars 14 forcing the digital abide major americas leading and the rest of the world is following our leadership. At the Top Republican on the Consumer Protection committee some of the issues is privacy. Yes. Where is your marker . What do you want to have done . The racket is very Important Congress act and that we set a National Standard for privacy in the United States of america. Right now what is happening is we are starting to see a patchwork of laws across the country and california has led with c cpa that what was going into effect right now and other states are introducing their own laws. Washington state, my home state, has introduced legislation and there is nearly 80 separate bills being introduced at the state level that are addressing privacy because congress isnt acting. We need to pass a National Standard or we miss having a patchwork of laws across the state that are only going to cause more confusion for consumers and also making it difficult for businesses. We could run into a situation with a blackout state because there laws might be in conflict with one another but it is just underscoring the importance of Congress Acting and i am encouraged and have been working very hard with the chair of the subcommittee on a bipartisan bill and in congress where the only bipartisan bill and play and we are continuing to hammer out important provisions. We released sections of a bipartisan privacy bill right before christmas and asked for input on it and our goal was to introduce language that would be stronger in california, that would ensure that consumers know that the information is protected also, beef up the enforcement at the enforcement largely at the state level. Our billing among the ags and the ags and the ftcs we beefed up some at the ftc but we need to make sure there is strong Enforcement Mechanisms and the goal was to have language that is strong so that we dont continue to have a some saying we need a private right of action. I fear a private right of action in privacy legislation will be a damper on the innovators and Small Businesses in particular. The European Union came up with a gdp are and we had are we headed in the right direction . I believe we could do better and we can do different than gdp are. Gdp are is going into effect in europe and what you are seen are increased Compliance Costs that are pretty dramatic and one, 10 million in Compliance Costs is a significant barrier to entry and in america my goal is to make sure we continue that we are leaving in innovation and encouraging the startups. If you create a significant barrier to entry around privacy and the regulations on privacy that will be a damper on the Small Businesses within the startup. That is part of what we are hammering out here is how to move forward with important privacy protections and a standard in place but also that will ensure that the innovators in the startup can continue to be the next generation of competitors and disruptors. What are the chances of a privacy bill coming through in an Election Year . Some will say its a long shot. However, as the california laws have been implemented in other states are moving forward i believe there will be an increased Awareness Among people that the patchwork is unworkable and isnt going to create the trust that we need to be building with consumers. With that there is an opportunity and it will underscore the importance of Congress Acting. Part of your district in washington is rural so how do you get 5g to your district . Is an important . And may be the number one issue right now. Its a number one issue in my district it is closing that Digital Divide. It is, it is foundational to our economy and foundational to our future and as you think about communities in Eastern Washington and all over the country the access to the internet is foundational to our economy, foundational to education, more and more education is demanding access to the internet, children are doing homework on the internet need to have access. Healthcare and very excited about telehealth and very excited about what it means for people who live in rural and underserved areas and yet, they dont have a broadband connection it is useless. Closing the Digital Divide is critical and 5g that has areas of my district that still need 1g. We still have a long way to go and it will be very important that this is addressed and that it is a priority at the national level. Representative Mcmorris Rodgers, the fact that Washington State as a technical logical leader has that spilled over to Eastern Washington and spokane which you represent . Absolutely. I thought about Artificial Intelligence, robo calls, the fact that its 2020 and robo calls are still an issue and ie to be prepared for technology because the technological innovation in the next 30 years will make the last 30 years look [inaudible] and must be ready. Why do you say that about the next 30 years . We need to be beyond. Its hard here and commerce to think more than just a month out but this is and we are in a geopolitical struggle with china. China made their interest very clear and back in 2015 they lay out a plan that they will surpass the United States and they will do that by being a world leader in areas of future technology, 5g, Artificial Intelligence, quantum computing and optics and this is a struggle in a couple of years ago a Bipartisan Group of ceos, generals, diplomats did a review that showed that the American MilitaryEconomic Dominance is no longer guaranteed and we have to recognize the place that we are in and we can continue to win and continue to be a leader in these areas but this is an actual problem. Congressman, we talk about intelligence matters, you are on the Intel Committee and when it comes to china there is an issue with stealing technology and the issue of huawei. What are your thoughts . The chinese are still stealing technology and using our laws to take technology in a illegal way. The way you deal with that is simple. If the u. S. Companies do it in china the Chinese Company or investment can do it the in the United States of america. If amazon is not treated like a Chinese Company in china why are we treating in the United States like its a Chinese Company. Right . That is true reciprocity and this is something we are working on. Huawei is an extension of the chinese government. There is no question about this. We looked at the heads of all the Major Chinese and [inaudible] they all have a strong relationship in the military often Intelligence Services and indeed theres a communist rule in part but huawei has 30 of the world market so what are we doing with our leaders and our allies to make sure that the 5g technology and that is why the chairmans are thinking about buying amazon or nokia versus huawei. Why is china focused so much on the 5g and what is 5g and why does that matter and 5g is you will download a 4k movie and in like three seconds. That is awesome. The real power of 5g is what is called latency. You may have a command on your phone and that command goes to serve on the cloud and comes back to your phone but that trip is under 5g he will do it in ten nanoseconds. Why does that matter . Because we make decisions in eight nanoseconds read now 5g will allow us to have an entire power of the internet in real time so that is what will empower Artificial Intelligence and the chinese know that. Whoever owns the 5g infrastructure they want to make sure that they own the company that sit on top of 5g because those will be the next trillion dollar companies. This is where it takes time to build this infrastructure and we need to be thinking of 60, 7g and whatever the new communications, Quantum Committee occasions and it is hard sometimes that the government plays a