Your daddy right now, what would it be . It would be i miss you, and i love you. What was going through your head . When you had your knee on my brothers neck . You knew that he pose no threat, he was handcuffed. Why didnt you just get up . My sons identity has also been reduced to that of a racist. I want this court to know that none of these things are true yay. When you sentence my son yay, you will also be sentenced sentencing me. The court then heard briefly from Derek Chauvin himself. At this time, due to some additional legal matters at hand, im not able to give a full formal statement at this time. But very briefly, i want to give my condolences to the floyd family. Theres going to be some other information in the future, that would be of interest. And i hope things will give you some peace of mind. Thank you. No one quite knows what that inference was two other information he was talking about. Late this afternoon, President Biden, who has become close to members of the floyd family, as you know. Hosted them at the white house recently. He was asked about the sentencing. Well, i dont know all the circumstances considered. But it seems to me that under the guidelines, it seems to be appropriate. Three other now former Police Officers also charged in George Floyds murder are scheduled to be tried it starting in march. They and chauvin will also be tried on federal civil rights charges. Meanwhile, there is new reporting about the Trump White House response to the protests that erupted in the streets after george floyd was murdered. New york times says the Trump White House aides went as far as to draft an order that would have invoked the Insurrection Act in case the president decided to put active duty u. S. Military onto our streets. Its a barely used act for good reason. It allows president s to deploy the military for a Law Enforcement purposes. The paper reports a Furious Trump indeed told senior officials he wanted to stop last years protests by using active duty u. S. Troops. Meanwhile, more science tonight that trumps business appears to be facing great legal jeopardy. Nbc news has learned the Manhattan District Attorneys Office is expecting to file tax related charges against the Trump Organization. Possibly as soon as next week. In a statement, a lawyer for the company said quote, a Corporate Office will plead not guilty and will make an immediate motion to dismiss the case. And on another legal front, the Biden Justice Department Today revealed, in suing the State Of Georgia over the restrictive new voting law signed into law by the governor. The doj argues parts of the law were intended to effectively discriminate against african americans. An the Justice Department will not stand idly by in the face of an awful attempts to restrict access to the ballot. Then came this. Earlier this evening, georgias Attorney General called the accusations disgusting. And this is a blatantly political lawsuit. This Justice Department, and im going to quote what Governor Brian Kemp said, the weaponization of the department of justice should bother everybody. It has now been weaponized by a group of political activists who dont like what our state has done. Tonight, we are also of course, keeping a close eye on the race to find any survivors found that high rise Condo Collapse in surfside, florida. Fire rescue and search crews have been working for a nearly 48 hours now, using both heavy equipment and their own hands to comb through the wreckage. The difference is this. Since we last spoke, the list of unaccounted for has ballooned from 99 people, which is where is stood at this time last night, to 159 people, currently listed as unaccounted for. There have been four confirmed fatalities as of now. We want to go to the very latest. Ali velshi is reporting from surfside, florida. Ali, two things. [inaudible] this is the first list of those unaccounted for. That larger and lot smaller. Usually they get smaller because people raise their hands to say, i was out of town, as that my sisters house, whatever and. Second the sadness of the scene tonight. This slow burning, Smoldering Fire underneath the wreckage. Lets not forget, there is propane, gasoline from every one of the gas thanks in every one of the cars that were pancaked while parked down there. And theyre using minimal amounts of water intentionally, to add to the weight of the wreckage. As they are in search and rescue mode. Yeah, unfortunately, you know well, brian, That Fire Begets fire. The firefighters and rescuers had been using water, but we have it has been raining. It stopped earlier in this afternoon. But it is raining last night, there was lightning which was not helpful. Rescuers cant work in lightning. It was torrential at some points today. They did continue to work, but so much water has accumulated in those very spaces, at the bottom of the building. Or at least what was the bottom of the building, that where screws are hoping there might be pockets of air that might contain survivors. So they made the decision earlier to cut back on fighting that fire with water. You can see behind