He was convicted back in may of murdering and kidnapping the teen. The jury recommended life in prison without parole but the judge still has to rule. That was scheduled for today. According to our media partner, Garcia TorresDefense Attorneys filed a motion to disqualify the judge from sentencing their client. They say she never disclosed that she once represented the lead investigator while working 25 years ago in a wrongful death case involving a mentally ill jail inmate. The mercury news reports zecher said i expressly deny defendants claim that a person aware or the facts might reasonably entertain a doubt that i could be fair and impartial in this case.
