Good evening once again, im stephanie ruhle, live at Msnbc Headquarters here in New York City. Donald trump also in New York City today, back in the courtroom for his third day of his civil fraud trial. He left court midway through the proceedings and was visibly angry on his way out. We are going to play some of what he said, even if it is filled with slander or lies or absurdity. We are going to play it because this man is the front runner for the republican president ial nomination, and what he says matters. Watch this. Im here, stop here, and i cant campaign. I would rather be right now in iowa. Id rather be new hampshire, south carolina, or ohio, or a lot of other places. But im stuck here because i have a corrupt Attorney General who communicates with the doj in washington, to keep you nice and busy, because im leading biden in the polls by a lot. This is election interference. They made up a fake case. They are fraudulent people. And the judge already knows what hes going to do. Nope, none of that is true. As far is donald trump being stuck here, not true. He chose to attend court today. And yesterday, and the day before. In fact, a reporter asked right after that why he made the choice to be there, and he said, because he wants to point out how corrupt the cases. Lets give you more facts. To be abundantly clear, there is zero evidence of corruption or any kind of election interference. In fact, that is what trump is accused of doing in two different cases. Here is new York Attorney general tish james soon after trump left the courthouse. Mr. Trumps comments were offensive. They were baseless. That were devoid of any facts or any evidence. What they were, were comments that unfortunately fermented violence, and comments i would describe as race baiting. Comments unfortunately that appeal to the bottom of our humanity. This case was brought simply because it was a case where individuals have engaged in a pattern or practice of fraud. And it will not sit idly by and allow anyone to subvert the law. And lastly, i will not be bullied. And so, mr. Trump is no longer here. That donald trump show is over. This was nothing more than a political stunt, a fundraising stop. As far as what happened inside the courootoday, we heard testimony from two accountants who at one point worked on trumps finances. One of them singled out trumps son, eric, who was in the courtroom today. Accountant Cameron Harris said eric was part of the executive Leadership Team who, quote, set the tone at the top. Meanwhile, eric sat in the courtroom shaking his head, no, no, no, during that very testimony. With that, lets get smarter with the help of our lead off panel tonight. And guess what, its a big news tonight, which means it is ladies night. Carol leonnig is here. Pulitzer prizewinning Investigative Reporter for the washington post. Susan glasser is back, staff writer for the new yorker. And a former u. S. Attorney joyce vance, who spent 25 years as a federal prosecutor. Susan, of course, none of these comments are going to surprise trumps base. But what about the rest of the country . Are we just getting used to him pushing these lies over and over . Its nonsense well, if there was a role against nonsense coming from donald trump, look. The bottom line is, it is about politics, not the law. Theres no lawyer, i a madrid, it would advise anyone, never mind the former president , attacking the judge in your case, attacking the judges staff in your case, attacking the prosecutors in personal terms. Thats not generally speaking a recipe for winning your case. So it seems very fair to conclude that what trump is doing here is continuing his campaign to return to office by other means. And his campaign, as his campaign in 2020 and 2016, its not aimed at the rest of us. To your question, its aimed at rallying and angering and riling up his own electorate and his own base. His base is not enough to win a president ial election, or it wasnt in 2020. Carol, whats interesting is, in the last few weeks although, donald trump has taken his rhetoric to a whole other level in terms of lies and slander and just overall darkness. What do you think going on . I love the word that susan used about riling up. Because what donald trump learned in his 2016 campaign is not only could he tap in to the anger, disappointment, and frustration of a segment of the population, but he could crank it up for his own benefit. For his fundraising, and for eventually his election to the white house. So when you ask, what is going on here . He has learned the lesson of 2016 and 2020, which is whenever he tries to appeal to peoples lowest expectations of government, the greatest distrust, their hugest, most fantastical conspiracy theories, that everyone is against him and potentially everyone is against them, it is a very winning combination. Now whether or not it gets him the number of votes he needs in the next election is still to be seen. But it has been at, winning role for him in many, many situations, and hes going back to that well. I think some of the comments hes made recently about, for example, the possibility that mark milley, the general and former chair of the joint chiefs of staff, would be executed, the idea of calling a prosecutor corrupt in her own courthouse, sending