me, the haze, the smoke and the steam, which is the combination of all of the debris and dust and the fires and the steam from the water that is in there. So, this is a very, very difficult situation. Typically, when you have the list of people are unaccounted for. As you reported, 99 last. White people say im not there. They report themselves in. Theres a number, a website, and Family Members say weve been able to reach them, they werent there. That number has not budge since it jumped to 159 this morning. The same four people have been pronounced deceased. No rescues, no recoveries, today. This is devastating for the families who are nearby. In a center that has now been moved to a hotel so that they can be in greater come for. An issue it was a community center. But theyre spending so much time there that there is now food and comfort for them. But theres no comfort in learning what is going on with their loved ones. In fact, authorities are now taking dna swabs from them to help them identify remains. But we havent even got reporting about that right now. So the bottom line is, theyre being informed every few hours. Were being informed every few hours. But as we end tonight, there is no reduction in the number of people unaccounted for. And no new discoveries in the last 12 hours, ryan. All i know is surfside, florida, certainly appears to be the saddest place on earth tonight. Ali, after a long day of reporting, thank you for staying up to update our audience tonight. Ali velshi, from the scene there in surfside, florida. With that, lets bring in our lead off guests, Eugene Daniels. White house correspondent for politico and coauthor of each days addition of the political playbook. Carmen best, former police chief in the city of seattle. Chuck rosenberg, Justice Department veteran. Former u. S. Attorney. Good evening and welcome to you all. Chuck, i want to begin with your lifes work which is the law and get your opinion on this sentence, considering the range was no time at all to 30 years. Yeah, brian, youre exactly. Right people look at the floor, no time in jail, and the statutory maximum, in this case, 40 years in jail. And they assume is going to be one or the other. Actually, minnesota, like virtually over the state in the federal system, has a set of Sentencing Guidelines so that the average case is treated in the same way for like the defendants whove done like things, with like criminal history records. So, for Derek Chauvin, that number was was at zero, was at 40, that number was about 12 and a half to 15 years. A judge departed upward from that. He found two aggravating circumstances that chauvins actions were particularly cruel and that chauvin abuse the position of trust as a police officer. So, he went from that presumptive 12 and a half to 15 years or so, up to 22 years. Its exactly what he couldve done. His opinion, which i read earlier today, was methodical, linear, cogent, thoughtful. If you havent read it, i think you should. I think your viewers would find it interesting to see how the judge reasoned through it. And thats how he came with a number that currently nobody particularly wanted. Some people wanted a lot more. Some people wanted a lot less. But i think the judge ended up in the right place, brian. Ende chief best, it struck me that the sentencing came down this afternoon, at least here on the east coast, just as the 4 to 12 shift was getting underway. Police officers up and down the east coast were in locker rooms and ready rooms heading out their vehicles when they no doubt, got the word. What do you think the message of this sentence is two Police Officers across the country . Chief, i think youre mooted. Can you hear me . Okay, now we can hear you. Thank you. Great. I would say that i think that there is a heightened level of accountability. They recognize is being imparted on Police Officers on crosscountry. That said, lets not forget, that the police chief and several officers testified against Derek Chauvin. No officer mounted to see a murderer set free. They wanted to make sure that justice was served. And this is the message. We know theres gonna be more in the investigation, accountability. After those of us who work in the profession, im retired, but those of us still there, certainly we welcome that accountability. No one wants to see a murderer walk free. Eugene, we noted there were a number of calls in the wake of this sentencing. And as truck but it, some people were satisfied with it. Some people were not. But a number of calls for congress to at long last pass a Police Reform act. Were, to the best of your knowledge, does that stand as of tonight . Yeah, it seems like were a few weeks off still of getting an actual bill. Right . Theres three big players here. Senator tim scott, the republican. Senator cory booker, and [inaudible] in washington d. C. Talking constantly about face that they want to see in the actual bill. And they feel like they have a framework. The issue is, this is an example of hard deadlines, soft airlines, are back because they move over and quite a bit. They bypass the May 