Law360 (May 27, 2021, 4:43 PM EDT) -- After being repeatedly targeted over missing text messages sought by Gilead Science Inc. during discovery, a pair of whistleblowers in a case against the drugmaker in Pennsylvania federal court have launched a sanctions bid of their own alleging that the company failed to maintain messages on employee cellphones.
Gilead has repeatedly asked a federal judge for sanctions based on ex-employee Chris Purcell's failure to preserve messages on an old iPhone, Purcell and his co-relator, Kimberly Groome, in a False Claims Act case over the company's marketing practices told the court on Wednesday that Gilead itself had not met its own obligations...
