This after he had broken through a sliding glass window and was threatening them with a nearly 9foot steel pole. She warned them hes in a Mental Health crisis. Mental health issues. Our officers train daily on when to use force. Reporter field officers are required to have eight hours of crisis intervention training. Even the head of the Negotiation Team was there but the situation kept getting hotter. Attorney for the hall family john burres says the officers did not follow their training. If they had been properly trained or followed their training they would not put themselves in a position of using deadly force or creating a confrontation by one yelling and screaming at him to put it down, put it down. Reporter walnut creek pd says their body cam footage says that hall charged them even after they fired bean bag rounds and thats when they opened fire. Attorneys for the hall family want to know why they did not attempt another felon lethal intervention. The officers have to turn to their right to shoot him with live rounds after the shotgun bean bag didnt work. That doesnt mean you stop trying because the bean bag shot didnt work. Why not the taser next. It seems obvious. Reporter now the family filed a claim against the city today. That is a precursor off into a state lawsuit. Burress says he might file a counter lawsuit. San francisco is now the first city in america to ban the sale of e cigarettes. The board of supervisors passing an ordnance this afternoon it prohibits the sale or distribution inside city limits. That includes brick and Mortar Stores and online. It also bans the sale of flavored tobacco products. It does not ban the use by people over the age of 21. And this just in within the hour, supervisors green lighted a controversial Homeless Navigation Center on the [ on the embarcadero. They expect to file a lawsuit. There are a lot of legal issues the city is just bypassing in order to build this as quickly as they can. The department of homelessness director told kpix five he expects the navigation to be built by the end of the year unless a judge decides to put the project on hold. A close call at walnut hill, fire broke out. Firefighters pulled up to fight the fire. Crews were able to stop the fire from damaging any structure. With fire season now here, pg e is warning that might have to shut off power for five days at a time. And some businesses say that may shut them. In three days it would be crippling to us. It wont be worth me having payroll for them because i couldnt keep them busy. My telephone systems dont even work without power. Steven shows up at Mountain Vista without telling his family members and each visit can cost up to 35,000. Slowly but surely draining his bank account. Even worse, collin says his father was admitted without his Blood Pressure medication, something the family didnt find out about for weeks. His counselor didnt understand the medications that i was explaining that he needs to be taking. We picked a place. Reporter the russells noticed the same thing when they paid 40,000 to check in their 19yearold son Teddy Russell to Mountain Vista last summer. During intake they were having a problem doing the Blood Pressure cuff. They didnt know how to do it. They were kind of fumbling. I said are you an rn she said no im not. I dont have any medical training at all. Reporter Mountain Vista farm is a state detox facility which in california is not required to have a doctor on site. And believes the lack of medical support changed their family. We trusted them and our son trusted us. Reporter he told the counselor he had taken xanax and oxicodone but that night tkeu run a screening. They allowed teddy to go into his room. Detox centers must check on patients every 30 minutes for the critical first 72 hours but that didnt happen either. At 10 15 he was found unreupon unresponsive. Seven hours after being dropped off, teddy was gone. Police came to the door. And i knew. And they said your son is at the morgue. And i was just like, what . Like, how can that be . Reporter the state has the ability to revoke the license of any rehab in which it finds a class a. Deficiency onsite. Teddys death resulted in two of those but the state did not shut this rehab down. In fact, we found the state hardly shuts any rehab down. So they only faced a fine. We found dozens of deficiencies from falsifying records, failing to report deaths, employing unqualified staff and not monitoring patient vitals like what happened to teddy. The russells are now joining a number of growing families filing lawsuits against facilities where their families died. They gave their son to the facility and said, here you go. He has a problem. Take care of him hes addicted. They utterly failed them. Whos going to care more about person than you are . You hope thats why you were paying these experts to do it. No accountability. No responsibility. Its a joke. Reporter one of the most difficult decisions that familys have to make is finding a rehab they can trust if theyre in this situation. And when researching rehabs unless they were to make a public records request the general public would not know if someone had died at a rehab. We wanted to change that. Tonight police are at the scene of a deadly workplace shooting at A Morgan Hill car dealership. Were just learning at least two people were killed. The shooting happened just before 7 00. Chopper5 flew over the store. Two people were shot including the suspect. They say both worked at the dealership. Special Counsel Robert Mueller is said to testify publicly before house panels next month. He agreed following a subpoena from a house judiciary and house committee. Mueller previously preferred not to speak. Mueller will testify on july 17th.