25th Deadline that President Biden thrust on them. Senator scott at one point said do or a bus. It seems like bust has occurred, past. They said they have a lot, they still have quite a bit of work to do. Even though theres a lot of pressure on them. Especially after today, to get something done immediately. Theres still discussing and arguing about officers use of force, qualified immunity. Which is whether or not to allow people to sue Police Officers or any of those guests that happen. The treatment that happens. And that is one issue where democrats are in danger of losing some Progressive House members. Someone like Cori Bush Out of missouri. She called it her redlined to have something about qualified immunity in this final bill that is going to come back from the senate. So there is still a lot out there. And theyre still trying to figure out just what is the right group of things to make sure that this passes, both in the senate and in the house. Both in youre right about politicians and deadlines. I dont imagine it would go over well if you asked the editor at politico to just simply move a deadline a few days. Hey, truck, were going to get into greater deal hill on this later. But i want to talk about the trump story in new york for just a bit here. Why did the new York Attorney Generals Office presumably tip their hand to someone about what was in the offing for next week . It seems to me, i dont want to sound naive, but there are two basic choices. Someone with loose lips around a reporter. Or someone asking with some kind of permission, some side kind of an aim, maybe to get weisselberg to flip in public. Well, its also possible, brian, that someone from new york a. G. s office had a conversation with representative of the Trump Organization, a lawyer, and told them that look, here are your options. Were planning to charge the company. So, you can either plead guilty,. Or you can wait until we charge you. Those types of conversations have been all the time, particularly in white collar cases. There are predate minutes she shuns, unusual, not. Nefarious nothing wrong with it but youre. Right. There seems to be other sources of information. Here not entirely sure theyre coming from. I do think if the New York Times is to be believed, theyre pretty good of late. It looks like the Trump Organization is going to get charged with serious crimes related to the operation of their business. Something we should absolutely talk about a little bit later. Eugene we also saw this week the senates pick darkly early riff on do you have any reporting that absent legislation for more lawmakers, this may be the way the administration is going to go statebystate if they have to . Yes i think thats exactly what is gonna end up happening, because there is no world right now which something that deals with long writes thats going to go through congress in the split that we have, even with some of the moderate democrats who have issues with as one, which was the bill that failed to even get that discussion in the senate. So, this is what the administration has talked about over and over about using using every single lever to work on things that they can get done in congress. That includes Voting Rights, that includes any civil rights, anything that can go through reconciliation. This is what is happening now, this is the Justice Department going on the offensive saying, hey, we have been acknowledging that something that something bad happened here in georgia that they thought this was targeted to make sure black people can vote. This is what this Justice Departments going to look at. Theres a conversation thats been happening on the right saying whether or not this is political actors doing something. But this is always going to happen. We were always going to see this Justice Department, we could see it when Merrick Garland was in the Confirmation Process that he was going to go after states if he felt like Voting Rights were in danger. He has talked about that over and over, he has talked about beefing up the groups of people in the Justice Department who work on Voting Rights because, you know, theyre not supposed to do political interments, the Justice Department knows the political realities of this country. Couple of notes for our guests and our viewers along the way. Chuck rosenberg, you are not off the hook i have a few more legal questions for you, after the break. Chief best, i owe you some care time with the audience straightened out so we can hear your brilliant answers. And as we thank our guests for starting us off on this last night of the week, congratulations are in order for one of them, Eugene Daniels got engaged in this week. Sources reporting the Trump Organization could face tremor the charges a soon as next week. The das office has been building this case, mostly against the companys cfo, Allan Weisselberg hoping to flip him and getting his cooperation. Nbc news putting it this way, quote, Court Documents show that vans is probing possibly extensive in protracted criminal conduct at the Trump Organization which could include falsifying