We made a family shelter available for them. Reporter according to the city of oakland, before deciding to clear the encampment, they checked for health, safety location and size. According to them the location met all four in a negative way. Vvs that cant be driven out with be towed and placed in impound for ten days. Everything outside of this area will be thrown out. In oakland, luz pena, abc7 news. A judge today set a man accuses much attacking a woman outside her Apartment Building in San Francisco will now of remain in jail. The case is against Austin James Vincent had become focal points for proponents of a proposed homeless city near the assault. Lyanne melendez is outside the jail to explain why. Reporter this is the judge that previously released him. Now today, she said given the new information and after reading the police report, she said i believe that the defendant represents a Public Safety risk. These are still photos of todays arraignment in court where Austin James Vincent was charged with assaulting a woman and some of her friends with a knife. And issuing criminal threats against them. Police say that was back in february. The case was never resolved until the victim saw this mugshot of vincent following an alleged attack on another woman outside her apartment on august 11th which was caught on surveillance video. Today the District Attorneys Office said other calls have come in. Some of those calls have not been substantiated but we have to review every singlenent is that comes in. Some were still reviewing. Today the judge ordered vincent to remain in jail after he turned himself in yesterday following the february allegations. Last week, judge Christine Van aken was criticized for ordering his release pending the outcome of the alleged attack caught on camera. Vincent was ordered to wear an ankle monitor only after the judge saw is the surveillance video. I was frankly alarmed. Van aken says she now believes vincent is a Public Safety risk. The Oakland Fire Department is trying to contain a fuel spill in the oakland estuary after a boat that someone may have been living on started to sink. The department defeated these photos. The rescue team placed 300 feet of boom around that sunken vessel. This is near the jackland aquatic center. Fish and wildlife was contacted by the Fire Department today because of the leaking fuel. They are putting down absorbent pads that is soaking up all of the gasoline that is on top of the water, the gasoline is going to float to the surface. Basically theyre starting to run out of time and theyre starting to skate on thin ice. As you know, they started out with four alternates down to one. Lots of scheduling conflicts we heard about today. And that could leave ultimately no alternates. I consulted with a couple of attorney who are not affiliated with this case. They said that the case cos proceed. The trial could proceed with only 11 jurors. That col happen but both the prosecution and defense would he have to agree toe that. If they did not, very likely they would agree, this could go to a mistrial. Three jurors were dismissed yesterday for misconduct. The judge replacing them with three alternates and ordering deliberations to begin all over again. Today in court, the judge alluded to the misconduct incident happening late last thursday. Involving a possible text mess and with a media link of some kind. The jurors add mon flished to not interact with each other or use the internet to look up anything pertaining to the case. The judge today said she could criminally sanction two of them for contempt of court. The third was dismissed because she knew of the illicit communication and didnt report it. Seems unlikely that the county is going to start prosecuting jurors for who knows what. But this certainly puts a serious crimp in the trial. Its now in jeopardy. The only remaining alternate juror could soon be seated on the panel because of a fourth juror who has a scheduling conflict upcoming. There are many work and vacation conflicts to sort through even though the judge told the jury the trial could extend into october. Shes asking for proof of nonrefundable expenses. One juror delayed a medical procedure. The judge also said she had a calendar. She highlighted all the scheduling conflicts, some of the jurors had and it basically blocks out most of the days in the month of september.
