Really frustrated including the city saying that they didnt know about this road work and that would have been incredibly important for them to know that. Caltrans says it would have been routine work if it wasnt for an accident, somebody allegedly driving around the cones, and that is what caused this huge headache yesterday. Pacifica natives know beach traffic on highway 1 can slow things down. But yesterday it was crazy. Ive never seen it backed up like that and ive lived here 30 years. Reporter traffic was backed up for miles. Caltrans was repaving a halfmile stretch of the southbound side. It was really slow and i had a screaming baby in the back. Reporter the work was supposed to be completed by 3 00 p. M. That time line was pushed back to 9 30 following a twocar accident. Caltrans says a driver went into the newly paved section of road. So we had to wait for the asphalt truck, which was caught in traffic, to make its way down to the scene. And then we had to remove all the asphalt we put down earlier in the day. Reporter they admit the crash, cleanup, and repaving was unexpected. Some city Officials Say the entire project was unexpected. We didnt get any prior notice. Reporter when they learned highway 1 had become a parking lot, they had to make some big changes. Moving equipment to make sure they could respond to emergencies while the main artery to the city was cut off. The way the Fire Department works, they designate certain engines to stay south of the slow traffic and we had some assistance from the daly city engines. Reporter all paving work is suspended. Caltrans says overnight work isnt an option in this area because of the safety issues and the cool overnight temperatures. They do say they plan to work with city leaders in the future. Ed cavanaugh was last seen while riding his bike in the El Dorado National forest. The teacher at Downtown High school in San Francisco. A member of the familys search effort found a body and a motorcycle matching the one cavanaugh was riding. His brother is now arriving at that dirt trail to attempt to identify the body. The family released a statement saying in part, we are overwhelmed with the kindness, generosity and support that has been shown by all they had. Its a testament to eds extraordinary soul. Cavanaugh was the wilderness and survival teacher but needed regular insulin medication. Not only has it tripled in size this week but its complex, much like a chess match. Veteran firefighters say this is among the most challenging wildfire theyve ever faced. Our nbc chopper is near the fire zone. We should note most air traffic is blocked for safety reasons. Spotty showers well to the north and over the past hour or so its been all about marin, napa and sonoma county. Also down towards novato as well. Were beginning to see that wind down and after rainfall the rocky fire today conditions still remain very hot at the focus of that fire. Right now temperatures in the low to mid70s. Eren directions h and so out of the east making it very erratic as youve been hearing for the firefighters. So whats on tap for tomorrow . Lets take a look and you can see winds that still could gust 10 to 20 miles per hour. Daytime humidity as low as 20 and were tracking the possibility of more showers and also lightning. Right now in the east bay friends of a High School Grad are gathering to mourn his death. Police arent publicly identifying the 17yearold victim who just graduated. They describe him as a fine student and athlete who was not a gang member. He and a girl who hasnt been identified were walking near the high school at 1 00 in the morning when they were confronted by three teenaged boys. One of whom fired a gun killing that 17yearold. The three teens then drove off in a silver suv. Police are asking anyone with information about that crime to give them a call. And right now 130 neighborhoods across san jose are gathered to take part in National Night out. The event is an effort to urge neighbors to reinvest in their own communities and take the streets back from criminals. You cant tell this is considered a hot spot. There are about 1,500 people here tonight and the marp just showed up to help push the message that Crime Prevention is a community effort. And from talking with community organizers, the message is sinking in and its a good time because san jose has been dealing with a spike in crime including violent crime. A lot of fear in recent weeks certainly a spate of homicides. We know folks are concerned. And we tell them if they see something, say something. We see them using social media a lot and theyre reaching out. Theyre calling the police more. Theyre looking out in their neighborhoods and anything suspicious they report. It sounds pretty basic. We know that. Its important to watch out for the neighbors, to know the neighbors, which is why its important for this night for them to be out, get to meet and greet not only the Police Department but the neighbors. Live in san jose, robert honda, nbc bay area news. Just a short while ago the closing arguments for a highprofile trial ended. A 46yearold woman says its her last chance to have a child. Shes battling her exhusband to keep her frozen embryos. Mark matthews has been covering this trial and joins us now from outside the courthouse in San Francisco. Mark . Reporter final arguments today in a case that has garnered national attention. 46yearold anesthesiologist trying to overturn an agreement she signed when her embryos were frozen in 2010. She has testified they are her last chance of having a child of her own. But in 2010 she and her then husband, steve finley, signed an agreement that the embryos would be thawed and destroyed if the couple ever got a divorce. His attorney argues its binding. The purpose of going through this is to determine the partys intent. Reporter the attorney and an attorney for the ucsf fertility clinic say they both agreed to destroy the embryos in the event of a divorce and if it can be voided because one person changes their mind, that shakes the whole foundation. His client didnt think she was signing a contract. She understood it to be part of the consent form and that she could change at any point in the future and she gave it that level of consideration. Certainly it was important to her but it was not at a level she thought she would be bound for all time. As a result she spent ten minutes going through the form. Reporter the judge asked each side to submit a statement saying how they would like her to rule. Those statements are due august 28. The judge then says she will take 90 days to make her decision. Jobs by next year. Now the most valuable company in the world is taking another bite out of the south bay. Apple says itll buy this plot of land along north first street. Two deputies who risked their own lives to pull a man from a car just moments before that caltrain slammed into it. The charges the driver is now facing. They say they dont consider themselves heroes, but they are proud when faced with an oncoming train they made the right call. San mateo county sheriffs deputy said it wasnt until he watched this video that he realized just how close he came to losing his life while trying to rescue a man stuck on the train tracks in sunnyvale. Nelson gomez crashed no a crossing gate tower last night. His car careened onto the tracks and his air bag. A train was traveling 80 miles an hour. Its just instincts that kick in. You dont have time to analyze the situation, think about the risk, the benefits of choosing to go either way. Instincts kicked in and i was there. I knew that my job as working Law Enforcement is to preserve life, and thats what i did. Reporter as you can see the deputy pulled gomez out of his car seconds before a caltrain engine slammed into it. Before he dragged him to safety, the deputy alerted the engineer to slow down. I had my hands above my head waiting, to give him the signal to stop. Reporter the engineer couldnt stop immediately but was able to reduce speed from 80 to 45 miles an hour. You can see here the impact could have easily killed gomez and the deputy. The deputys swift actions also helped protect the 40 passengers onboard the oncoming train. Sunnyvale police later arrested gomez on suspicion of driving under the influence and hitandrun. He allegedly slammed into a parked car and a bicycle just minutes before he drove onto the tracks. They say an engineering student on leave from stanford killed his former girlfriend at her parents house in walnut creek. The 19yearold was home for the summer from san diego state. Today investigators believe he made the gun out of parts ordered through the mail. Theyre called ghost guns because they dont have serial numbers and cant be traced. Theres no evidence suggesting the retailers who sold the parts did anything illegal. A home broken into and burglarized. Police hope this surveillance photo will bring the suspected burglar to justice. It was broken into. These cameras captured photos of the suspect just sauntering out of the house.