business records, Insurance Fraud and tax fraud. Still with us, chuck rosenberg. Chuck, weisselberg is key to this because the Trump Organization is not a vast organization. There is no board of directors, it is basically a family run company, with a lot of long timers. Weisselberg goes back to when trumps father ran the outfit. Michael cohen contends Weisselberg Flipping is not essential because he says that the documents that he is aware of, that the das own offices has, are damning enough. Please take on the question for us. We may be yes, brian, maybe not. As a prosecutor, you always like to have documents, of course. Compelling evidence. But you need someone to use another cliche, meat on the bone. That is why having individuals on the stand who can explain the documents, maybe who wrote the documents, who received the documents, who interpreted the documents, are so important in the criminal case. And as you described, allen well solberg goes way back a number of years with the Trump Organization. Many years. And to another point you made, also very important, it is a small corporation. It is a small, privately held company. And if anyone is going to know where the money is and where it went and how it went there and why it went there, its going to be the cfo, and that is weisselberg. So i dont think that is entirely correct, or at least in my experience, i want documents, and i want witnesses. Maybe that makes me greedy as a prosecutor, but to me having both of those things really gives the case more power. It makes it more compelling for the jury. I dont think anyone can make much more compelling in a fraud case then a cfo who is willing to testify against its principles. Ive never know a prosecutor who wants to try just a paper case absent human involvement. Chuck, based on the knowns and i guess, im going to ask you to react to what we know because it has been leaked. Do you think there is enough to flip weisselberg, do you think the proper pressure has been brought to bear . We are hard to say in the abstract, brian. People flip when its in their best interest to do so. For many people its in their best interest to do so when theyre looking at a lengthy jail sentence. Charging a corporation is not going to be enough in and of itself to get weisselberg to flip. Having said that, lots of people dont flip, they simply tell the truth. There is nothing to flip. You subpoenaed them, you interrogate them, you questioned them in front of a grand journey, and they tell the truth. Now, i dont know mr. Weisselberg, i dont need to cast any aspersions on that man, i dont know if you will tell the truth or if he would lie. But charging the corporation is probably not enough if he did something wrong to get him to own up to what he did. And so, there are other options for prosecutors. Perhaps they have a case against Miso Weisselberg directly. If not, they can always put him in the grand jury, indian my son and compel his testimony. Theyre a number of ways to get to the truth. Flipping a recalcitrant witness is one of them, but there are many ways to get to the same place. Let me play something that someone you and i both know, Daniel Goldman said tonight about this them. Its interesting and not surprising that they would approach the organization to tell them that theyre considering to charge them because that would be almost a death blow to the Trump Organization. Every single bank would call their loans if the Trump Organization is indicted. There is no way that the Trump Organization has enough capital to pay off all their loans. Some chuck, less than a rib minute remaining, but i share of course as a civilian, had not thought of that, do you concur . I wish i was half a smart as dan goldman. Charging a corporation can be cataclysmic for corporation. Just think of the accounting giant anderson, back in 2001 when it was charged as part of the emirates scandal. So dan is right, there is risk here there if you charge the corporation. Perhaps banks called loans, they dont extend for the credit. I dont know what each Individual Bank will do, but theres absolutely risk that prosecutors think of charging corporations, they can also think of the collateral consequences of the corporation. Understanding that our sanctions in charging the corporations it would be wise to listen to what he has to say. Our guest tonight, stand late for extra credit. Our friend chuck rosenberg, chuck, always a pleasure. Coming up for us the gop had all of today to condemn a Fox News Anchor who called the chairman of the joint chiefs a pig and stupid. On the very same day the man who murdered george floyd was sentenced to over 20 years in prison, were learned of the Trump White House was prepared to deploy activity u. S. Military to put down the protests in the streets last summer. Thats according to new reporting from the New York Times today. Quote, responding to interest from president trusts, white house aides drafted a proclamation last year to invoke the Insurrection Act. Mr. Trump was talked out of the plan by three officials. Those being Attorney General bill barr, defense