Top lawmakers in washington continue to clash over who is at fault for the shutdown. Our political reporter, melissa kane, tells us if all the finger pointing sounds familiar, its because youve heard it before. Reporter one party in one house of this congress is deliberately holding our government hostage. Its a familiar accusation, in 2013, it was the republicans who refused to pass the budget because they didnt want to fund obamacare. Heres nancy pelosi in 2013 saying that the budget should not be held up over nonbudget issues. We shouldnt take hostages because the weakness of our ideas. We should go confidently to the table of policy making to debate them. Reporter this morning, leader pelosi made it clear, no daca resolution, no vote on the budget. Theres unease on the part of some in the Republican Leadership to say we want to do it separately. Okay. But you have to do it first. Senate democrats refuse to fund the government unless we agree to their demands on something entirely unrelated. They want a deal on immigration and then theyll think about reopening the government. We have rain in northern california, down to sonoma and napa county. The north bay is getting wet at this point. It has been since about 4 00 this afternoon. Rain is coming down pretty good, a fairly decent downpour west of us. Well have timing and amounts when we cover the forecast in just a few minutes. We have new video now to show you of a San Francisco driver barreling down a public sidewalk in castro as people run after him, trying to get him to stop. This happened yesterday afternoon right after the van plowed into a nearby deli. Tonight, the 70yearold man behind the wheel is facing serious charges including attempted murder. Police say Kenneth Rotter crashed his van onto the sidewalk on castro street near market, backed into a deli and took out some parking meters after driving down the sidewalk. He then got back on the road and drove a few more blocks until he was stopped and arrested. No one on the street was hurt. Rotter has been charged with attempted murder, felony vandalism and driving under the influence of drugs. Tonight, the San Francisco medical Examiners Office is working to identify a body pulled from the bay. Somebody spotted the remains floating near the docks behind the ferry building. Its not clear how long the body had been in the water. We have learned a second little girl died from injuries suffered in a violent crash in antioch. 2yearold carmilla cardoza had been on life support in a hospital in oakland. Her 4yearold sister was old killed in wednesdays crash. The other driver, noe saucedo, was speeding in a stolen pickup and fleeing police when he ran a red light and broadsided the truck carrying the little girls and their mother. He is being held on more than 1 million bail, charged with murder, possession of a stolen vehicle and drug possession. The girls mother underwent surgery for her injuries. The number of People Killed from mudslides in Santa Barbara county is up to 21. The body of a 28yearold woman was found over the weekend in montecito. Her son, niece and sisterin law also died. You remember that that wall of mud and debris swept through the area after heavy rains early this month. It destroyed dozens of homes and damaged hundreds more. Search crews are looking for two more missing victims including a 2yearold girl. There is some good news for people around Santa Barbara tonight. The stretch of highway 101 that has been shut down since the slide is back open to traffic. An 11mile section of 101 is now back open. It took them about two weeks to clear the mud and debris that was blocking the road. A homeless man is facing charges for sparking a fire while Manufacturing Hash Oil in a storage unit. He was smoking a cigarette and dropped it near the chemicals. Within minutes a fire had spread. Six units were destroyed. All had some type of smoke damage. Thats an estimated 200,000 worth of damage. More than three months after suffering heavy damage in wine county wildfires two schools will reopen to students tomorrow. We have details on the challenges they faced and the lessons learned. Reporter on october 9th the fire storm rained down on santa rosa, destroying nearly everything in its path, including Cardinal Newman catholic high school. When the principal arrived the next day, he realized not all hope was lost. I was amazed we had at least half the school. I didnt think we would have anything. Its like we had half a school, we can do this. Reporter classes have been split between four different parish churches in the area. 22 portables were brought in to temporarily replace class rooms, the library and an administration building. The artificial turf on the baseball field melted. The team has had to practice and play at other schools, which held a lesson of its own. There are more important things than winning. Its participating. Its having it. Reporter right next door, saint rose elementary and middle school suffered a double disaster. After losing its preschool, kindergarten and second grade classrooms to the fire, they had to completely redo the surviving buildings because the Water Company restored pressure before the fire sprinklers were shut off, spraying 5,000 gallons