While the situation in paso robles is unfolding, were learning more information about the deadly shooting of a sheriffs deputy in Santa Cruz County last weekend. Steven carrillo will be in the santa cruz courtroom tomorrow facing 19 charges including murder in connection with an ambush on deputies last week in ben loam and. Sergeant Damon Gutzwiller was killed and two others were hurt. Carrillo has also been connected to the death of david underwood. Underwoods sister tells us shes troubled by the fact that he could face charges for both killings. If that were the case, was he just looking for someone that had on a uniform . Prosecutors believe carrillo was lying in wait and that the shooting was premeditated. The San Francisco sheriffs captain is under the microscope for this video that shows him pushing a protester to the ground. The veteran officer is now facing internal and criminal probes. Here is Investigative Reporter jaxon van derbeken. Reporter this was may 31 in the downtown financial district, just after 5 00 p. M. , with sheriffs deputies and vehicles confronting demonstrators. Keep your eye on the protester wearing the green shirt. An officer walks in from offscreen and pushes him from the back on the ground. We dont know who he is or whether he was injured but we have learned the officer involved was a 22year veteran sheriffs captain, john ramirez. The sheriff issued a Statement Today saying while hes opened an internal probe into the actions of the staff, the departments initial review of available information and circumstances does not appear to rise to criminal conduct. Thats simply premature, says the district attorney, given what the video shows. Its very disturbing. It appears to interfere with and undermine our commitment to First Amendment protests. Its why were in the midst of a criminal investigation. Reporter the San FranciscoSheriffs Office says the ongoing probe will be fair to everyone involved. Boudin is concerned that a member of management is responsible. Someone that high ranking is supposed to lead by example. Instead the example set by the Sheriffs Department is one of escalation, violence, and intimidation of peaceful protesters. Its a disturbing message indeed. Reporter a civil rights attorney echoed that concern. Hes telling younger officers that it doesnt matter, i can do it, you can do it, and we dont have to treat these people in any kind of respectful way. Thats significant to me, that its a captain. Reporter jaxon van derbeken, nbc bay area news. A trip to the beach turned into a dramatic rescue late today. Five people pulled out of the water at ocean beach in San Francisco. Weve just learned that they were all teenagers. Nbc bay areas Christie Smith is at ocean beach for us with the new details. Christie . Reporter all five of those teens were taken to the hospital. Two of them listed in serious condition. But firefighters tell me tonight that they will remain optimistic for all of them to recover. But this was really quite a rescue effort out here. In fact one of the teens, were told, was unconscious when he was pulled from the water and this did include help from of course trained rescue swimmers but also from surfers who were on the scene here at ocean beach. Firefighters say they started getting multiple 911 calls at around 1 30 this afternoon of victims in the water. Originally they thought six people needed to be rescued. Ocean beach is of course known for its dangerous rip current. The response was fast. Dozens of firefighters and others came out. Rescue swimmers from the park service were assisted by two surfers. They helped three people out before firefighters arrived. The firefighters and rescue swimmers helped two other people who had drifted a half a football field from the shore. A 15yearold, two 17yearolds, and two 16yearolds, all males from the east bay. A witness described a quick response. We figured there was one person that got pulled out. But it seemed different this time. It seemed like they were actually rescuing people and pulling them in and we kept thinking they had gotten the person that had been pulled out and then they kept racing back. We got three rescue swimmers from the National Park service in the water, all doing a single rescue, which is very cumbersome, it takes a lot of effort to do in these conditions. If it werent for those two surfers, its foreseeable that this could have had a different outcome. Reporter all five were dressed in swim attire and appeared to be out for a day of fun. Some background on ocean beach, from a 2017 nbc bay area investigation, more than a Million People visit ocean beach in each year and between 1997 and 2017, at least 11 people drowned at all San Francisco beaches and nearly 430 needed to be rescued. Live in San Francisco, Christie Smith, nbc bay area news. It is precarious. Okay, lets turn your attention to the coronavirus and check where we stand with covid19 cases in the bay area. Alameda reporting 86 new cases which brings the county now to over 4,000 cases. Now, in santa clara county, 31 new cases and over 3,000 in total. So overall, when you look at all of the bay area, we now have 16,000 cases. A little bit more than that. And almost 