secretary mark esper, and joint chief chair mark milley. But a separate group of white house Staff Members wanted to leave open the option. Well, with us again tonight, Charlie Sykes, founder and editor of large of the bulwark. Or four of the successful book how the right loss is mine. And heres bill kristol, author, writer, thinker. Editor at large over at the bulwark. And gentlemen, good evening to both. Charlie sykes, i want to read you from the Michael Bender book upcoming from the inside the west wing. Quote, thats how youre supposed to handle these people, trump told his top Law Enforcement and military officials. Crack their skulls. Trump also told his team that he wanted the military to go in and be the bleep out of the civil rights protesters. Just shoot them trump said on multiple occasions inside the oval office office, according to the excerpts. Charlie, couple things. Number one, this may account for the attack on General Milley who had the presence of mind and courage to stand up in that moment and say no. Number two, does this prove that with january six in mine, trump is an anti protest, hes anti certain people who protest . No its, also a reminder of how this country has dodged a bullet by not giving him a second term. And how grateful we should be to people like General Milley. What we see again is who donald trump was and how close this country came to real disaster. His will to power. His loss for violence and his fantasies about using the military are on display there. And you have to wonder what he would have done had he not had restraining hands. And what he might do if he ever gets back into the presidency. Back into t bill crystal, a p quotes indeed are erdogan ian, to coin a phrase, and enough to make the cuddly of old blush. But then we move on to the attack on the chairman of the joint chiefs of staff. Well youve done nothing to deserve this, lets listen to what went out over the air last night. He didnt get that job because hes brilliant or because hes brave. Or because the people who know him respect him. He is not and they definitely dont. Milley got the job because he is obsequious. Pardon me, that man wears a uniform. Hes not just a big, hes stupid. Bill kristol, did you think in your lifetime youve live to see a day where the write was out to disfigure, denigrate, perhaps destroy the u. S. Military . I didnt, but a lot of surprises. Mostly very bad ones. In the last four years. To that previous point on the Insurrection Act. When General Milley and general esper walked across the square with trump, immediately regretted that. There were three people in that room. Mark esper, secretary of defense, bill barr Attorney General and the chairman of the joint chiefs, nearly. Trump fired esper right after the election. Bill barr quit on December 23rd as i recall. Not wanting to have to do certain things that trump wanted him to do. I think they had so many disagreements barr couldnt stay there. I mean, i just come back and we discussed this a little bit before, but i want to take this occasion to say, people really, really, really were worried about those last week or two of december, and those first two or three weeks of january, and the pentagon. Serious people. Trump in his loyalists there. I do think the uniformed military has a very delicate dance of maintaining civilian controlled by while making sure they General Milley put out that statement and i think he sent it to all the troops saying our loyalty is to the constitution, to the law. Not an individual people. How close we came to a genuine constitutional crisis, i think, is not fully appreciated today. And two of those three people who stopped trump, helped stop trump from invoking this Insurrection Act on june 1st, they were gone by the last month of the presidency. Again [inaudible] behind the scenes [inaudible] did resist. Including the uniformed military. In a pretty impressive away, i would say. So, they hate a conservative media, the trump media. I hate to even use that word, conservative. The trump media hate that. They hate milley. The millie was a Trump Appointee at the time. Some people worried he was too loyal to trump. But he did stand up and do the right thing. Hes standing up to those in congress now and defending the military and their various policies. And they just cant stand it. Gentlemen, stay with us. Im going to fit in a break. Will continue our discussion on the other side. And indeed, coming up, the coming revenge tour. Kicking off with a Grievance Rally of sorts in ohio. So, weve got that to look forward to. Forward to are your hr processes weighing down your employees . On to quarterly projections expense report if youre using multiple systems, reentering data over and over time sheet using email and spreadsheets to manage information and approvals, then your hr systems are a drag on productive time. Do they know this door is locked weve got to ask if youre any closer to a decision about 2024 . I think youre going to be thrilled. Youre gonna be very happy. We want a little time to go by. Ill be making an announcement and the not too distant