After news broke that a federal judge in d. C. Denied it team trumps hope for three more days, to respond to the dojs request for protective order. The deadline remains monday, five pm, despite the push from trumps lawyers. The government is seeking a protective order to keep trump from publicly disclosing evidence gathered during the dust disappointments sprawling investigation. And to keep him from threatening potential witnesses. Special counsels office wants this all to have been quickly. In a new filing they say, quote, the government stands ready to press send on a discovery production. The defendant is standing in the way. And the request for protective order, the Special Counsels office cited this social media post from trump, reading, quote, if you go after me, im coming after you. The prosecutors argued to trumps rhetoric and possible use of grand jury transcripts could have a Chilling Effect on witnesses. This afternoon on msnbc, u. S. Delegate, stacey plaskett, who served as House Manager during trumps second impeachment, had this to say about the move from federal prosecutors. I think that this is jack smith and the prosecution is saying that they are not going to let him get away with intimidation. This is different than a gag order, which we keep the him from speaking at all in public. This is a protective order to protect witnesses, potential jurors, as well as the judge and those that are within the court room, and the transcript itself from being tampered with by donald trump. Of course, we cannot forget the backdrop of all of this. Donald trump remains the gop front runner for president. Once again, seeking to be the Head Of State of a government he tried to overturn in 2020. Im going to dive into all the legal questions in just a moment. Now, when we look ahead to what happened today, and all of these revelations in this back and forth between the trump team and between the doj, Special Counsel jack smith, and the judge overseeing that case. It is clear that the trump team is trying to delay the possible potential movements that we already know our to come. His Second Court Appearance in just three weeks. But right, now this is over the evidence that jack smith, the Special Counsel, has agreed to share with trumps legal team. There is concern, you read that truth social post, at the top of the segment, that he is going to pressure potential witnesses in this case. That he is going to divulge sensitive details, sensitive material, that is shared in this Discovery Phase A you said it at the top there that the judge denied the motion by the trump team to try and extend that deadline. By three dates. They said that this is a tactic. With the defendant, quote, stonewalling, and trying to delay their investigation. It is all just a split screen. Its a very good sign. The judges in control. And not the former president or his lawyers. The treat was unwise, in saying it does nicely as i can, it is definitely viewed as a threat. And i dont know what he doesnt get about the original Magistrate Judge saying you cannot commit another crime while you are out on bail. Or you will be held in custody. You cannot threaten or intimidate witnesses, or you will be taken into custody. I dont know whether that will happen now, but hes getting very close to forcing the hand of the justice system. Yeah, jill, trump posting prior to this, that we were just talking about, if you go after me, im coming after you. The Special Counsel citing the post in request for this protective order. Theres the post you referenced, attacking mike pence. When you talk about him not taking it serious, not understanding it, we talk a lot about the ways in which he tests the guardrails. He pushes the limits. This is no, even for him, right . Not understanding that a court operates differently than other government functions. These are limits that are enforceable. The other limits that he has ignored have been a common rule of behavior for a president of the united states. These are not just rules of behavior that are accepted. These are enforced rules. They are written rules. And im not so worried about what hes saying, as what impact it will have on his followers. And im worried about his conduct. Remember, this indictment, this last indictment, for interference with the election, is not for his words. It is for what he did. The phone calls he made. And for the impact that his words had on his followers. In saying that its so awful, saying i will come after you, what does that mean . Remember on january 6th, hang mike pence. He went out and tweeted, if pence had done the right thing, we wouldnt be in the trouble we are in. Then the calls for hang mike pence the game letter. It is a very serious threat. The court system has to take it seriously. If holding him in custody is necessary, eric holder has already said that the bureau of prisons can handle jailing a former president who has secret Service Agents with him. And so, it is not something that is desired. I dont think anyone wants to see that happen. Certainly, we want to see a trial, and an outcome, before that is even considered. But, if he is endangering witnesses. He must be stopped. Jennifer, so much of what we hear from trumps legal team, whether its this First Amendment argument that they are pushing, whether its this it took you three and a half years to do this investigation, we should have three and a half years before we have to deal with this trial. It all feels to me more like a political argument than an actual legal argument. Because every lawyer that we talked to says, yeah, thats not a thing. The argument that they are making has no basis. And that