Well, there is new information tonight about a kidnapping and death in santa cruz county. Initial reports yesterday were that a man was kidnapped from his home in santa cruz. I want to show you a picture of that man. Its 50yearold. Later they found his car in the Santa Cruz Mountains with a body nearby. Today investigators say the motive is robbery, and that its an isolated incident. No word at this point how autre died. We are getting our first look at the driver of a deadly hitandrun in cupertino. She is accused of running over a man who was walking on a trail at the popular Rancho San Antonio park. Nbc bay areas Marianne Favro has been following the story. She has an update for us. Marianne . Janelle, we know the suspect is a 50yearold woman from santa clara. She lived alone, and neighbors we talked with today say she was a very pleasant woman, so they are stunned to learn she is now accused of murder. Tonight mireya orta is behind bars, accused with murder and assault with a deadly weapon. Investigators believe she ran over and killed a man walking on a trail. We talked to one woman who was at the park. Maybe they were hitting a log or a rock, and i thought they were going to bottom out. But no, this woman is shes were witnessing a murder. This person is murdering someone. Thats a person on the ground. Reporter she shot this video after the assault. It shows a black audi driving off as park rangers close in. Orta lived in santa clara. We talked with her neighbors today who described her as a friendly woman. They also say she had shown signs of paranoia and struggled with psychological issues, and they say she was very upset last week when her rental car was towed. Today Rancho San Antonio reopened to hikers, who were stunned such a horrific attack happened in such a serene place. Its kind of scary. This is such a peaceful area. Surprising. Pretty shocking. Very sad. It doesnt happen out here. Reporter as the car sped off, another person suffered minor injuries. Investigators are still not saying whether orta and the victims knew each other. When he tried to break it up, he was robbed. Police say it was during a Party Saturday night in this palo alto neighborhood that the owner of the house, who rented it to two people on airbnb got worried. He started getting notifications saying that a smoke alarm was activated. He got suspicious, whats going on. Reporter the man, said to be in his 60s, then drove here to the 100 block of tennyson avenue, walked into the home and started telling people to leave. As he is going from bedroom to bedroom, asking people to leave, hes approached by two men. They push him to the ground and they take his wallet and they take his cell phone. Reporter it gets worse. After one of the partygoers got the owners wallet and phone back, the owner called 911. During that call, another suspect took the phone out of his hand and ran away. No injuries, but some tell us they have concerns about parties inside other airbnb rentals. There were a couple of large parties, and we contacted the homeowner via the website, and she couldnt do anything about it. We also did call the police on one of the parties. Reporter palo alto officers say theyre trying to find the suspects and get in touch with the person who rented the house in the first place. We reached out to airbnb, which says, quote, the reported behavior is appalling and we have removed the booking guest from the airbnb community. We are providing our full support to our host at this time and have proactively reached out to Palo Alto Police to offer our assistance in their investigation. A stanford swim champ is now accusing his former team of homophobia. He says he was kicked off the team because hes gay. Abraham devine is a twotime swim champ. He posted on instagram he is the only openly gay swim theyre competes at an elite level. Hes had experiences of aggression and he says its caused by homophobia within the sport of swimming. Stanford swim coaches deny the claim that devine was kicked off the team because he is gay. In a statement to swim swam, the coaches said, quote, abe wasnt invited back to train with us this fall as a post grad for reasons entirely unrelated to his sexuality. We take pride in the inclusivity and supportiveness that exists on both our mens and womens team but we will continue to strive as always to improve those aspects. Once the legal ball started rolling, the gilroy high football season seemed doomed. The Police Investigation put the spotlight on allegations that a player had been assaulted, and then in the aftermath, ten players quit the team yesterday, leaving the school with only nine players and leading to the cancellation. Shocked us, because we wouldnt expect this to happen, and, like, it just shocked us a lot because we werent expecting this at all to happen. A lot of people are involved and a lot of people care, but its kind of been, you know, mixed up. Not everyone really knows what happened and whats going on. A lot of rumors. Reporter Gilroy Police captain told me the investigation is over, but tough decisions loom. We felt that the conduct here involving these four particular students rose to the level of criminal activity. So they were in fact arrested, and we dispositioned that case by issuing them juvenile citations. So now we forward that entire investigation to the District Attorneys Office and they make a determine as to criminal howlihe case will proceed through the Court Process from there. Reporter from the police point of view should this go higher in terms of charges . We charged this as a felony. This is whats called a wobbler in Law Enforcement circles. It could be a felony or a misdemeanor. It feels we have been trofbd opportunity of winning. And it sucks, but well pick ourselves back up. Now the School District did not return our calls concerning the cancellation. Our legal analyst steven clark applauded the district for taking the action saying it shows the district put a higher priority on students safety than a football me, and says it indicates that authorities plan to treat this more as a crime than simple student hazing. Decades old art can be destroyed within minutes, and a group of san jose residents are trying to fight it. The Emergency Committee for the preservation of chicano arts was formed after the historic mural de la rosa in East San Jose was painted over last year. The committee is pushing to have certain murals in san jose declared historical landmarks and therefore protected. We spoke with one artist whose mural was painted over. A lot of these murals are at the risk of being taken away without any type of protection. And what were doing, what were trying to do is get city hall to recognize these murals in the hopes that they stay protected. The committee has given a list of murals to a city commission. Tonight that commission will decide whether certain murals should be considered historical landmarks. The city council, though, will make the final decision. An east bay city has a dubious distinction, one it probably never wanted and doesnt like very much. Antioch recently ranked the most miserable city in the bay area. So is it true . Reporter rich says hes not surprised. Hes lived in antioch all his life, but says the citys not what it used to be. He says crime, traffic, and a lack of information from the city has him feeling down. And i plan on moving after 72 years. I cannot take it any more. There is a lot of good things happening here. Reporter antiochs kmim development kwamie reed says the study has it wrong. He says the city is working hard to attract business, beautify the area, and create jobs. Reed says the marina, new electric car charging stations, and the water park are many things antioch has to offer. We have hiking. We have a wonderful marina. There is a lot of things that people can do within the city of antioch to enjoy themselves. Reporter residents admit the city has its challenges. She ju he just opened a Cell Phone Repair store. Well, nearly eight months later, since a landslide in sausalito, crews finally started cleaning it up today. Heavy rain triggered it back in february, sent an entire house down a hill, trapping a woman. Shes turned out to be okay. This is the mud and the debris left from the landslide. Crews now scooping it out and taking to it the disposal site. They say the reason it took eight months because the city wanted to make sure it would be reimbursed for the project. The job should be finished by the end of the year. Its a beautiful day. Another beautiful day. It has been. I think weve had a stretch of great weather where we havent been too hot or cold.
