Its not just trees. In letters sent to homeowners land scaping like Backyard Pools could be ripped out too. Its how you do it. Its not necessarily that can do it. They could do it. They have right aways but in some cities or towns would you want to remove 500 trees . I dont think the community would put up with that. In a statement pg e said we are working to keep the pipes safe and having access for First Responders is the number one issue. This is part of an 850 million effort by pg e that was ordered by the Utilities Commission after the san bruno pipe explosion. Part punishment, part lets make this work better than last time. Developers pay for public art in order to build in several bay area cities. There is a powerful group suing to stop the practice. Its park and art in oakland thats created part of the huging Housing Development downtown. Last year the city voted to require developers to include public art in any new plans near or contribute to a public fund. The price tag is about 1 of the value of the development. The Building Industry Association says Developers Already struggling to meet city requirements like parking and Green Building standards. Those are all public amenities or needs that are in part created by the new development and public art simply isnt. The association has filed a federal lawsuit contesting the ordinance citing rulings saying fees must be tied to the direct impact of the development. The lawsuit is asking that the public art fee be eliminated and if it is it could force other cities with similar ordinances to do the same. I can see both sides of the story. The problem for most is the specific price tag, set 1 . A lot of art doesnt need to cost that much. To, but its a set aside that we have started with buildings. If you do a big project, its to make it look good. This is a pet project of the new oakland mayor when she was in the city council. Well have to see how she deals with this. Traffic navigation apps and gps have become invaluable but what happens when everybodys new route goes past your house . Loss gados beach goers heading south bound are being rerouted when traffic is bumper to bumper. The google owned gps app tells drivers to exit camden to cut through loss gados before getting on the highway. Its an often used shortcut that locals say the roads cant handle. It can go from taking ten minutes to go to work to 20 or more. Normally i can be there in three minutes or less but its taken me 20 or 30 minutes. The city is testing four of the signs this weekend near the highway exits that tells drivers downtown traffic only, beach traffic, use 17. The city reached to google to ask about making a change to the app but it has not heard back yet. Its interesting. Remember this app had a similar problem with police. They were putting up when there was Police Activity to avoid that if you were driving around at Los Angeles Police force wasnt happy about that saying criminals could use that as a device. This is an app that tells you when there are traffic back ups. Its real time data. Why doesnt it tell you that loss gados is backed up . Well its less backed up than 17. Its pretty bril i cant believe. You type it in and no looking at maps. A Group Unhappy with the cyclists who run stop signs is protesting the law by obeying it in Critical Mass style. That might seem counter intuitive but they want to demonstrate what it would look like if every cyclist made a full complete stop. Its called stopin. They want to repeat it soon again. Last week cyclists rode a popular street in single file stopping at every stop sign creating a traffic jam for bikers and drivers alike. For them to actually pick cyclists and go after us, its absurd. We cannot turn a blind eye to those committing violations and expect us not to enforce it. The group is challenging San Francisco park Police Districts proposal to increase enforcement by ticketing cyclists who dont come to complete stops. The coalition has launched a petition to stop the park station from moving forward with that crack down. We have talked about this before. The biken shoesists are a powerful lobbying group. Thats right. Its interesting, one of the reasons why the captain instituted this warning or crack down, whatever you call it, was because pedestrians werent feeling safe. In the overall political environmental transportation food chain, pedestrians still trump bicyclists. I can see why. Bicyclists would leak something after a law in idaho. A rolling stop. There is a hearing in San Francisco friday to determine that. A federal judge will hear a lawsuit that claims californias 1961 antiprostitution law violates the Constitutional Rights of sex workers. The defendants are californias attorney general and four bay area district attorneys. The suit is brought by Erotic Service providers Legal Education and research project. It says criminalizing prostitution violates the first and fourth amendment, free speech and equal protection. They say its only illegal for reasons of morality. They also say it would be better for police to focus on more violent crimes, ones with more obvious victims. But this is where we come into a catch 22. San francisco has criminalized prostitution because they didnt want to victimize the health workers. We have a huge issue about human trafficking. Are people being brought in to work in the places against their will. They are. Which will it be . Is it a victimless crime if the person is being forced to do it . Its unfortunately more complicated than that. Plus its an under ground industry that breeds more crime. There is something to be said when it comes