is also what hes doing on truth social. The attacks against mike pence. What is the political calculus there . And if you are mike pence, who sort of has gone out the farthest now that he has gone out in talking about january 6th, what is the pushback . What do you do . Well, i think youre exactly right. Those silly arguments about the First Amendment which does not apply in this case, in fact, jack smith right up front in the indictment says he could have said anything he wanted. But it is what he did that got him here. Whatever donald trump says through his lawyers, or directly, out to the public, is meant to increase his sympathy factor, his claim to be a victim. That they are squelching my free speech. And theyre persecuting me. This was all to keep his base engaged, keep them sending money. Remember, hes running low on funds now, to defend himself. And these various criminal activities. So what he says there has very little to do with what arguments, if any, hes going to make in court. You dont see him making at argument in courts, at least not yet. That he should have three and a hears three and a half years to respond to the indictment. Thats not going to happen. I think what is significant is, the judge responded very quickly. And once you make it a admonition, once you tell the witness if you do x, we will put you back in incarceration. We will put you behind bars. You then have to be ready to act. That is what is so difficult. Judges, up until now, have been very nervous about putting him in jail. They dont want to appear to be political. They dont want to appear to be scratching his First Amendment rights. But i think he has met his match in this judge. And in the entire circuit. Whats interesting, a few of the judges, including the senior judge came to that arraignment, and sat in the back. That was a sign of what we are in this together. Dont mess with the judicial system. So, i would expect that the judges are going to come down hard on him. Its going to take several rounds of this before were even contemplating putting him behind bars. This is the first step. We are going to have round two and round three, and run for. As far as mike pence goes, i think he has no choice. Hes been out there already. And he said, listen, i have to defend myself. And say that donald trump did something that was wrong. , eugene, theres the calculus, the political calculus for the people that are running against donald trump. And then theres a political calculus for all of the republicans in the house, and the senate, who is following in his state. You have House Speaker Kevin Mccarthy, immediately defending trump this week. And not only defending trump, but repeating a lot of the and main arguments that trumps lawyers were making. I mean, what are you hearing from these lawmakers . We know trump himself says only needs is one more indictment, im just becoming more popular, its all working for me in my favor. Is that what you hear from republicans on the hill . Yeah. A lot of them are scared of the base. They are not scared of donald trump. People arent scared of a truth social post anymore, theyre scared of the tweets when he was president. Theyre not scared of him anymore. They are scared of his base. They have people like Kevin Mccarthy who talked to donald trump often. Right, he talks to him sometimes weekly, over, and, over and over again. Who knows that, and Donald Trump Tells his base, hey, i dont Like Mccarthy anymore. Youre going to start hearing that bubbling up. And maybe mccarthy isnt speaker anymore. So hes protecting his face, right. When you talk to folks behind closed doors, and they know that youre not gonna put their name to the words theyre saying, theyll tell you they are sick of it. Theyre sick of having to answer for donald trump. Theyre sick of they wanted him, but they are scared of the base. And saying that in public. They are worried for their families, and what that could mean. They are worried what it looks like to be disloyal to donald trump. January 6th changed the calculus for folks. They are already fearful about saying things about donald trump. But january 6th showed, and weve seen over and over again, that some of these folks that like donald trump are willing to go to dangerous lengths. That is something that these folks have been thinking about, the folks in congress are thinking about all the time. They have families. They themselves are all raise worried about whats going to happen. The thing that is happening what they dont want to happen to them. They also know, and are hopeful, that someone is going to take donald trump out on the debate stage. Or through this primary process. Because they themselves are too scared to do so. They are hoping that the stance in this campaign gets it together. And is able to take donald trump on the debate stage. That chris christie, for some reason, bubbles up and takes him on. But that has not been the case for donald trump. The he has been very fortunate, and specifically, because he has spent his entire political career, and really his entire public clearer. Even on the apprentice. Saying, the reason people are coming after me is because theyre coming after you. He is being much more explicit about that now, that the folks in washington d. C. , this warm that is here, i am the only thing standing between you and them. Once you say that, and you have all of these republicans parroting that for years, of course these folks are going to believe it. So why should they choose mike pence or ron desantis, or nikki haley, or tim scott . When the guy who made those promises, and his promise to continue that, is standing right there.
