The video is the boys arrest from monday night. We did blur his image because of his age. Police tell us he led his 8yearold neighbor Maddy Middleton into his apartment there, and then killed her. They believe he committed this crime before she was even reported missing sunday evening. Please arrested him when they noticed him near a recycling bin. Inside the bin is where they found the body of a young girl. Last night there were hundreds of people who lit candles in this town in honor of Maddy Middleton. It really hits home. I have a maddy myself a 6yearold little girl. Its one of our worst fears that we have as parents. The only thing you can say is you know its good to see the Community Come together and i hope that you know Something Like this raises an awareness, you know. Theres really not a lot more i can say. Its just a truly sad situation. Its tough to put into words. Reporter as we stand here waiting for the District Attorney to step up to the podium for his 11 00 a. M. News conference, not only is the media gathered here but members of Law Enforcement and a lot of members of the community, certainly some of the people who live in the complex a couple miles away from where we are at right again, waiting for the District Attorney to answer a question he alluded to yesterday. Happening now, fire crews in the east bay are battling several fires, keeping a close eye on others including one that flared up early this morning. That fire was contained within a few hours, but firefighters are saying theyre not going to take any chances with the east bay hills winds. I want to point you to a firefighter who has been Walking Around the hillside this morning as firefighters have been coming back to check on this area. It looks like hes been studying one particular area for a while, making sure theres no hot spots. There are hose lines left here just in case. Tripledigit temps are predicted, and firefighters have to be ready for anything at any time zach first noticed something was wrong at 4 00 this morning to see the bright glow the flames creeping towards hi home. I sprinted down the stairs and woke up my parents. Two glow lines. It was pitch black except for the fireside. We knew it was a serious fire. Reporter this was the last section of the fire to substantially burn. Contra costa county fire marshal says the biggest challenge was the thick brush all over the hills. Not only the paige home was threatened countless others might be compromised at any shift in the weather. That side we do have other residential in neighborhoods. A high school is not too far from here. If the winds go to the north, we have the wooded areas where weve been you know lots of trees. It was coming from the northeast, so it was blowing straight into the house. We were worried about that but they got it under control very quickly. Im sure everything here in the bay area i wasnt worried, but the house doesnt matter as much as my dog or my family does. And we have breaking news this morning. The charges have been filed as an adult in the Santa Cruz County situation. Were going to go straight to this press conference. This is the District Attorney jeff rosell. The charges and allegations that go along with those. The specifics of the case and the specific details and the facts are not something that we are able to comment on. Those details will come out during the course of the trial in the case as it proceeds through the court system. So with that im here to take a couple of questions, and just let everyone know the specifics of the case are not something were going to comment upon. The arraignment and Court Proceedings should take place tomorrow here in superior court. [ inaudible ] under certain circumstances, with specific charges, the law does allow determinations about whether or not you file something as a minor or as an adult. This office has always taken those cases seriously. The decisions that the decisionmaking factors that go into that you look at the nature of the crime, you look at how the crimes were committed. You look at the age of the offender, and you look at criminal records, if any. Those are typically the factor that are used to balance. [ inaudible ] the penalties are up to the court, but i will tell you this juveniles are not subject to the same penalties that adults are. So if something would apply to an adult, it does not necessarily apply to a juvenile and the Death Penalty is not something thats applicable to juveniles. [ inaudible ] that is correct. [ inaudible ] in terms of the specifics of the facts, were not able to go into that. Right. His criminal history is not something we are able to discuss at this point. Those details should come out during the course of legal proceedings. We have charged this individual as an adult with the crimes for which he is responsible. Were going to bring him to justice, and at this point theres no plea deal on anything. [ inaudible ] the sentences in this case carry life sentences. So he is looking at life in prison. You know ive been here 24 years and, you know off the top of my head i cant remember any 15yearold if charged with these specific offenses including Sexual Assault offenses. Have they been charged in the past . Perhaps. I would have to look back. The investigation is ongoing in this case. What i can tell you, as you heard yesterday, he was a person who was here in santa cruz at the time of the offenses and has been here for some time. Im not going to discuss the facts and circumstances of the case. That is not something that we are prepared to discuss oreically really are in a position to discuss. Were trying to preserve the right to a fair trial, which is our ethical obligations. The details and the facts and circumstances of the case will come out. So i can tell you this. People do things for lots of reasons. Sometimes we understand them sometimes we dont. The specifics of this case im not prepared to discuss. He has an arraignment that is scheduled for tomorrow in court. I dont know the specifics of it. I would suspect 8 15 in the superior court. Im not sure of which department. A complaint has already been filed by the District Attorneys office. The wlau providelaw provides that somebody who is under 18 be housed at the juvenile detention facility. That is where he is housed. The facts and circumstances of this case are something that im not prepared to go into the specifics. Well do a comparative analysis. Im here to discuss the decision we made to file charges, what those charges are, and so thats not something im prepared to goo into. The specifics of his custodial status are not something were here to discuss. Hes essentially charged as follows hes charged with one count of murder. Hes charged with two special circumstances that are associated with that involving sexual offenses kidnapping and lying in wait. Hes charged with a kidnapping charge.