500 people have died because of this virus. So we are definitely seeing an uptick in the total number of covid19 cases in the bay area. But it also turns out were testing a lot more people. And here is the most important part. The percentage of positive tests each day is actually going down, which is encouraging. Lets show you San Francisco county. You can see there was a spike back here in march, okay. But then since april, the numbers have all been trending downward. You get all the way here at the end, only 1 of the people being tested for covid19 are coming back positive. Similar story in contra costa county. At the beginning of march right here, we saw a big increase here r of positive ttle bit over 8 o. Tests went down and decreased for the most part, most of the time. Now less than 5 of the tests are coming back positive. As for education now, the scramble continues for schools trying to prepare for this Upcoming School year in the fall. The only thing thats clear is that nothing is clear. For many students, School Restarts in just a couple of months. San jose unified took parents to a virtual slide show today to demonstrate where they are in the planning process. The district says its forming teacher and parent committees to help them iron out the details. Theyre going to release the plans on july 1 with School Starting on schedule august 12. In San Francisco its a different story. Parents say they just want to be part of the discussion since theyve been forced to become home school teachers. They get assignments, parents are supposed to help expected. Parents are organizing and rightfully so, they want to be included in the Decision Making process. Theyre included now as coeducators. It is a big challenge for all of us parents. The nonprofit innovate Public Schools is pushing for a strategy. We are awaiting for a response from the president of the school district. A lot of cities are considering shutting down main streets and creating more room for restaurants. Tonight, palo alto closed california avenue so restaurants and shops can serve more people outside while of course maintaining social distancing guidelines. The street, california avenue, will be closed for most of the summer. Many Business Owners say theyre hurting and the street closure might help them stay open. Reporter drivers honk their horns to show support for the friends and family gathered in front of Highland Hospital. Families say brianna columbo was pregnant when chp officers shot at her and her boyfriend, eric salgado, in oakland saturday night. Salgado died from his injuries. A report released by the Oakland PoliceDepartment Investigating the case says the officers were making a traffic stop on a car reported stolen when salgado rammed his car into the chp vehicle. But the family and their attorney believe thats not what led up to the shooting. I would like the public to understand, people are always going to take sides. Ive been told that car had been purchased by him. I dont think thats relevant. Because a stolen car or not, its not a justification for excessive force. Reporter briannas friends and family say theyre upset with the hospital because they havent been able to see brianna until today. They say the father finally got to see her today. They say it may have been because of covid19 restrictions. The family says the girls unborn child died from the shooting although we dont have confirmation that have from the hospital. As protests sweep the country, our Investigative Unit has learned the fbi is probing civil rights complaints against the palo alto Police Department. You might recall the video we showed you last year, here it is, captured by a Security Camera on the mobile home of gustavo alvarez. The Video Shows Police slamming his head against the windshield after he was already in handcuffs. They had spotted him driving, they say, with a suspended license. Court records weve obtained confirm an agent with the fbis Civil Rights Division has been investigating. An attorney for alvarez says he welcomes the probe. Its very clear these officers violated a number of his civil rights and in doing so violated a number of federal criminal laws. Like an 89yearold mother and grandmother from daly city. Garvin thomas shares her story. Reporter as i spent time listening to rosemarys family talk about her, one phrase popped up a lot. She was active in her church, active in her childrens school. She was just plain active in every aspect of her life. But when they grew up and moved on, rosemary wasnt one to stay put. She enrolled at San Francisco state at the age of 47, graduating magna cum laude and working for the American Academy of ophthalmology for the next 20 years. She pursued her goals. Like most grandmothers she was very caring, thoughtful, and considerate. Reporter michael says even in retirement, his grandmother was up for anything, be it a hike in the bay area, or a pilgrimage across the world. Thats pretty cool, not a lot of 80yearolds get on a transatlantic flight and go to italy and ireland. Reporter michael says the last visit they had together, the one when the dancing video was recorded, will remain with him forever. A great memory of a memorable woman.
