Meanwhile, there is new reporting about the Trump White House response to the protests that erupted in the streets after george floyd was murdered. New york times says the Trump White House aides went as far as to draft an order that would have invoked the Insurrection Act in case the president decided to put active duty u. S. Military onto our streets. Its a barely used act for good reason. It allows president s to deploy the military for a Law Enforcement purposes. The paper reports a Furious Trump indeed told senior officials he wanted to stop last years protests by using active duty u. S. Troops. Meanwhile, more science tonight that trumps business appears to be facing great legal jeopardy. Nbc news has learned the Manhattan District Attorneys Office is expecting to file tax related charges against the Trump Organization. Possibly as soon as next week. Earlier this evening, georgias Attorney General called the accusations disgusting. And this is a blatantly political lawsuit. The firefighters and rescuers had been using water, but we have it has been raining. It stopped earlier in this afternoon. But it is raining last night, there was lightning which was not helpful. Rescuers cant work in lightning. It was torrential at some points today. They did continue to work, but so much water has accumulated in those very spaces, at the bottom of the building. Or at least what was the bottom of the building, that where screws are hoping there might be pockets of air that might contain survivors. So they made the decision earlier to cut back on fighting that fire with water. You can see behind me, the haze, the smoke and the steam, which is the combination of all of the debris and dust and the fires and the steam from the water that is in there. So, this is a very, very difficult situation. Typically, when you have the list of people are unaccounted for. As you reported, 99 last. White people say im not there. They report themselves in. Theres a number, a website, and Family Members say weve been able to reach them, they werent there. That number has not budge since it jumped to 159 this morning. The same four people have been pronounced deceased. No rescues, no recoveries, today. This is devastating for the families who are nearby. In a center that has now been moved to a hotel so that they can be in greater come for. An issue it was a community center. But theyre spending so much time there that there is now food and comfort for them. But theres no comfort in learning what is going on with their loved ones. In fact, authorities are now taking dna swabs from them to help them identify remains. But we havent even got reporting about that right now. So the bottom line is, theyre being informed every few hours. Were being informed every few hours. But as we end tonight, there is no reduction in the number of people unaccounted for. And no new discoveries in the last 12 hours, ryan. All i know is surfside, florida, certainly appears to be the saddest place on earth tonight. Carmen best, former police chief in the city of seattle. Chuck rosenberg, Justice Department veteran. Former u. S. Attorney. Good evening and welcome to you all. Chuck, i want to begin with your lifes work which is the law and get your opinion on this sentence, considering the range was no time at all to 30 years. Yeah, brian, youre exactly. Right people look at the floor, no time in jail, and the statutory maximum, in this case, 40 years in jail. And they assume is going to be one or the other. Actually, minnesota, like virtually over the state in the federal system, has a set of Sentencing Guidelines so that the average case is treated in the same way for like the defendants whove done like things, with like criminal history records. So, for Derek Chauvin, that number was was at zero, was at 40, that number was about 12 and a half to 15 years. A judge departed upward from that. He found two aggravating circumstances that chauvins actions were particularly cruel and that chauvin abuse the position of trust as a police officer. So, he went from that presumptive 12 and a half to 15 years or so, up to 22 years. Its exactly what he couldve done. His opinion, which i read earlier today, was methodical, linear, cogent, thoughtful. If you havent read it, i think you should. I think your viewers would find it interesting to see how the judge reasoned through it. And thats how he came with a number that currently nobody particularly wanted. Some people wanted a lot more. Some people wanted a lot less. But i think the judge ended up in the right place, brian. Ende chief best, it struck me that the sentencing came down this afternoon, at least here on the east coast, just as the 4 to 12 shift was getting underway. Police officers up and down the east coast were in locker rooms and ready rooms heading out their vehicles when they no doubt, got the word. What do you think the message of this sentence is two Police Officers across the country . Chief, i think youre mooted. Can you hear me . Okay, now we can hear you. Thank you. Great. I would say that i think that there is a heightened level of accountability. They recognize is being imparted on Police Officers on crosscountry. That said, lets not forget, that the police chief and several officers testified against Derek Chauvin. No officer mounted to see a murderer