pictures of a judges staff member and calling that judge a left wing liberal, these are things that go not so much to winning his case, but winning his campaign. Okay, and all of these things go, joyce, to a question i have about the gag order. There is lots of people sitting at home this week go, didnt i hear something about a gag order . What does donald trump get to keep running his mouth with no consequences . And now we learned that he doesnt. Just like that, a State Court Judge in manhattan said donald trump, in this instance, you are just like everybody else. If you talk about my courtroom personnel, if you do it again, trump had posted a picture and made salacious statements about one of the judges courtroom deputies, a lawyer in her own right. And the judge said, thats the line. If you do it again, there will be serious consequences. As with all of these judges, the question is, whether or not there is an enforcement mechanism. Might a judge be willing to hold in contempt or fine or even jail donald trump to put an end to this sort of behavior . But the reality that every judge trump is in front of, ultimately faces, and we heard Tish James Say today, these comments are dangerous. Hes targeting people, someone could easily get hurt. And the judges bear the responsibility for preventing that from happening, even if it means taking this unusual step of gagging a former president while he is running for reelection. But joyce, hes not stopping. He went harder and more aggressive today than he has yesterday or the day before. Thats right. He has this upcoming hearing in the district of columbia, where there is a request for not a gag order a butlimited Restraining Order with prosecutor requested. And we may see judge engoron, is clearly very angry about this attack on his courthouse staff. He is, i think, and susans words, pretty riled up about that. And we may see matching the temper of trump, who displayed in the courtroom today, the demeanor of a toddler. And its still stunning to me, people, average americans, that is one of the kids behave like this, trump is behaving in a childish fashion, accusing everyone but him of being in the wrong, people will see through that. But here we have a former president who wants to blame everyone but himself for whats emerging as a clear pattern of fraudulent conduct. The question is, how long people and the judges will tolerate the ongoing lies . I think we are seeing the end of that sort of permissive environment for trump. Carol, hes out there saying hes stuck in the courtroom, when thats a lie. He could be anywhere he wants. Instead, hes in that courtroom and every chance he gets, hes asking his donors for money. Even a single dollar, while at the same time, hes talking about how super wealthy he is. So explain to me, is this Fundraising Mechanism actually working . And who is it writing the checks . Theyre nodding, saying you are right, big guy, you are the richest person in the world, let me write you that check. I dont get that either. I dont pretend to know exactly how well hes doing on the Campaign Trail in terms of donations in the last few days. But i will say this, steph, Donald Trumps poll numbers were really, what were described as milquetoasty before he was charged with a crime. His expectation has proven true. His expectation is is when hes up against the ropes, when he is appearing to be victimized, he plays a martyr role. He convinces his supporters that somebodys coming for him, so that they can block him from being president , and that means that the justice department, the federal Law Enforcement, the local Law Enforcement in new york, the county and state Law Enforcement in georgia, that all of them have chosen to come for him so as to come for voters who support him and to block their wishes. And, you know, these poll numbers were pretty pathetic until he was charged. And then they started to creep rather rapidly upward. Which is really interesting. Voters are seeing him onstage, acting that matter, and they are coming to his defense. Sometimes with donations, sometimes just with fair registration that that really supports the sky and are expected to vote for him again. Susan, lets talk about the trump case. Ivanka has wiggled her way out of this, but one witness today, a former accountant that worked with the Trump Organization tote by eric trump. Said He Sat On Top of the organization and at leadership position. Eric said, no sir, i didnt. And in the video of the deposits we, saw erik and don jr. , i dont get her any of this works. Is that going to fly . This wasnt a giant corporation. I dont get her any of this works. Is that going to fly . This wasnt a giant corporation. Less than 20 people or. There it was a Family Business with a big, giant. Bryant thats right, thats always the striking thing about the Trump Organization, it was a Family Business. And its one of the most extraordinary model in fact to me about the Trump Presidency that the president , when he came into white house, refused to do what all other recent president s have done, which is to follow ethics rules, to divest himself or at least place his holdings and a blind trust while he was president. He said he wasnt going to do that. Nominally speaking, his son eric was placed in charge of the Trump