If the past is any indication he is absolutely going to be using the third indictment as a key part of his Campaign Messaging in the coming weeks and months and the way that the legal calendar is lining up with the election calendar, primary calendar, it is going to be fairly easy for the former president to soak up a whole lot of oxygen, which is going to make things pretty difficult for his primary opponents. Youve already got him posting on truth social that he just needs a fourth indictment to secure his election, and some of his allies are saying indeed, three or four indictments are actually politically not legally, but politically better for the former president than just one because it muddies the waters and makes it difficult for the broader public to focus on the details of any one of these indictments. Who is going to read 40 some pages when there are three or four major legal cases and he can continue to do what he did yesterday on the tarmac and hammer the message this is a political weaponized system that is out to get him and if youre looking at the polls, a whole lot of Republican Voters are buying that message. Now, were talking republican primary voters and that is the focus now. What does that mean for the general election . Thats a different story. But thats not at issue right now and when looking at the legal calendar and primary calendar, this is why youre having his lawyers trying to delay, delay, delay these trials so that they can try to run out the clock and hope he could get into office and if he does it is possible that all of this can go away. Reporter well, chris, the short answer is i cant tell you very much because like so many of these trials, especially involving opposition figures, this was a closed door proceeding and even apparently navalnys parents who havent seen their son in person for more than a year, even they werent allowed to attend. This was actually the fact that this is being done in secret is among a list of things that u. S. State department condemned when they condemned this ruling earlier today. The frultsz today, they werent a surprise to anyone, least of all to navalny himself. The russian judicial system rarely acquits those accused and prosecutors had already called for navalny to spend two more decades in jail, so in addition as you said the nineyear sentence hes serving. He released a statement yesterday through his organization saying that the sentence will be a long one. He knew this was going to happen. Hes going to be serving more than a lot of rapists and murderers in russia and said the sentences main purpose was to intimidate. The list of charges look like they were trumped up. He was accused of a bunch of different things. Creating an extremist group, inciting extremism, creating a Nonprofit Organization that infringes on the rights of citizens involving minors in committing dangerous actions and then this unique charge at the end, of rehabilitating naziism. Thats a criminal charge that was only put on the books in the last ten years and russian human Rights Groups say its vague and specifically designed to silence dissent. Of course, we havent seen much in the way of evidence during the closed sessions. This is something that State Department brought up when they condemned this decision. The charges dont resem whabl navalnys organization has been focused on and that is the thing that has probably terrified the kremlin creating this draconian reaction. Navalnys group the anticorruption foundation, mostly researches and exposes highlevel corruption in russia and the group has been outlawed and navalny and his supporters have in the past faced punishments worse than imprisonment. Navalny nearly died when apparently poisoned with a nerve agent. Many suspected the kremlin was behind that, it was an assassination attempt. I have to tell you, navalny willingly returned to russia after he had recovered, essentially giving himself up to russian authorities who were watching and waiting to arrest him upon arrival. Ron allen following that for us. So how does this play into the prosecution of the suspect connected to these murders or does it at all . Theres no connection between the identify of the woman found today, the womans remains found and the suspect in the case rex heuermann. He is charged with the murders of three women. This is a case, the woman identified as Karen Bergada that dates back to 1996, her remains found with the remains of the others who are part of this gilgo beach murder case. There are in total 11 sets of remains found and so far, there are only three that have not been identified. So again, they were able to match the dna of the set of remains with a family member. Heres how the d. A. Describes how they were able to identify this woman. In September Of 2022 the fbi was able to was able via a Genetic Genealogy Review to identify miss bergada as fire island jane doe. In october of 2022, using a swab from a relative of karen, we were able to definitively identify her. So theyve been using the genealogical research, sophisticated technique we see more and more in Law Enforcement and thats why they were able to identify the remains and this woman 27 years after she went missing. This was a solid number, but compared to the breakneck pace of hiring weve seen in recent years this is a number that represented the fewest hirings since december of 2020. Over the last year job gains have averaged about 312,000 per month, so to put that number in perspective, job gains for the previous two months were revised lower as well. Nonetheless the Unemployment Rate ticked lower to 3. 