of water into the rooms. First fire, then flood. Exactly. It made the mess bigger to clean up. Reporter all thats missing was a plague of locusts. Through it all, the principal says the kids have gotten even closer and have learned the school is much more than a collection of buildings. It is the people who gather there. This was a tremendous, testing, difficult time, but in the end it also is something that we learned a great deal from and were stronger for it. Julie watts found out theres a storm brewing, finding out who is responsible to maintain them. Pipe runs essentially over here. Reporter Kelly Oconnell had no idea there was a county storm drain pipe running under her property until it starting disintegrating, creating a sinkhole in her yard. The whole bottom part of this pipe is gone. Reporter like many other aging drain pipes in the bay area, this one carries storm water from county property here, underneath private property, in this case kelly and her neighbors, out to a creek blocks away. Who carries the responsibility when one of these pipes breaks, causing damage to your property . Well, you do. We dont own the water. Reporter but you own the pipes. We do own the pipes, thats correct. This section thats within the county. Reporter mike carlson says while the county owns and operates storm drain pipes under public property, the countys interpretation of the law requires homeowners to maintain the portion of the pipe that runs under their property. It doesnt matter whose water it came from but youre required to pass it from one side of your property to the other side. To say theyre not responsible for maintaining that infrastructure seems appalling. Reporter ian ren. Says this is the type of maintenance only municipalities can take care of. They warn that pipes like these were laid more than 50 years ago and theyre reaching the end of their life span. Theres a reason people pay taxes and fees, to maintain these facilities. Reporter but thats the problem. According to the county, while California Homeowners pay taxes to fund sewer and water utilities, most counties dont have storm drain utilities. They say theres no funding to repair or replace the aging pipes. There is no mechanism to help maintain the pipes. Thats why we have the problem we have. Reporter it appears a storm is brewing over who will ultimately have to pay. The only portion of this pipe that is draining onto her property is your portion. An argument could be made that a majority of the system is owned by the county, therefore, maybe they should have responsibility for the portion thats are on private land. In this case, yes, a majority of the system looks like its in the county. Reporter the county sent kelly this letter, saying she should hire a licensed contractor, she should pay to have a drainage permit and she should perform the work to county standards. I was shocked. How could a private citizen be expected to do that. Reporter a job she estimates will cost more than 60,000. I really, really feel like this is the countys responsibility. Reporter kelly says shell feel responsible to fix the pipe under her yard, since the problem downstream will ultimately cause more damage to her neighbors along thepipe. Weve got more rain on the way for the bay area. We have some pretty good downpours already. Much of the breadth of the front will be knocked out by the time it gets here. Today we had numbers that looked like the numbers yesterday, with upper 50s and occasionally the 60s. As we have a look at the bay bridge right now, the numbers have fallen into the 50s. It wont be as cold tonight as it was last night. The cold front is powering south over the bay area, bringing not too terribly much with it in terms of wind. But in terms of rain, the farther north you go, the more rain thats going to fall. At the moment we have gusts up to 8 miles an hour in santa rosa. The rain has been coming down for a couple hours now. Embedded in the front, a such hell heavy cells. Its all going to sink south as it slowly makes its way into marin county and south of the Golden Gate Bridge after 9 00 tonight. By the time it gets to central and south bay, theres not much left. The front will begin to fall apart by 5 00 in the morning, widely scattered light showers, so there will be slick streets for the commute tomorrow, with lingering showers in the south bay. The rain will be mostly done by 9 00, out it goes. Later on monday we begin to get drying. Tuesday looks pretty good. Fog will form in the night and Early Morning hours the next couple nights. On wednesday a more powerful system comes in with stronger winds and heavier rain. For tonight, well all get wet but not that wet. For the south bay well get up to a quarter of an inch of rain and lesser amounts to the south. Heres what we expect, rain in the north bay will spread south tonight. Well get a rogue shower or two monday morning. It will clear out monday afternoon, through tuesday, and then that sharper front comes through on wednesday. Overnight lows tonight will be in the mid40s. Sunup tomorrow at 7 41. Forecast highs looking similar to today with the south bay showers later tonight and early tomorrow morning with numbers in the 50s. East bay, pretty much ditto.
