KSL TV WEST VALLEY CITY — Salt Lake County District Attorney Sim Gill ruled Thursday that a West Valley police officer was legally justified when he shot and killed a man who managed to grab ahold of another officer's gun while handcuffed and in custody in a small room in the basement of West Valley City Hall. But Gill also said the shooting of Michael Chad Breinholt could have been avoided. "If you're asking me to take off my district attorney hat, I can take it off. And do I feel morally comfortable in the way this ended up here, that there were other ways this could have been averted? Yes," the district attorney said at a press conference announcing his decision. "As a civilian, do I think this death could have been averted? Yes.