to legalizing marijuana. Lets make this legit so this is not funding crime rings. Another debate. Hillary clinton will be back in the bay area. Shes slated to attend an evening reception at a home on wednesday. The host is a former chief privacy officer at facebook. The next morning she will be at a Breakfast Fund raiser at the San Francisco home of the state assembly woman. The price to attend both is 2700 a person. Clintons competition Bernie Sanders announced his run for president. There were more than 80 parties in the bay area to celebrate it. Sanders is the darling of progressives. His campaign is in the National Scene painting him as the straight talking anticandidate. The campaign is a war chest thats about 30 million behind clintons but political analyst Paul Henderson says that can change. It is more difficult to get around the bay area this weekend using mass transit since the tube is closed. Well have one of the directors live in studio about crews are repairing a critical section of bart tracks this weekend. Theyre replacing aging cross over tracks in west oakland. Wither about 50 down in ridership, 80,000 trips, which is what we needed this weekend to make it a success. Lets get to the issue people are watching. Is it going to be done on time and are we going to be up and running monday for the commute . There is every reason to believe. I checked a few moments before coming on air that we will be back operational at 4 00 am tomorrow morning. Was this really necessary . Was there a way around closing this down . There are ways around it. We could have delayed service on a regular basis, but doing it in a concentrated way means we get the work done. It will be done over two weekends and we will repair an aging part of the system. As you know phil the system is aging all over and we have to pick those opportunities where we can do the most work and get the best benefit. Not only are we doing work thats described, we are taking the opportunity to do other maintainance that would take a much longer period of time if you had to do it over a few hours a night. With the concentrated tappet we are getting a lot done. One of the questions about bart was when it was originally designed its a small system. Its tight. Those tunnels are tight. Theres no wiggle room in them. If anything goes wrong or work needs to be done you have to shut the system down. Especially trans bay which is why it is so important that tenance we do on a regular basis avoids that potential. Our crews out there are doing a terrific job. The men and women of bart have stepped up and making sure the work gets done on time and is responsive to the publics need to have access to the trans bay tube. Speaking of the trans bay tube some in San Francisco are starting to be concerned about gridlock, the whyed that we are just impacted, that there is not enough late night service. There is not overnight service. Are there plans to expand barts service around the bay area . We have as our priorities, the big three. Rail cars, train control, and hayward maintenance facility. If we can accomplish increasing the fleet, increasing headway, we will get more capacity. Can we extend hours . The overnight service is not likely to be possible with rail, but we do have a pilot project, a rubber tire overnight service from San Francisco. Buses . Buses. Why is an overnight isnt overnight service possible on bart . Because of the maintenance needs. We have to have access to crews into the various parts of the system. If you dont provide the access the maintenance will deteriorate causing service to go down. Its a balance. We want to provide the maximum service we can for riders and we want to be sure that crews can get in there and maintain trouble spots when theyre identified by employees. We only have a couple seconds left. The question that keeps coming up when you close down this trans bay tube, what are the odds of a second tube . I think there is growing momentum in the bay area for a second trans bay tube. A number of officials have stated their support for it. Its going to be a huge undertaking, a lot of money, planning, timing. We have to start looking at that as an option. First i think we have to reinvest in the system and make sure what we have works as well as it did when we opened 40 years ago. The clock is ticking. Monday is just around the corner. A sports shake up in the east bay. Alameda county wants out of negotiations. The county is offering to sell office share of the stadium and arena complex to the city of oakland. The price could be between 100 and 200 million. The relationship between the city and county historically hasnt been the best of relationships. Its been very challenging at times. The move comes after years of stalled negotiations with raiders over a new stadium and just weeks before the nfl is set to decide if the team should be allowed to move to los angeles. Phil, that is a column in the San Francisco chronicle. It is. This deal changes the equation in the east bay. Instead of two or three entities trying to negotiation with the raiders and too many cooks in the kitchen has been the problem. Already talks are going on between raiders and oakland about what it would take to keep them here. Three points. Raiders want free land as part of the deal and development. Thats not going to be easy. They want the current debt which is about 120 million for the last stadium renovation not to be part of the deal. In other words thats going to still be assumed by city and county. And they want infrastructure. That can cost a lot as well. In other words, this is the deal. This is what