A judge released him even after seeing this video. Abcs Lyanne Melendez is in the area to explain where the attack happened. You look at the video and have to wonder how is this man not no custody. Now, the woman who was attacked in that video was told by the District Attorneys Office that the man was under the influence of drugs. And i started crying. And i could not continue the conversation. Reporter panice was notified by the District Attorneys Office following the release of the man shown in this video as he tries to enter her Apartment Building over the weekends. She falls to the ground as she struggles with him. He continues to grab her. She finally crawls inside. It ends as she and person at the front desk try to keep him out. The man identified by police as Austin James Vincent was chargeded with battery, false imprisonment and Second Degree robbery. He appeared in court for the first time yesterday. Heres what the d. A. s office told us. Prosecutors expressed concerns about his release. Ultimately, the court released him on assertive Case Management. Vincent walked away even after the judge read the Police Report the Public Safety assessment and yes, watched the video. The judge has seen the video. She still thinks that this man is okay to be on the streets. Instead, the judge ordered vin isnt enrolled in a program with assertive Case Management which falls under the jurisdiction of the San Francisco pretrial diversion project. David moroff is the ceo. How will they make sure that he shows up for his Court Ordered appointments and stays away from the woman in the video being attacked . Reporter well, according to the agreement that he made with with the judge, dan, he has to call in, check in two to four times a week. Theres also a stay away order meaning he cannot approach the victim. Other than that, you know, the judge yesterday decided not to demand that he wear an ankle bracelet. Many times they do. So that was a little strange. And as far as we know, he doesnt have an address. So again, you know he may or may not show up. In oakland tonight, people taking Crime Fighting into their own hands. Theres an anonymous effort to shed light on muggings in the city especially in north oakland, but the warning signs popping up around the neighborhood are is not o not sitting well with some residents. Reporter we saw the signs posted all across the neighborhood. It says warning, muggings occur in this neighborhood. Oakland elected officials do not care. You are on your own. And we spoke with people who live in this area and theyre concerned because they think these signs may do more harm than good. Warning be alert. Those words on sign after sign after sign in this oakland neighborhood cautioning neighbors of muggings in the area. And saying Oakland Police cant protect you. Reporter hey, kristen sze, traffic is starting to pick up in this part of the south bay on highway 101 south of san antonio road near the border of palo alto and Mountain View. You can see the chp is getting ready to reopen the rest of the lanes that were impacted. The accident happened around 1 00 this afternoon. The chp telling us sanitation truck owned by Norcal Portable Services was traveling north on 101 when a black sedan trying to exit at san antonio road cut off the truck. Truck hit the barriers on the right shoulder losing control and veered across all of the lanes striking a white sedan before hitting the Center Median and then overturning onto the center divide. The truck was carrying about 1,000 gallons of human waste. The chp telling us a small portion did end up on the roadway. This truck tried to to avoid the vehicle and ended up losing control and crashing. Thats why we cite people when they do Different Things like this unsafe actions that can cause collisions.
