Revelation that new wall will be built at the border. The fury from fellow democrats and another move to deter migrants announced overnight. Hot off the presses, a surprisingly strong september jobs report. That is good news, but could it also mean higher

from new york, and this morning as tensions simmer on capitol hill, donald trump is inserting himself into the mad scramble to find the next speaker of the house. The de facto head of the gop endorsing longtime ally jim jordan overnight calling him a, quote, great choice. This as multiple sources confirm trump is consideration a visit to the capitol next week, right as jockeying and votes for speaker are expected to reach a crescendo. Also significant, it would mark his first visit to the hill since the january 6th attack. Joining us now, nbcs

Congressman Jordan
is a close ally of trump, a reminder jordan isnt even the only candidate in the race, theres also congressman steve scalise. How much weight does trumps
Endorsement Carry
in the house . Reporter it certainly carries a significant amount of weight. Its not necessarily a surprise. Jordan has been a close ally of the former president much like he has been a thorn in the side of the current one. Thats part of the reason why trumps endorsement carries weight among the hard
Line Conservatives
in the house gop conference. Will that get jordan to those 217 votes he needs on the house floor to clinch the speakership. That remains unclear, and in part thats due to the fact that moderates in the conference who arent big fans of the former president are

out on who they will support, in large part jordan, though, has the appreciation of some of those hardliners who are more likely to cause a stink on the floor. Moderates want to get back to governing. I spoke to a number of moderate members who want to fill this position as soon as possible. The quicker they can get to that magic number, including funding the government ahead of that midnovember

on items like ukraine funding, which is obviously very critical. And in that tieing it potentially to border security. But again, its not clear, if jordan can get to 217 or scalise, a member of
Republican Leadership
can get to that number either. Its not clear if they can do that by next week, by next wednesday as well. So brendan, trump had previously even earlier in the day floated this idea of him taking the speakers role, and now hes backing jordan, weighing a visit to the capitol. How much more complicated could that make the vote, and how do you think this idea of him going to the capitol goes over for lawmakers who were there on january 6th . Yeah, i imagine most people would prefer that he just stay home. I dont know what value he adds showing up. Youre right, it would make a circus out of this, what has already been a big sur cut. Im skeptical that hell actually show up. His endorsement of jordan, its meaningful but its not necessarily going to clear the field or anything like that. We talk a lot about how this is a trump conference, and it certainly is, but leadership races are more of an inside game. Its member to member, based on long relationships, rivalries, friendships. I think that is a coup for jim jordan to get that endorsement, but i dont think it dramatically changes the direction were headed. A lot of focus on moderates. I want folks to appreciate this is a very conservative conference. If you are seen as the conservative choice, thats good and maybe thats what the trump endorsement can provide. I just dont see moderates standing in the way of whoever the conference ultimately picks. Senator, as brendan just mentioned, the race for speaker is more of an inside game. Punchbowl news has reporting this morning about a
Potential Fox Debate
among speaker candidates. Thats a first. Is this a good idea . I dont think thats a good idea. I dont think its a good idea for donald trump to head to the capitol. Thats like coming in with a
Hurricane Category 5
hurricane after the destruction of a category 3. It is just not going to be good for anyone, with all the chaos that will ensue from whether its a debate, whether its trump going to the capitol. This should be folks talking to each other, trying to get something done. I think the real question that republicans have to ask themselves are do we want to govern or do we just simply want to continue to take votes on the extremes to try to show who we are, and that will be unfortunate, if we dont get a speaker of the house who is interest instead actually governing as opposed to continuing to burn the house down. Jim jordan, what would a
Jordan Speakership
look like if he is ultimately the victor here . Is he the uniier of the gop the house need . I cant believe im saying this. He may actually be. I think jim jordan may be the one person who could make this conference work. The motion to vacate, the thing that kicked out
Kevin Mccarthy
, i think you have to get rid of that. Thats a big lift. I dont know that its possible, but if theres one person who could get rid of the motion to vacate, its jim jordan, because he has so much credibility with the type of people who have been threatening to use it against him. Hes a very rigid ideologue. He means business. That will obviously scare off a lot of moderates. I think hes aware of that. Hes got some work to do to show that he understands if he was playing one role as a
