Developing this hour, donald trump and his 18 codefendants now have six days to surrender at the Fulton County courthouse in georgia, on racketeering and conspiracy charges. Three senior Law Enforcement officials tell nbc news, they are anticipating the former president will turn himself in at the atlanta jail, no earlier than thursday, but they stressed nothing is yet officially it. Democratic what congressman, eric swalwell, gave msnbc his assessment of what happens next for the former president. Here it is. Donald trump is going to get a Justice System that hes never been willing to afford to others. He always wants to try and convict people in the public square, without giving them any due process. Hes gonna get all the due process, hes gonna get every protection under law, and whatever happens to donald trump, it is going to come from his peers. And thats why i think its gonna be so sweet when he meets accountability. Meanwhile in georgia, there are new reports the fbi has joined an investigation into threats made against Fulton County officials in recent days, including members of the atlanta area grand jury that voted to indict trump. Also new today, trump deciding he will snub the first republican president ial primary debate, thats wednesday. Thats also according to two sources familiar with his thinking. Those sources say he is instead seeking a sitdown interview with former fox news host, tucker carlson. Trump spokesperson told nbc news, quote, we havent confirmed anything on our end. In atlanta, some of trumps gop primary rivals gathering today for conservative conference in the city where trump was indicted. Today, Chris Christie taking veiled aim at donald trump. Walk us through what that process will look like once it happens . Yeah, hey, alex. Heres what the process normally looks. Like for any other normal defendant who comes to this jail, over my shoulder here, and the sheriff here says that he wants it to be that way for the former president to. Lets talk about what that would look like, right . It would consist of the former president arriving, getting fingerprinted, getting his property searched. Turning over herself, on anything else he may have on him, getting a medical screening. And getting his mugshot taken before waiting in a room for sometimes upwards of 12 hours at this overcrowded jail that, by the way, is under investigation for civil Rights Violations by the department of justice. When the Secret Service is involved, and as weve seen in the last three indictments, of the former president , thats not typically what happens. At this point, we still dont know how its gonna go down here on the ground. What we do know, the former president doesnt plan to show up here until at least next thursday. Remember what the d a fani willis had said she wanted them to come here, setting a deadline of midday by next friday for trump and all the other 18 codefendants to show up here and go through the Booking Process. He plans to do that at least the day after the Republican Debate which is skipping, as you mentioned, at the top of your show. Thats not stopping the former president from taking to truth social, his social media platform, with continuing to rail against the Georgia Election results in 2020. Greg, with you, were gonna start with the fact that donald trump is expected to turn himself in. As julies reporting, no earlier than thursday. Will his attorneys successfully negotiate any kind of Special Treatment for the former president . You saw where shes standing, right . Outside of that Fulton County jail. Does he get there . What does the Booking Process look like . Yeah, notorious is an under step for subscribing the Fulton County jail. I cant imagine him staying there for hours and because of logistical nightmare. The left move inmates around, an already very overcrowded facility. I know that Surrendering Negotiations are underway. Were expecting him in the latter half of next week, after the debates. So, the booking of the 19 politicians, lawyers, and former president , greg, sitting closely the tories jail several investigation by the Justice Department talk about that. Are they in for a shock when they see that place. Yeah, again, its notorious. Its known as rice street here in atlanta. Its a place where even hardened Criminal Defense Attorney say you wouldnt want to wish it upon your worst enemy. Wow. A place that is plagued with civil Rights Violations. So, this is a facility that Fulton County authorities have long tried to get back on the right track. But it is a troubled, plagued facility. Unlike trumps previous three documents, julie, this arraignment have been separate from his booking. The arraignment is scheduled for the week of september 5th. It in the courthouse. In that courthouse, cameras are usually permitted. So, what does that mean for his first appearance for the judge . Will it be televised . Yeah, exactly right, under georgia law, they actually do require cameras be present in judicial proceedings. Of course, the judge has to sign off on that. Usually, and typically, they do. Georgia believes, under their law, of course, the public has a right, and an interest, to have an inside look as to their judicial proceedings. That will, of course, be super notable, previously, weve only got in those Courtroom Sketches of the former president sitting inside the courtroom, as the charges are being read to him, as he appeared in his first hearing. I will note, the arraignment that the d a fani willis had proposed to the judge for the week of september 5th, trump can appear virtually, perhaps, if they agree to that. Theres nothing in georgia law that says that is not an option. Currently, thats still on the table. Its not clear, because of, course the former president , all of the 18 codefendants, can file a separate motion to try and delay the start of the trial. They still havent fully agreed to the dates that fani willis has proposed here. Its not clear when were gonna see the former president in the courtroom here, he could totally show up virtually to the arraignment, if and when that happens. I do want to talk about something about you and greg are talking about that, just for color, just as if you setting outside this jail. My producer i have been going through that booking system, they actually have an app where you can see people who are being booked in the jail. So far, nearly 30 people have actually been booked just today. Just this morning at this jail. None of them, i will tell, you are those 18 codefendants. They can enter either right