Judge Denies Motion to Quash Subpoenas The hearing was for the case against David Ingersoll, who has been charged with Sexual Assault of a Minor in the Second Degree for an alleged incident that occurred between July 2nd and July 5th of last year. The victim was 15 years of age. District Court Judge John Fenn denied the motions to quash subpoenas that were filed by the defendant for the victim’s records from DFS and Northern Wyoming Mental Health. Judge Fenn granted the defense’s motion for discovery and in-camera review of the records from both agencies. The agencies have until the end of the business day on February 16 to supply the Court with the records for review. The weeklong jury trial is scheduled to begin March 1. A pretrial conference will be set following the Court’s in-camera review of the records. The crime of Sexual Assault of a Minor in the Second Degree is punishable by up to 20 years in prison and a fine of up to $10,000.