Freedom Caucus
member, he would play a different one as speaker. I do think the biggest problem we have continues to be that hard are far right who dont trust leadership. They may not trust the next person in leadership up if its steve scalise. Jim jordan potentially has that credibility. Whether he would be a good speaker, but he actually probably is more reflective of who that conference is today. But senator, if jordans able to get all republicans behind him,ow does he then work with democrats . I think its going to be really difficult. Really very difficult, and i think brendans right. I do think jordan has the opportunity to unify a conference. I dont think he has an opportunity to unify the
House Of Representatives
and try to get things done. It seems to me he has not been interested in governing at all, and if you continue to do with a
Government Shutdown
looming again in like 42 days, if you continue to take political votes to make a point and youre not interested in working with democrats, which jordan has shown no inclination, which may be the number one criteria for the republicans in the house now, no inclination to work with democrats, then i think were still in for a long road leading up to 2024. Right, and how does anything get done in government when you have to have all the chambers, both the senate, the house, and the white house working together ultimately to passlaws. Your old chamber had this warning for
House Republicans
and a more conservative speaker wont necessarily make their dreams come true. Republican senator thom tillis saying so you get more conservative and that attracts more liberals to work with you on
Consensus Policy
. Havent read that book. Thats absolutely correct. Democrats did not take diagnostic in what happened in the
House Of Representatives
the other day, not at all. If theres one thing that democrats have learned to do under this president , under president joe biden, under the leadership of
Chuck Schumer
and nancy pelosi and hakeem jeffries, it is learn how to govern, to bring consensus together within a caucus that can also be very divided but learn how to govern for the american people. Thats what the u. S. Senate wants. Thats exactly what both sides of the aisle want, to see someone that they can work with because if it is burn the house down, sooner or later somethings got to give, and i dont think the senate will be in that position. I dont think the president will be in that position. I think it will ultimately hurt the country if we take a
Scorched Earth
approach that i worry about with the next speaker. And brendan, were also learning that a group of about 45 members of congress have now written a letter, the
House Republican
conference is receiving this to express frustration that a small but vocal minority of republicans were able to defy the majority and get mccarthy ousted. So it comes down to this motion to vacate rule that approved to be the
Achilles Heel
for mccarthy. It will threaten the next speaker if they dont get rid of it. This is one of the last things
Kevin Mccarthy
gave, just a

being able to give it up, it felt inevitable, the moment he made that give. As doug was talking about, there are realities of governing that upset conservatives and if it only takes two or three upset conservatives to boot you from working with democrats, its an impossible job. Its a sort of impossible job as it is, when you have this gun pointed at your head at all times, you cant do the things you need to do to be an effective speaker. You have to compromise. You have to work across the aisle, and thats whats made it so hard to get anything done. Im skeptical theyre going to be able to do it. I think jim jordan is the only person who could get rid of it. Weve talked about how there are no votes until there is a speaker, also on pause, the gopled
Impeachment Inquiry
into
President Biden
, and some may be surprised to learn that matt gaetz who ousted mccarthy wasnt sold on this
Impeachment Inquiry
. Do you think that could be going away . Reporter certainly not just because of what gaetz had to say, right . More so because of that hearing that they held into this inquiry a couple of weeks ago where the gop witnesses, the witnesses that republicans on the committee had called said that there is no basis at the moment to pursue an impeachment of
President Biden
. Gaetz made those comments according to our katherine doyle, but this isnt the first time hes made these kinds of comments. He said this before sort of down playing republicans pursuing this inquiry, and remember, it was speaker mccarthy, one of his last acts who launched the
Impeachment Inquiry
, thinking this could get those hardliners on board to maybe back off the push to oust him. I dont know where this
Impeachment Inquiry
goes next, certainly if you ask james comer, the head of the
Oversight Committee
or even jim jordan, theyre going to keep pursuing it in the inquiry phase. Its not clear that gaetz comments will shake or break loose on that. Its another example of gaetz crossing leadership, crossing the bulk of the republican conference and down playing what even jim jordan has been saying all along, which is that there is basis. There is evidence. They have yet to prove it. Certainly a