set free. They wanted to make sure that justice was served. And this is the message. We know theres gonna be more in the investigation, accountability. After those of us who work in the profession, im retired, but those of us still there, certainly we welcome that accountability. No one wants to see a murderer walk free. Eugene, we noted there were a number of calls in the wake of this sentencing. And as truck but it, some people were satisfied with it. Some people were not. But a number of calls for congress to at long last pass a Police Reform act. Were, to the best of your knowledge, does that stand as of tonight . Yeah, it seems like were a few weeks off still of getting an actual bill. Right . Theres three big players here. Senator tim scott, the republican. Senator cory booker, and [inaudible] in washington d. C. Talking constantly about face that they want to see in the actual bill. And they feel like they have a framework. The issue is, this is an example of hard deadlines, soft airlines, are back because they move over and quite a bit. They bypass the May 25th Deadline that President Biden thrust on them. Senator scott at one point said do or a bus. It seems like bust has occurred, past. They said they have a lot, they still have quite a bit of work to do. Even though theres a lot of pressure on them. Especially after today, to get something done immediately. Theres still discussing and arguing about officers use of force, qualified immunity. Which is whether or not to allow people to sue Police Officers or any of those guests that happen. The treatment that happens. And that is one issue where democrats are in danger of losing some Progressive House members. Someone like Cori Bush Out of missouri. She called it her redlined to have something about qualified immunity in this final bill that is going to come back from the senate. So there is still a lot out there. And theyre still trying to figure out just what is the right group of things to make sure that this passes, both in the senate and in the house. Both in youre right about politicians and deadlines. I dont imagine it would go over well if you asked the editor at politico to just simply move a deadline a few days. Hey, truck, were going to get into greater deal hill on this later. But i want to talk about the trump story in new york for just a bit here. Why did the new York Attorney Generals Office presumably tip their hand to someone about what was in the offing for next week . It seems to me, i dont want to sound naive, but there are two basic choices. Someone with loose lips around a reporter. Or someone asking with some kind of permission, some side kind of an aim, maybe to get weisselberg to flip in public. Well, its also possible, brian, that someone from new york a. G. s office had a conversation with representative of the Trump Organization, a lawyer, and told them that look, here are your options. Were planning to charge the company. So, you can either plead guilty,. Or you can wait until we charge you. Those types of conversations have been all the time, particularly in white collar cases. There are predate minutes she shuns, unusual, not. Nefarious nothing wrong with it but youre. Right. There seems to be other sources of information. Here not entirely sure theyre coming from. I do think if the New York Times is to be believed, theyre pretty good of late. It looks like the Trump Organization is going to get charged with serious crimes related to the operation of their business. Something we should absolutely talk about a little bit later. Eugene we also saw this week the senates pick darkly early riff on do you have any reporting that absent legislation for more lawmakers, this may be the way the administration is going to go statebystate if they have to . Yes i think thats exactly what is gonna end up happening, because there is no world right now which something that deals with long writes thats going to go through congress in the split that we have, even with some of the moderate democrats who have issues with as one, which was the bill that failed to even get that discussion in the senate. So, this is what the administration has talked about over and over about using using every single lever to work on things that they can get done in congress. That includes Voting Rights, that includes any civil rights, anything that can go through reconciliation. This is what is happening now, this is the Justice Department going on the offensive saying, hey, we have been acknowledging that something that something bad happened here in georgia that they thought this was targeted to make sure black people can vote. This is what this Justice Departments going to look at. Theres a conversation thats been happening on the right saying whether or not this is political actors doing something. But this is always going to happen. We were always going to see this Justice Department, we could see it when Merrick Garland was in the Confirmation Process that he was going to go after states if he felt like Voting Rights were in danger. He has talked about that over and over, he has talked about beefing up the groups of people in the Justice Department who work on Voting Rights because, you know, theyre not supposed to do political interments, the Justice Department knows the political realities of this country.