role in this and it also plays a role in regulation and not making sure we over regulate this so that we can have new technology. Are we moving towards the World Wide Web for separate internet u. S. China based . You can make and augment that there already is one and that we have one that is china based and when you have the infrastructure within applications, apps on your phone and the fact that you cannot move information from facebook to another social media account and you already have these Little Pockets where it is hard to get information out of and consumers demand and ease the transfer between various systems and so i thank you can but we should be doing is making sure that liberal democratics western values is what is used as technology develops and not autocratic regimes. The chinese spent time on facial recognition and they are not doing this to make it easier for their citizens to buy groceries in the Grocery Store because you could buy the groceries with your face. They are using this technology because they already are using in one of their provinces where there are using technology to monitor and ethnic minority groups called the reapers. A million of them are already in that concentration camp in the chinese are using the facial recognition to deal with them. They are protecting this. Basically they have turned orwells 1984 into a 21st century reality and they are perfecting that but there is one problem. They will share this with other autocratic regimes. We should have our values to finding this kind of technology and that is why its a leader and why we should be working with our allies especially our european allies on creating the rules of the road. There is a real slippery slope for that social behavior, contract and facial recognition and Artificial Intelligence and it is here in the states too, isnt it . It is but we already have rules against discrimination and housing and determination of all kinds. Guess what . The algorithm, new technology are new to those rules too. Theres a thing called guidance and Artificial Intelligence and this is why we put it into ethics and guess what . And algorithm should not discriminate. If you are using an algorithm to make decisions on whether someone gets a home or not you cant do or use discriminatory tactic now and you should be able to use it in the algorithm so the people that are developing these algorithms have to ensure that they are able to buy it and prepare for it. To change, it is coming. We cant stop it but we have to be ready for it and i think we can take advantage of technolo technology. Is someone who has an intel back on how you protect your own data and privacy . It starts with simple things you can do pretty have a long password, 14 characters and make sure your software is patched so that means Software Hacks may find the vulnerability in it and we know theres a problem with the code and you have to download the patch. Make sure the apps on your phone are up to date and make sure the software in the computer is up to date and most importantly do not click on the links from people you do not know. Most malware is perpetuated through fishing or fishing campaigns so dont click on a simple way to know is if you have interacted with that person before their name or their actual name will show up in the two lines. But if their name doesnt show up and its a long and it may look like the person you know dont click on it. That is the best way and you do those three things here you will defend against 80 of the bad things that are out there. Should long pursuant be able to break into a phone . Let me refine that question if Law Enforcement can break into a phone and they have a warrant to do that and theres a reason to find that that is one thing but should lawenforcement tell a private company how to build their witches . The answer to that is no. Those who issue a backdoor encryption is always a debate. We can get a backdoor to encryption and it weakens encryption but we should strengthen equipment and corruption paid as a tool protect ourselves in a tool to protect our society and ultimately Law Enforcement has a tough job and i served alongside minimal adderall Law Enforcement and theres never been a real case or no one has brought cases to me were the case has gone cold because of encryption. There is there is no such thing as an impenetrable device but lets go to the San Bernardino shooter and the killer in San Bernardino when they had that phone and there was a court case, fbi versus apple and in that case you have the killers email, the phone number, you knew the apps on the phone and you have the backup and the fbi was able to get the information on the phone and when they broke into the phone they found out there was nothing else on the phone that they did not already have. The reality is theres no such thing as an impenetrable device and they are always ways to get access to that information and if a federal Law Enforcement has a judicial order to get that information then they should be able to use the tools they need to get that information its been that christman will hurt, thank you for your time on the communicators. Joining us now on the communicators is the commissioner on the federal Election Commission. How is this that you are share of the ftc during the Republican Administration and how does that work . Is a bipartisan body and it was designed that way it was supposed to have three republicans, three democrats but no more than three members of any one Political Party but right now you have a bit of a problem because there are only three commissioners so that as a whole another story but the chairmanship rotates. Every year it goes back and forth. Last year i was the chair, this year a republican is the chair. And next year will you be chair again if youre the only democrat . [laughter] im really hoping it will not come to that but democrats will be chair next year. What are you doing here the state of the net conference . I am here to talk about technology and elections and there is a lot of interest in our technology and elections. There are concerns too. I am one who is concerned about that. Whats your major concern right now . A lot of concerns related to technology, concerns about hacking in a little out of my area of expertise and theres a concern about how many messages are being conveyed to the American People and what are they can trust those messages whether their information is from american citizens and people who are masquerading as american citizens like the 2016 election. Im worried about the implication of disinformation and miss information on social media platforms and i am concerned about whether the social media platforms are stepping up and doing everything they can to ensure that they are not going to be provide a forum for people who are trying to undermine our democracy. What is the federal Election Commission in monitoring or enforcing those laws . Our role in this area really goes to whether the disclaimers and whether the information, particularly on political ads and whether people can tell when they see their ads are coming from and who is paying for them and that is of primary jurisdiction in that area but if someone was been active in trying to protect the integrity of our government and our elections for my entire career i personally have broader concerns than that. Ellen, has this information been a part of campaign sense 1783 . In a sense, but the problem is the plot forms provide this new mechanism where disinformation can spread at the speed of light and any corrections that come after that never quite catch up and it has become a way for people to spread information without conveying who is doing the talking and i dont think anyone really wants