Policy Changes are coming as the
Biden Administration faces growing criticism and growing pressure from democratic governors and mayors across the country. The white house down played that as the reason for these changes, but how much of it is a factor . Yeah, hi, ana, good morning. A white house official told me and pushed back strongly on the idea that any of these changes had anything to do with this increasing pressure from democrats in places like new york, chicago, massachusetts, also denver seeing a large
Migrant Influx as well. The
Biden Administration is coming back saying this money was appropriated back in 2019, as you just heard in morgans piece, but also that this project was announced in june. What is new here, ana, is this idea that this waiving of environmental laws, this is highly unusual and in a notice in the federal register, dhs secretary
Alejandro Mayorkas talked about an acute and immediate need to construct physical barriers. Dhs
Secretary Mayorkas said yesterday those statements were taken out of context. You have to look at this as a whole picture. These
Border Numbers have been going up and the ground has shifted in terms of politics on this from the democratic perspective, when you have governor j. B. Pritzker, a staunch biden ally calling the situation in his state untenable, and that the federal government, he says, should be doing more, ana. On one hand you have some of those democrats saying not enough is being done. On the other hand you have other democrats saying what is being done is perhaps cruel in some way. Gabe, we know
Secretary Blinken and mayorkas were in mexico this week, and obviously that is a key partner, that countrys key partner with this administration in dealing with the surge of migrants. Whats the message there . Yeah, ana, the
Secretary Of State blinken as well as the dhs
Secretary Mayorkas were in mexico this week, and theyre trying to present a united front with mexican officials skprgs they spoke about a range of topics including a gun and
Drug Trafficking and increased cooperation on stopping that, but also the topic of this historic migration that were seeing in this hemisphere. There is talk about how best to stop that, and you heard also morgan report with that announcement of those venezuelan deportation flights rumoring. That comes after these meetings this week, and there is still some friction, however. Yesterday when this announcement was made public of these waiving of environmental laws to move this border project forward, mexicos president called it a step backwards, so certainly its something that the

Donald Trumps legal team officially filing an appeal to halt the new york civil fraud case against him. That appeal is just one of a barrage of legal motions trumps team is firing off to try to dismiss or delay the cases against him. Nbcs rehema ellis is outside the courthouse for us. What do we know about this latest effort to try to delay that case . Reporter one of the things we know is that this is something that is common for trump attorneys to deny or delay any action thats going on in the courtroom. But as you point out, this was just filed this morning before the judge gavelled the court into order. What we do know, what we suspect is that this is part of the effort of him delaying things while theyre appealing the judges
Summary Judgment from last week, in which they found the
Trump Organization liable of fraud. And we also know that the judge in this case now is giving both sides an october 26th deadline, which they must identify potential receivers for the dissolution of the
Trump Organization llcs, and this is something that the judge has said in his statement from last week is going to happen. He also made note that there is now an independent monitor whos going to keep watch over anything, any assets or any movement of assets that the
Trump Organization might attempt to do. Meanwhile, in court, letitia james, the attorney general who filed these charges against the
Trump Organization, shes back in court. As you know, former
President Donald Trump, he is not here. There are fewer people here, but whats happening now is the trumps former comptroller is back on the stand testifying, and what we know or what we expect to happen next week is that michael cohen, the former president s personal attorney who went to jail on
Tax Evasion Charges in connection with money paid to a porn star, hush money paid to a porn star during the campaign, hes expected back here next week. Cant say exactly what time. One thing we do know is that it seems that the case is being streamed on a little bit more now that the former president is not here. The attorneys are moving a little bit faster and the judge had asked
Donald Trumps attorneys to move faster and it seems they are complying with that today. Rehema ellis, thank you so much for the update outside the courthouse. Joining is former federal prosecutor kristy greenberg. Lets start with this latest move, this move to appeal, to halt the
Civil Fraud Trial thats already well underway. What do you make of it . Well, i dont think theyre going to be successful in halting the trial. Like you said, the trial is already underway and the trial is really about two things. One, with respect to this cause of action where there was the
