And in that tieing it potentially to border security. But again, its not clear, if jordan can get to 217 or scalise, a member of Republican Leadership can get to that number either. Its not clear if they can do that by next week, by next wednesday as well. What do we know about this latest effort to try to delay that case . Reporter one of the things we know is that this is something that is common for trump attorneys to deny or delay any action thats going on in the courtroom. But as you point out, this was just filed this morning before the judge gavelled the court into order. What we do know, what we suspect is that this is part of the effort of him delaying things while theyre appealing the judges Summary Judgment<\/a> from last week, in which they found the Trump Organization<\/a> liable of fraud. And we also know that the judge in this case now is giving both sides an october 26th deadline, which they must identify potential receivers for the dissolution of the Trump Organization<\/a> llcs, and this is something that the judge has said in his statement from last week is going to happen. He also made note that there is now an independent monitor whos going to keep watch over anything, any assets or any movement of assets that the Trump Organization<\/a> might attempt to do. Meanwhile, in court, letitia james, the attorney general who filed these charges against the Trump Organization<\/a>, shes back in court. As you know, former President Donald Trump<\/a>, he is not here. There are fewer people here, but whats happening now is the trumps former comptroller is back on the stand testifying, and what we know or what we expect to happen next week is that michael cohen, the former president s personal attorney who went to jail on Tax Evasion Charges<\/a> in connection with money paid to a porn star, hush money paid to a porn star during the campaign, hes expected back here next week. Cant say exactly what time. One thing we do know is that it seems that the case is being streamed on a little bit more now that the former president is not here. The attorneys are moving a little bit faster and the judge had asked Donald Trumps<\/a> attorneys to move faster and it seems they are complying with that today. Lets start with this latest move, this move to appeal, to halt the Civil Fraud Trial<\/a> thats already well underway. What do you make of it . Well, i dont think theyre going to be successful in halting the trial. Like you said, the trial is already underway and the trial is really about two things. One, with respect to this cause of action where there was the Summary Judgment<\/a>, there its really just about understanding what the penalties will be associated with that Summary Judgment<\/a>. But then there are six other claims, claims for falsified business records, falsified Financial Statements<\/a> and insurance fraud. Those are separate from the Summary Judgment<\/a> motion, and those are Going Forward<\/a> on disputed facts so i dont think youre going to see a halting of this trial as much as trump likes to delay. This is one of many moves weve seen in the past 24 hours, really just the past 12 hours overnight. This one with appeal in the fraud case, you have him trying to delay the start of the case after the election. They filed this motion to dismiss the 2020 federal election interference case, and that one they cited president ial immunity. I want to read from the 52 page filing, the trump team writes breaking 234 years of precedent, the incumbent administration has charged President Trump<\/a> for acts that lie not just within the outer perimeter but at the heart of his official responsibilities as president. Is this a real legal argument . So its interesting the way that they frame it, they frame it as well, its within the president ial duties for the president to communicate with the vice president. Well, sure, but not about trying to stop the certification of an election. Theyll say, oh, well, its within the president ial duties to communicate, you know, with members of congress and with other state officials. Well, yes, but when he was communicating with the members of congress it was to stop the count, when he was communicating with, you know, the georgia Secretary Of State<\/a>, it was to, you know, find 11,780 votes, so you know, you have to look a little deeper into the details, and when you look at the details, these are plainly things that are not within his official duties as president. Hes also arguing or his lawyers are arguing that his actions that have been alleged as part of some conspiracy were actually efforts to ensure the integrity of the election. Right, and that really falls flat because we know over and over again that members of his own staff, people that he hired at the white house, his counsel, people at doj, everyone was telling him there is no election fraud, and so when you hear that over and over again, this idea that he was somehow maintaining the integrity of the prorks you know process, you know, is completely bogus. We have to ask about new reporting in the New York Times<\/a> that trump is said to have realed Nuclear Submarine<\/a> secrets to an australian businessman. Nbc news has not independently verified this report, but the times goes on to say that businessman went on to share the sensitive details with others. A trump spokesman declined or talked about these reports calling them illegal leaks, denied any wrongdoing. How damaging is this in the classified documents case . These secreted were reportedly shared also at maralago . So i mean this has been the problem all along. He has these boxes and boxes of classiied documents and the question has always been why. Why did he want these records . Why did he fight so hard to keep them, even when, you know, you have the National Archives<\/a> asking for them. When you have a subpoena, and hes still doing all these things to try and keep them. This was the concern, he was somehow sharing the information and little by little were learning more about what he was actually doing with the information he had. Its damaging, its not charged conduct in the classified documents case. What do you make of that . Well, there may be many reasons, it may be that they dont have corroboration for it. I dont know if this witness was cooperative with them. They interviewed him it seems like multiple times, do they have any corroboration this occurred . Did those conversations happen at maralago where they would have venue, you know, there are any number of reasons they may not have charged this, but its certainly relevant, potentially other evidence that goes towards this kind of propensity evidence, you know, what is his propensity to be sharing and being reckless with classified information. So there may be arguments that it should come in, but if it is more serious than some of what is already being charged, it may not. Potential new legal jeopardy, new york congressman george santos, a former Campaign Treasurer<\/a> for santos has pleaded guilty to Conspiracy To Defraud<\/a> in connection with the case against her former boss, and according to court documents, former aide nancy marks admitted to fabricating donations to make it appear that santos had a much Larger Campaign<\/a> fundraising haul than he did. Joining us now nbc news investigate correspondent tom winter. In laymans terms what did she admit to doing, and how does it fit into the bigger case against santos . What she admitted to is falsifying the documents as far as what donors they had. In over ten years ive looked at these types of cases, typically what we might see if you were running for office, ana, and i wanted to give you more donations than perhaps i am allowed to under the individual contribution limits, what i might do is take money and give it to Family Members<\/a> or give it to other individuals and they would my donations in their name. Thats illegal. We do see that from time to time in these types of cases. What federal prosecutors say and marks admitted to, they didnt bother to do that. They wrote down that they received these donations from individuals. The purpose for doing so is that they could get money from national committee, which is very clear from the documents is a reference to the Republican National<\/a> committee. If they hit a certain threshold of money they say they brought in, the rnc would then provide them support in terms of funds and logistics, so that is something that is also illegal and lying on these documents is illegal, and thats something that marks has now admitted to. Santos has pleaded not guilty to the 13count indictment against him. Thats the focus as far as what we saw yesterday in the court. And the Charging Document<\/a> says that the prosecutors have Text Messages<\/a> between santos and marks so they have evidence to back up her testimony as well. Could this mean more legal trouble for santos . Well, i mean, certainly if the evidence and what prosecutors say here is true, it never hurts to hear from the actual individuals youre charging as far as what they were specifically doing. And obviously Text Messages<\/a>, im not an attorney nor do i play one on tv, but just from spending the time in court that i have and i think anybody would reasonably conclude that seeing Text Messages<\/a> between individuals is particularly powerful evidence. So yes, this does not bode particularly well for the congressman from new york, but again, we continue to watch this case. I did check the docket late last night, there was no sign of any cooperation agreement. Could that change at some point, of course that might be the case for marks.
