The clock is running out on eviction protections for tenants in california. The statewide moratorium is set to expire in just two days. Susie steimle has a look at the last ditch efforts the legislature is making to prevent a wave of evictions. Its a pandemic. Were living in a history book so therefore, we have to try to have conversations of how to proceed forward and theres no easy answer. Reporter for this man, nothing about the past five months has been easy. He lost three jobs back in march. He needed all three to be able to afford rent in california. Hes a barber by trade but also worked for a concert venue and comedy club which have since closed. He applied for unemployment unable to pay rent. I sent my paperwork three different times and no results. So literally just got result last week. Reporter just in time for congress to suspend those 600 a week checks. Adding insult to injury, hes also injured. He tore his achilles which means he cant get back to full time work on his feet. And because he has not paid rent his landlord is now evicting him. A class lawsuit by my landlord for back rent which again leads me to believe all he cares ability is his bottom line. Reporter the only stopgap keeping tenants like him housed is a statewide Eviction Moratorium that expires on friday. We cant allow a massive wave of evictions. As well as homelessness. Reporter the bill ab 1436 is the best shot tenants have at staying houses. The bill would put in place an Eviction Moratorium until april of 2021. Tenants have to prove theyre impacted by covid19 and it helps landlords too. The bill offers mortgage forbearance for landlords of Small Properties for the next 12 months and six months of buildings with five or more units for landlords. The alternative if we dont pass state law, you will see potentially a massive wave of evictions of tenants who will be kicked out on the to the streets and landlords who will never get the monies they are owed. Its not always the tenant that is in a bad position. Reporter pattys mother wanted to take her rental property off the market back in 2019 before the pandemic. She let the tenants know the plan was to vacate in march. One tenant stayed. And i dont think that he was really affected by covid. Negativities. But he used it to not move. Reporter shes now working with todd an eviction attorney who says the statewide moratorium is on its face unconstitutional. Reporter hes filed a writ of mandate arguing the judicial counsel is violating the separation of powers provision in the constitution saying this moratorium denies landlords due process. He says for justice to be carried out. Landlords need to be able to take their cases to court. They have to allow someone to remain indefinitely without being able to collect money for their property. Their property is being taken without just compensation. Reporter he worries chus measure doesnt do enough to ease the burden on small landlords. I appreciate the people who are advancing this measure maybe well intentioned. I dont think theyve seriously thought through the longterm consequences. Reporter but for tenants like him, inaction means more fail safes falling through. So im honestly in kind of limbo no mans land. And im just hoping for a life raft or something you know. Kind of praying about that. And seeing whats going to happen going forward. Reporter judicial counsel is now recommending that the statewide moratorium stay in place through september 1st. To give the Legislature Time to put in place some additional protections. The judicial counsel is expected to formally vote by the end of the week. Susie steimle, kpix 5. Keep sending your stories and ideas to projecthome cbs. Com. The drive time 34 minutes 205 over to 680. The maps here you can see it originates all that red there right around tracy and Mountain House and extends beyond grant line over towards north flynn. At this point. You might see slower speeds in the Livermore Valley as well. A wind advisory in effect for pars of the altamonte and parts of 580. Taking a look at traffic elsewhere. Kind of just perusing the maps looking for slow spots. I saw some on the eastbound side of highway 4. But based on the sensors here looks like that may have cleared. Likely some overnight construction just getting out of the roadway there. But both directions of highway 4 all clear with no major delays to report there. If you are going to the eastshore freeway, things from pretty quiet on the westbound commute. Headed into gay field or that area, a little windy in that portion of 80. Now lets check in with mary.