Summary Judgment, there its really just about understanding what the penalties will be associated with that
Summary Judgment. But then there are six other claims, claims for falsified business records, falsified
Financial Statements and insurance fraud. Those are separate from the
Summary Judgment motion, and those are
Going Forward on disputed facts so i dont think youre going to see a halting of this trial as much as trump likes to delay. This is one of many moves weve seen in the past 24 hours, really just the past 12 hours overnight. This one with appeal in the fraud case, you have him trying to delay the start of the case after the election. They filed this motion to dismiss the 2020 federal election interference case, and that one they cited president ial immunity. I want to read from the 52 page filing, the trump team writes breaking 234 years of precedent, the incumbent administration has charged
President Trump for acts that lie not just within the outer perimeter but at the heart of his official responsibilities as president. Is this a real legal argument . So its interesting the way that they frame it, they frame it as well, its within the president ial duties for the president to communicate with the vice president. Well, sure, but not about trying to stop the certification of an election. Theyll say, oh, well, its within the president ial duties to communicate, you know, with members of congress and with other state officials. Well, yes, but when he was communicating with the members of congress it was to stop the count, when he was communicating with, you know, the georgia
Secretary Of State, it was to, you know, find 11,780 votes, so you know, you have to look a little deeper into the details, and when you look at the details, these are plainly things that are not within his official duties as president. Hes also arguing or his lawyers are arguing that his actions that have been alleged as part of some conspiracy were actually efforts to ensure the integrity of the election. Right, and that really falls flat because we know over and over again that members of his own staff, people that he hired at the white house, his counsel, people at doj, everyone was telling him there is no election fraud, and so when you hear that over and over again, this idea that he was somehow maintaining the integrity of the prorks you know process, you know, is completely bogus. We have to ask about new reporting in the
New York Times that trump is said to have realed
Nuclear Submarine secrets to an australian businessman. Nbc news has not independently verified this report, but the times goes on to say that businessman went on to share the sensitive details with others. A trump spokesman declined or talked about these reports calling them illegal leaks, denied any wrongdoing. How damaging is this in the classified documents case . These secreted were reportedly shared also at maralago . So i mean this has been the problem all along. He has these boxes and boxes of classiied documents and the question has always been why. Why did he want these records . Why did he fight so hard to keep them, even when, you know, you have the
National Archives asking for them. When you have a subpoena, and hes still doing all these things to try and keep them. This was the concern, he was somehow sharing the information and little by little were learning more about what he was actually doing with the information he had. Its damaging, its not charged conduct in the classified documents case. What do you make of that . Well, there may be many reasons, it may be that they dont have corroboration for it. I dont know if this witness was cooperative with them. They interviewed him it seems like multiple times, do they have any corroboration this occurred . Did those conversations happen at maralago where they would have venue, you know, there are any number of reasons they may not have charged this, but its certainly relevant, potentially other evidence that goes towards this kind of propensity evidence, you know, what is his propensity to be sharing and being reckless with classified information. So there may be arguments that it should come in, but if it is more serious than some of what is already being charged, it may not. So i think it will really depend on what more we learn about this particular episode. So good to see you. Thank you very much for sifting through all of that with us. Potential new legal jeopardy, new york congressman george santos, a former
Campaign Treasurer for santos has pleaded guilty to
Conspiracy To Defraud in connection with the case against her former boss, and according to court documents, former aide nancy marks admitted to fabricating donations to make it appear that santos had a much
Larger Campaign fundraising haul than he did. Joining us now nbc news investigate correspondent tom winter. In laymans terms what did she admit to doing, and how does it fit into the bigger case against santos . What she admitted to is falsifying the documents as far as what donors they had. In over ten years ive looked at these types of cases, typically what we might see if you were running for office, ana, and i wanted to give you more donations than perhaps i am allowed to under the individual contribution limits, what i might do is take money and give it to