Organization. It is clear trump himself was still a personally engaged with his own business. By the testimony of numerous people who followed trumps career throughout, he cared most of all about the Trump Organization, not only did it have his name on it, but money has always been an animating factor for him. He was still working on deals, remember, even throughout the 2016 campaign when he was running for president. And so i dont think its going to be very plausible to suggest, as a defense in this case, that the family organization, that the family didnt know with the family was doing. Thats going to be tough thing to prove, i would imagine. Important reminder. The one thing that put juice in those deals was the fact that donald trump stood to potentially become the president of the united states. Thats what there was no way he was going to loosen the reins on his business. Joyce, lets talk testimony. What stood out to you from these two former accountants . The testimony is slow and perhaps not the six east part of testimony and a case. But what these accountants do is they build the case, you or member of the judge has already ruled as a matter of law there was a fraud involved. Now were looking at some of the remaining charges that the Attorney General has brought that and fulfill statements, primarily, and whether these false Financial Statements report for it and by who. But also the issue that is hanging in the courtroom is the issue of damages and how much money trump will have to pay, in essence, how much profit he has received as a result of the fraud that must now be disscouraged the accountants are an important part of expanding the lines of control and organization here. Eric its a great example. There was testimony obtained during depositions that he was responsible for the false valuation on one of the properties. And that he signed off on some of the Financial Statements in one year. Today, we are primarily hearing testimony about whether the trumps provided actuate in formation to mazars when they are doing the accountant. Weve already learned it was not really an audit in any sense of the word. It was mostly just a compilation of documents. And this accountant, who i think at some point, had to make a decision to did he want to be defendant or of witness, he clearly chose to be a witness in this case. He is now laying forth this sort of notion that he was not given the documents that he would expect to be given by any other business involved in this sort of accumulation of documents. I need to move on, but i do have to ask, quickly. Lets just say the damages are huge. Whats the timeline that he actually has to write a check . Or will he does get to appeal and appeal . Im thinking, six months ago he was ordered to pay e. Jean carroll 5 million. Has he written that check . Does she have the money . Typically, to appeal a judgment like this, you have to put an appeal bond in place. That money for instance and the e. Jean carroll case isnt in e. Jean carrolls hands, it but you have to secure your willingness to pay the appeal bond before you are permitted it to move forward. That is, i think, a partial step towards justice and these cases. I want to move on to georgia. Because the New York Times points out, even though trump will not be in the first trial this fall, hes going to looming large. Because thats how racketerring cases work. Can you explain to us, joyce . Sure. This case thats going to trial at the end of the month will only involve two defendants, Kenneth Chesbrough and sidney powell. The government still has to prove the entire conspiracy to engage in rico and the other charges that are made records to these defendants. So we will see, this will really be Fani Willis Teeing up the same case that shell bring against donald trump. She will have to prove that agreement was made among defendants to achieve that rico outcomes that would engage in this sort of effort to interfere with the election on multiple fronts. We will learn an enormous amount about the evidence that prosecutors in Fulton County have against donald trump in the course of this case against his two codefendants. Carol, also reporting georgia prosecutors are floating plea deals to some of trumps coants. How could these deals change things here . Just to be just as the accountant in new york is deciding hit rather be a witness that a defendant, there will be people in georgia who are charged in a very, very broad conspiracy. Theyare going to say to themselves, have private conversations with their lawyers, i just did this one little thing in this paragraph and i did it because so and so encouraged me to do it. And they will think about what the penalties are if convicted. What the changes are, if convicted. And what are your choices . That is something that every defendant has to wrestle with. Are they going to be actually convicted . What are the penalties for that . And when those people start to flip, essentially, and start to give their testimony, its some of the most powerful testimony there can be. Because they were essentially a party to this. They were a coconspirator. And now they are turning on, essentially, the head of that ring and saying, you did this i did this but im explaining how we do this together and why this happened.