future. So, trumps going to hold his First Official Campaign Rally since leaving office on saturday. His return to the trail being billed as something as of a revenge tour. It will kick off a series of events in ohio to support the primary challenger to congressman anthony gonzales, who made the mistake of voting with his conscience. He voted for trumps second impeachment. As political puts, a former President Trump is a bronze, rested and politically bloodthirsty. Remaining with us, Charlie Sykes and bill kristol. Bill, three prominent republicans in ohio. Governor, Lieutenant Governor, and little behold, rob portman. Citing prior commitments, are not going to attend the revenge tour stop in ohio. Granted, salk jurors have become unruly places during the pandemic and to need sorting. Is it your hope, a case of the prior commitments. Perhaps, wallets no substitute for actual courage, might break out in some of the cities and states that are stops on this tour . That is sort of a wonderful [inaudible] [inaudible] some of them do. And actually the Lieutenant Governor has to some, better than most republicans. But still, they step aside. I think they might put out a statement of come trump coming to the state urging him to speak up. Asking people to get vaccinated. Speak up and say that the election was was true, and stop the deploying destroying the democracy. That would be too much. Ask charlie, i want to back up one subject matter. And talk about the item in the previous segment. Fox news is on in virtually every mess hall and lounge in military bases foreign and masticate. Think about, it through the ranks there are going to hear fox news refer to the chairman of the joint chiefs as a stupid pig. The rules and an open letter to your old response and friend, former speaker of the house paul ryan, who is on the fox board, asking him this was months ago, to push back. Did you ever hear back from him . No. Unfortunately, although i think the silence is rather eloquent. Look, you have and im glad you asked me about. This because that was one of those really extraordinary moments. We cant get numbed about what Tucker Carlson is doing. And what fox news is allowing to go over its airways. But think about this, you have this pampered, man child, trust fund baby, calling a decorated veteran a pig and stupid. And you would think that people would step back and say, okay, im sorry. You can disagree with the man, but we are a party and movement that has always prided ourselves on respect for the military. Respect for what he has accomplished. Those stripes on his sleeve are not venmo accounts. Those stripes on the sleeves are places that he has served his country. And it is interesting, as you pointed out, the ongoing silence from other republicans. The ongoing silence from other folks at fox news. I guess part of it is, bill and i were talking about earlier this morning, its just the stupidity of it. Its the crudity of it. Its the lack of patriotism. Its the willingness to throw any value, anyone under the bus. Whether they are Police Officers, or whether they are the military. But this is the norm that the Republican Party and the right and the conservative media have fallen into. They wont push back. They wont stand up for this. Theyll mature brian, im actually having some flashbacks to 2015, 2016. They know that donald trump is a cancer on the party, but theyre hoping that someone else will do something about it. Someone else will see something about it. That something will come along to make this cup pass away. But they are cowardice is on display, again. And if they dont stand up against him, youre going to see this crazy spread. Coming to ohio, its very interesting because, he continues to target fellow republicans. And he continues to up the ante, demanding more and more of them. So, in ohio, you are seeing the greatest elements of the party competing with one another. And you might end up losing a very Winnable Senate seat because no one is willing to push back against what donald trump is doing to his fellow republicans. To his fell i will also add,d never forget the goals of the foreign interest that are all quietly all over social media. They rhyme with vladimir putin. And those interests are to cause division in our society, we can our alliances, we can our military, among other things. Gentlemen, we will do this again for good reason. Charlie sykes, bill kristol, thank you both for staying with us and joining us tonight. Good we can do both. The urgent search for the cause of this disaster also continues, all the while. A report again tonight from nbc news correspondent sam brock. Above the rubble of the smoldering 12 story high rise, and the desperate search for survivors, heres a look at the devastation before and after. A collapsed wiping out a huge part of the building. Now efforts to find out what caused. It how soon do you think theyre actually going to start the investigation . I think the investigation has already started. If i use doctor says investigators can review Design Documents then take samples from the debris and see if they.