5 , hovering near a historic low. Wages grew more than expected up 4. 4 over last year and for the federal reserve, the slowdown in hiring is likely a welcome sign as it looks to cool the labor market. Its the wage gains that will be in focus. Those may signal that additional Interest Rate hikes could be needed to staunch Price Pressures since the Central Banks does see labor costs as a contributor to inflation. C. , according to multiple lawyers i spoke to, and to me, it puts on the table whats going to be a devilish and ongoing question in this case, how much will this court and this judge let donald trump get away with in terms of attacking the prosecutors and the judge and the process publicly . At what point does that verge into potential Witness Intimidation or other misconduct . Its a really tricky problem because donald trump is running for president. He has a First Amendment right to speak, including to criticize people, who he deems is political opponents. Normally a defendant cant just go out and trash the judge and prosecutors. Theres local rules in washington, d. C. That say you cant talk about the evidence in the case, for example, the lawyers or the defendant. This sets the stage for whats going to be an ongoing drama when the judge Tanya Chutkan picks things up in august and then ongoing as to, you know, how they will regulate, if at all, mr. Trumps conduct on social media. This is not the first time hes gotten a warning from a judge at an arraignment. In new york in april, the judge advised trump please refrain from Making Statements likely to incite violence or civil unrest and avoid rhetoric that would jeopardize the rule of law. This is unchartered territory in so many respects. Theres another thing i thought was particularly interesting about the judges admonishment here. A lot of people forget that one of the things that apparently that donald trump had listed in the target letter, although it was not part of the indictment was the notion of Witness Intimidation. Its telling the judge even without that having been charged, still felt the need to reach out to donald trump during this Arraignment Hearing and otherwise what would have been a standard pedestrian hearing, insert that which i will add myself to the name of many attorneys who have said, weve never seen anything like that in this sort of proceeding before. Theres that much concern about Donald Trumps ability to shape the public narrative that you do have to start putting in guardrails as early as possible. What does the law say about Witness Intimidation . There are very overt things that have been done, very overt personal threats that have been made, but again, what is the law saw . Youre not number one, youre not allowed to contact witnesses or other parties directly when represented by counsel. Thats a huge nono. Following that youre not allowed to get around that rule by sending someone a third party, if you will, to try to contact them or otherwise influence them or take other activity, for example, if you know that you are in a restaurant where they were eating to begin talking loudly or speaking loudly as if you know the things that youre saying are going to get back to them. None of those things are permitted or permissible. With someone who has such a wide platform as donald trump does, these are unchartered waters because what he can do by his truth social platform and other things he can do is basically engage in a way that energizes them to focus on juror, witnesses or others of the court and thats what i think is the difficult part of trying to create a rule in this space for donald trump because weve never seen someone who has such a devoted following and is in this type of trouble who is willing to put that on the line by basically influencing his followers to try to put pressure on witnesses or other people who are involved in the Court Process . Jack smith, if you want to talk about just the indictment, he went to great tloengs say im lengths to say im not going after trumps free speech but it becomes an argument on the other side what is his free speech versus was does that cross the line of Witness Intimidation and endangering anybody else. Some of it is going to have to wait until the threat or the risk of the threat gets higher. There have been threat assessments by fani willis who hasnt even filed case yet, jack smith has done several and alvin bragg as well. Unfortunately, until there is a threat thats deemed viable, which is a very dangerous standard to have if youre someone who is potentially going to be victimized by his rhetoric, until that threat becomes viable most of the judges are going to stick to verbal rep panneds in court. If it comes to the point where it is believed theres a viable threat to the witnesses, prosecutors and so on, i suspect that the notion of a gag order will actually be on the table.
