Investigators say they got a call of a shooting at the intersection of seventh and chester street in west oakland. Once on the scene, officers say the two men were in a struggle. One had a gun and the other was wounded. Investigators say the bart officer gave the men several commands to drop his gun before shooting and killing him. It is not about bart police but how is community can come together. The only thing i am concerned about, not who is right or wrong. They have to prove implied malice, meaning that he knew when he got behind the wheel of that car that he was doing something inherently dangerous to human life. You can talk to me all day long or have the judge instruct jury, that a motion is not to come into this case. Passion or sympathy is not to be decided by a jury. But it will affect this case. The jury will hear what this guy did. If they go to trial, i think they will get a conviction. Lets switch gears. What is going to happen with the man who was accused of killing kate steinle. I do not think he will get the motion thrown out. I think the met they judge will overrule or deny. They will take this up on appeal. I would sentence him to three years. But he turns around and walks out the door. As he takes a step toward that door, the feds will be there and will grab him. They will be trying him in federal court. The difference there is, San Francisco is a city in a county. The jurors come from the city and the county. In federal court, the jurors come from all the bay area counties.
