BOSTON – Citing prosecutorial misconduct, the state Appeals Court has vacated the second-degree murder conviction of a man accused of fatally stomping on Keith Boudreau in a Quincy bar in 2015. The decision calls for a new trial for Paul Fahey, who, after a jury trial, was sentenced in 2017 to life in prison with the possibility of parole. "We agree with the defendant that a new trial is warranted based on the cumulative effect of the prosecutor's improper cross-examination and inflammatory closing argument," wrote Justice James Milkey in the decision. The decision said former Norfolk County Assistant District Attorney Craig Kowalski's improper questioning and remarks during his closing argument "created a substantial risk of a miscarriage of justice and that the defendant is entitled to a new trial."
