Its such a rare encounter, so close to these gray whales, but the question that federal investigators are now asking is this legal and if its not, what are they going to do about it . While the whale watchers in this video are thrilled at the prospect of petting a whale in the wild, a spokesman for the center of biological diversity steve jones is quite the opposite. Initial reaction . Kind of appalled, you know. Its presented as its cute. You can pet the whales. Reporter thats because it might be illegal. The federal Marine Mammal protection act requires you to be 300 feet from whales and this videotape by anchor charter boats at ft. Bragg obviously shows the boat inside that space. Not only that, but goes on to show tourists petting the gray whale. You have to put this a lot on the whale watcher community. They really ought to know better and some of the fines can be loss of vessel or up to 25,000 for the vessel. Reporter we called the Charter Company asking about this and the owner said hes within the law because the whale came to him. The whale came up to the boat and started rubbing on the boat. It put its face all over the boat, was rubbing its back on it. At one point its head was on one side. The tail was on the other. It was like scratching its back on the boat. It was very, very pleased. Reporter always for the tourists, maximum punishment as for the tourists, maximum punishment could be up to a 10,000 fine and up to a year in jail. Noaa said theyre aware of the situation but cant comment further other than to say this is a prime example of what not to do when you see a whale. It sends a bad message. Also we dont want to domesticate our wild animals, particularly large whales. We would like them to be wary of us and keep their distance from us. Thats only going to happen if we keep our distance from them. Had i tried to maneuver away from the whale, i would have hurt the whale. It was down near the propellers on the hull of the vote where we would have either hit it or cut it boat where we would have hit it or cut it with a propeller. Its just not something i could do. Reporter the captain went on to say there is no law that explicitly states you cant get a whale. So i talked to noaa about that. They said it doesnt say dont pet a whale, but the intention of the law itself is to keep wild animals wild and for them to act naturally. The question investigators have to look at now is whether or not petting a whale makes it act unnaturally. Emily, the captain said the whale swam up to the boat. Does the law say anything specific about that and, if so, what is the boat captain or tourist supposed to do when that happens . Reporter so the whole premise basically of this law is to keep these wild animals wild, like i said, but also to keep them from to not disrupt them i guess i should say from what they would naturally be doing. So if its swimming your direction, youre not supposed to try and scare it away. Youre supposed to let it continue swimming and if it comes up to the boat, it comes up to the boat. The same thing with the petting. Would this whale naturally be rubbing its face all over the boat and sticking its head out of the water and asking basically to be petted if you werent petting them .
