Measure 114 ruled unconstitutional

BURNS One of the most restrictive gun laws in the nation has been struck down by a Grant County judge.

Grant County Court Justice Robert S. Raschio issued a permanent injunction under Oregon Revised Statute 28.020 declaring Measure 114, a ballot measure passed by Oregon voters in 2022 to be unconstitutional, permanently preventing the measure’s implementation. Raschio heard the case in a Harney County Circuit Court, making the final ruling in the case on Tuesday, Nov. 21.

The court found that the plaintiffs in the case, Joseph Arnold and Cliff Rasmussen demonstrated that their right to bear arms under Article 1, Section 27 of the Oregon Constitution would have been unconstitutionally impaired if Measure 114 were allowed to be implemented.