behind, me or theres a Back Entrance in this jail as well. This jail being busy is an understatement. Yeah, okay. The judge, greg, we have 34yearold scott mcafee, whos been assigned to hear this georgia case. What can you tell us about him . His background . And how it mightincher flip his approach to the case . Well, hes about to get the biggest case of any judge in his lifetime. Maybe the biggest case in georgia history. If he actually ends up overseeing it. We expect motions to remove this to federal court, we have no idea how those will play out. As of right now, scott mcafee is the judge assigned to this case, 34, as you mentioned. Been on the bench for about seven months. He was just appointed by Governor Brian Kemp. Hes a former prosecutor, former inspector general, he is a renowned musician with a long history of playing all sorts of different instruments, at a highlevel. But no one in Fulton County, no one in the state, no one in the country, has ever taken on a case overseeing a case like this one. His challenges laid out for him. Yeah, he sure does, pretty remarkable. So, greg, we have the fbi now confirming to nbc, it has joined an investigation into threats of violence against Fulton County officials, as well as the grand jurors who indicted donald trump. After the personal information was posted online. So, will this judge consider these threats at the arraignment . We how do think that could play out . Yeah, we saw the federal judge consider these threats, in terms of warning the former president that any of these malicious statements he makes could speed up or timeline. Look, this is all goes back to the georgia case law from hundred and ten years ago, that allows the publication of grand jury names. Now, theres calls to change that statute, to shield grand jurors from this sort of attention. They were just doing their jobs. Now, local authorities and federal authorities are having to step up security just to make sure that they remain safe. Lets go back to december 14th, 2020, greg, the day that Georgia Democratic electors cast their votes for president biden. You spotted republican electors holding what they told me it was an Education Meeting behind 2 16 there the state capital. You witnessed the meeting, which is essential now in the alternate electors scheme, only three of the 16 people in that room are now facing charges. From what you know about them, are they likely to cooperate . To try to escape jail time, or no . Well, we know that at least eight of those fake electors have already taken immunity deals. We assume that theyre cooperating. We dont know if anymore have. We know that prosecutors have always kind of focused on those three, partly because one of those three was former gop chair, david schaffer, alleged to have orchestrated the fake elector plot. Another one, is now a state senator. He was secretary of the state Republican Party at the time. We assume thats why prosecutors are narrowing on them. Theres also another name out there, Lieutenant Governor robert jones, state senator, whos also fake elector. In prosecutors have initiated an investigation that could involve him. They havent said whether they charged him yet. Fani willis was ordered not to investigate, him she held a fundraiser for burgeo and political opponent, now, there is procedures underway to possibly investigate him as well. Get around that. Because the times lays it out, three different prosecutors, four different cities next year, in the midst of a president ial campaign. Saying that its gonna be nearly impossible to pull it off. What are you hearing about the potential timing . Well, i mean, the trump legal strategy has always been to delay, delay, delay as much as possible. Try and push back these trials as much as possible. Ideally, until after the full election. Thats not gonna happen. We are not, i feel like, going to be seeing these federal cases stretched out that for. But he does have a point that for the criminal cases, at least, he does have to be there for them. He doesnt need to be in need to be in court the suffering theres civil case that hes facing. Both in new york one federal civil case. Again another Defamation Case against e. Jean carroll. And one civil case from letitia james, the new York Attorney general against his business. He is going to have a lot to do, on civil cases, he doesnt have to be there. He wasnt there for the first e. Jean carroll defamation suit. He probably wont show up for this one. But the rest of them he does need to be there. So, its going to be a real balancing act, its gonna take up a lot of his time over the next few months. Starting at the beginning of the year. Yeah, absolutely. Referring to the delay delay tactic, heres what trumps former white house lawyer ty cobb says about trumps proposal of a 2026 trial date start, lets watch that. Thats nowhere within the neighborhood of the neighborhood of possible dates. I dont think that the a lawyer decided date. I think that probably was a trump date. Im sure that the lawyers proposed something slightly more reasonable. I think that this case, the Election Interference Case in particular can easily be tried before the summer of 2024. So a couple of points, there chris. First of, all do you agree with ty cobb, and what makes this Election Case easy to wrap up by next summer . Well i do agree with ty. I think that the dates that he states are definitely trump driven. But listen, you know, i think that, and that is also consistent with his delay delay delay, but i think that he makes a really good point and that Donald Trumps first strategy is delay, but then keep in mind that these courts are really not hearing his delayed topics. And so a secondary thing is, lets make this trial my campaign. So really these trial dates are turning into his campaign. He is really rallying up to allow these trial dates to really be what he is campaigning on. So now he has turned his delay tactic into, they are out to get me. And so even though he has got the october Trump Organization hearing coming up, hes got the e. Jean carroll trial that hayes was talking about taking off on the same day as the iowa primary, he is going to utilize these trials to really be his campaign point. And you know what, the polls are really supporting that tactic. No, its true. But do you think that the Election Case, could that be wrapped up by next summer if it goes forward . If he does not win on delay delay Delay Tactics . It could be wrapped, up absolutely. But i think that the Trump Lawyers to make a really good point.