Family Members or give it to other individuals and they would my donations in their name. Thats illegal. We do see that from time to time in these types of cases. What federal prosecutors say and marks admitted to, they didnt bother to do that. They wrote down that they received these donations from individuals. The purpose for doing so is that they could get money from national committee, which is very clear from the documents is a reference to the
Republican National committee. If they hit a certain threshold of money they say they brought in, the rnc would then provide them support in terms of funds and logistics, so that is something that is also illegal and lying on these documents is illegal, and thats something that marks has now admitted to. Santos has pleaded not guilty to the 13count indictment against him. Thats the focus as far as what we saw yesterday in the court. And the
Charging Document says that the prosecutors have
Text Messages between santos and marks so they have evidence to back up her testimony as well. Could this mean more legal trouble for santos . Well, i mean, certainly if the evidence and what prosecutors say here is true, it never hurts to hear from the actual individuals youre charging as far as what they were specifically doing. And obviously
Text Messages, im not an attorney nor do i play one on tv, but just from spending the time in court that i have and i think anybody would reasonably conclude that seeing
Text Messages between individuals is particularly powerful evidence. So yes, this does not bode particularly well for the congressman from new york, but again, we continue to watch this case. I did check the docket late last night, there was no sign of any cooperation agreement. Could that change at some point, of course that might be the case for marks. Okay, tom winter, keep us posted, thank you, sir. New numbers from the irs show former new york city mayor and trump attorney

Breaking News on the economy this morning, a better than expected jobs report showing the u. S. Added 336,000 jobs in september. Again, thats higher than expectations. Unemployment holding pretty steady at 3. 8 . Now, the big question, how will the fed view this and the
Overall Economic picture as it weighs more efforts to get inflation under control. Nbc
News Business and data reporter brian cheung is here now to break it down. What are the
Key Takeaways here . This was really, really interesting. I saw some economists reacting online, wow, just basically taken aback because the expectation was for 170,000 jobs to be added. We got 336,000. It seems like people restimated how much the leisure and hospitality section is adding to our economy. Thats bars and restaurants. They added 96,000 jobs in that industry. Retail trade jobs at the mall adding 19,700 people. Some of that could be seasonal highing ahead of the big holiday rush, but whats interesting is people knew about this seasonality, and that was something that economists had already factored into their expectations, which the ultimate numbers blew through. For the federal reserve, theyre looking at this saying this jobs market is hotter than we expected. Theyve been raising
Interest Rates to deliberately slow this economy, and hiring is still churning on all cylinders. Thats good if youre a household looking for a job. If youre the federal reserve, thats not what you expected at this point. Well see how they react when they get to their next meeting in a few weeks. Well be on it, and well talk to you then. For more on all of this, i want to bring in acting labor secretary julie su. Thanks for being here. I want to get your reaction to the jobs report. Is this what you expected . This is a great jobs report. This is a continued sign of steady, stable growth in a strong economy. People want jobs. Theyre getting them. The
Unemployment Rate remains at under 4 for now a year and a half, thats the longest stretch since the 1960s, and workers continue to come into the job market. Those are good things. Its what we want to see. Lets talk about the historic strikes we are seeing in multiple industries right now and their impact on the economy. The
United Autoworkers Strike has cost nearly 4 billion in losses to the industry, dealers, and consumers. This is according to the anderson economic group. The actors and
Writers Strike have cost californias economy more than 5 billion per the mill ken institute, and we dont know the cost of the kaiser strike, but more than 75,000 workers in the
Health Care Industry at that one place are on the picket lines. The administration has been very supportive of the workers, but what do you say to concerns about the drag on the overall economy . Were in a tight labor market. That means that workers have more power. The unions have more power at the bargaining table. We have seen time and time again that this results in better wages, better working conditions for working people. Its also good for employers and good for the economy in the long run. Thank you so much, secretary julie su. I know were a little over time here because you have another hit that you need to go to, but we appreciate you taking the time and joining us this morning to discuss the latest jobs report.