they want. Its not going to be cheap. Its still annoying i think to me maybe because i am not a huge sports fan that this multi dollar industry of nfl and the teams would need money from us, municipalities, to build. It appears oakland could put together a deal that would be financially viable. In other words they could get the stadium built. The question is whether it is financially advantageous enough for the raiders and nfl. So do you want the stadium or do you want some big profit as well . Thats where it gets dicey. A hearing, a high stakes court battle over uber and lyft, a Class Action Lawsuit that could make uber Drivers Company employees instead of independent contractors. The hearing this coming friday is focused on a motion by uber that argues the lawsuit should not be certified as class action. They say it should only apply to drivers who filed suit. Thats three drivers. The difference is huge. If uber were to lose the case more than 160,000 california drivers could be eligible for paid expenses like cars and gas plus benefits like workers comp. It is all part of a larger debate. Uber drivers say they like their independent contractor status. They prefer it to being full time because it offers drivers more freedom. Its going to be interesting because uber has been valued at 50 billion. I mean, it is one of the Biggest Companies and growing into china, india, asia. On the homefront as noted, there are questions about the relationship not only with the drivers but with Insurance Companies and with local governments as well as they constantly expand in what they call the shared economy. Thats another sort of story of the legislation trying to catch up with tech no the gee technology thats really being widely used. State lawmakers helping to grow a bigger Business Environment for cannabis industry. The two sides met in sacramento and theyre trying to figure out ways to make it easier and safer for dispensaries to pay their bills. Banks cant work with them because marijuana is still a banks look at the situation and say i dont want to be part of this. The result of that is all the legitimate cannabis businesses now they have to do everything with cash. Thats not safe. Thats not safe for communities. Thats not safe for employees. Theyre facing the same issues in colorado and washington where recreational pot is legal but so far nobody has come up with a solution. Its frustrating. This is a legal legitimate business. Cant we find a way to work this out . No. Thats the short answer. Maybe in time we will, but right now we cant. Could 1 billion make a dent in the drought . Thats what we will find out. Senator Diane Feinstein has drawn up a bill for emergency relief to help drought stricken communities. One water expert believes the focus should be efficiency in getting more mileage out of the water we already have. Californias water problem is enormous. Its developed over generations. Money alone isnt going to solve it. As the for feinstein bill it will have to work out of the senate and through the house where California Republicans have drafted their own plan. That republican plan would pump more water to the farmers by rolling back environmental protections which is another debate. There is debate about whether you build reservoirs or store under ground. This bill will not stay the way it is. It will be modified if it is passed. There is a lot of interest and even Diane Feinstein says you are the devil if you try to do it and you are the devil if you dont. This will be interesting to watch even as we go into another round of drought. Mark zuckerburg used facebook to tell everybody he is going to be a dad. With the good news came sad news. He says he and his wife have had three miscarriages. Its a lonely experience and most people dont discuss miscarriages because you worry your problems will reflect on you as if you are defective and did something to cause this. Congress is voting on it. We have a congressman in studio to give secretary of state john kerry has met with top officials in cairo as the u. S. And egypt resumed formal security talks that were held six years ago. Kerry meet with egypts president and foreign minister and on the next stop he will hold discussions with gulf arab Foreign Ministers on the deal. Joining us is congressman mark desonier who is like a lot of people on capitol hill feeling pressure from all sides. How has this manifested . A couple weeks ago a couple freshman were invited to the white house to go to the situational room to meet with staff. I was trying to juggle schedules and thought i wont be able to go. You werent crazy about the idea, were you surrendered to police. There is a courting process that goes on in washington. But i went and five minutes in the president walked in and stayed for a couple hours. It was intense, knowledgeable, and stressed how important it was to getting this done. The fact that he showed up to meet with how many congressmen . 12. 12. And he spent a couple hours. That shows a level of intensity on his part that we havent seen before. Theyre very engaged from what i am told by senior members of congress who have been there for the administration. He is completely engaged in this. Others have been up to talk several times. Theyre very invested. The opponents are equally invested. Arent they visiting and knocking on doors . Yes. Its a lot of pressure and its the middle east. People who want to protect israel dont trust iranians for good reason. In a vote like this pull the lens back a little bit because votes like this happen all the time in congress. That is where you have an issue and a group of people that are very committed to it. Say the pro israel lobby or the antiiran lobby. Theyre very committed to it. The rest of the public says it might be a good idea. How do you gage the political blow back. One group will never forget and another group will be thinking about Something Else come monday. There is aplite in the american Israeli Community too whether its a good deal or not, whether it will reach peace and more security for israel. I think the easiest way to do this is to focus on policy which is what i am trying to do. This s in you to me, but its very complicated issue and a complicated deal. Youve just got to delve into it and do what you believe is best. But you have been in politics enough to know that while you are driving down this policy road you are also looking at the signs that say warning, warning. If you vote for this, there is going to be a group that will come out against you in the primary. Theyre going to maybe support another candidate and put money in somebody elses pocket, right . Yes. I have found in my 25 years in politics that you have to be aware of that. Ultimately if you do what you believe is best you can explain why you did it because you understand the policy. I think the people in the east bay, theyre knowledgeable people. When you are at town meetings does this come up . I was at town hall a couple weeks ago in the district in danville and it came up with very strong emotions on both sides. I will have five town halls in august around the district and we will have one with half of the town hall on this. How do you gage that. Obviously it will be activists and advocates on both sides. Everybody else is taking their kids to school or watching tv. How do you gage whats going on in the meetings of the activists verses what your whole district is thinking . You listen. You do have to be aware that people who tend to come to town Hall Meetings are more engaged. You see the same folks. You just have to listen. Its retail politics. North bay the next seven days we will see this mini cooling trend before the temperatures bottom outcome tuesday. Then they will rebound again for the second half of our work week. Still we do not have any rain in this sevenday forecast. Police ticketing bicyclists rolling through stop signs and breaking rules of the road. Why cyclists say the crack down is doing more harm than a group of bicyclists protested over cyclists who break the rules in San Francisco. The group known as wig party had cyclists ride along market street. The idea is to have all of them come on it complete stops at stop signs to show that that, following the law, could worsen traffic. The group is named after this route called the wiggle which makes its way through San Francisco avoiding hills. We asked political insiders if they were full of hot air or if they had a point . Carla, everywhere i look bicycles appear to rule the roost whether on the bay bridge with an added lane that goes nowhere or the streets of San Francisco. What is the strength . Bikes are the future. The city better get used to it. They better learn how to work with these folks in San Francisco. There has been a contentious relationship. They should learn from oakland which has a better policy and relationship with the bicycle community. They need to talk about how to make the street safer for cars and bikes. What about people . How about bikes on sidewalks running over people . What do you do about that . I agree there are some bad bikers. There are a lot of bad drivers out there. Lets get real. More bikes means less cars, less gridlock. You may not recall but i had an incredible confrontation with bicycles when they had that friday deal they used to use. I had some cops literally riding along with them. I got rid of the cops as well as Critical Mass. We got arrests. I had Highway Patrol confiscate 50, 60, 70 bicycles. Mistake refer not a mistake. Yes. They supported for reelection and i kicked them at that time as well. You are correct. The relationship has to be equal. Right now, many many bicycle advocates want it to be unequal. They want you to start conceding their right to the road without paying license fees, without being licensed to ride bikes, without having helmets or any of those things. They dont want to assume responsibility for keeping their counterparts whom you refer to off the sidewalks. The great majority are safe bikers. You can see more and more of them on the streets. This is reality. Go after the people who dont use the lights at night, who dont have helmets, or who are unsafe but dont make them stop at every stop sign. Thats unworkable if you are on a bike. Well that is legitimate. You are correct. It is totally unworkable to stop at all apparently if you are on a bike. Keep in mind that in automobile accidents with bicyclists 75 to 80 is at the fault of the bicyclist, not the motorist. Thats part of the reality. We do need some system by which the government and bicyclists relate the same way the government and cars relate. It seems like all types of bikers are breaking the rules. I saw one of the sf Traffic Enforcement guys riding on the sidewalk. From the city . From the city. Riding on the sidewalk because the roads can be so unsafe. Thats the thing. As a driver you dont want them riding next to you either. One little mistake that anybody makes, somebody is dead. Its scary. Exactly. A very serious injury off the top. Slow down if you are on a bicycle or a bike, even a a quick check of the weather, mild today, a bit of a cooling trend in the next few days before tuesday and wednesday when temperatures rebound again.
