So much to get to but we start in georgia where democrats are suing the State Election Board over new rules they say will sow chaos and uncertainty election day. The rules allow Election Boards in 159 counties to make what they call reasonable inquiries about the vote count before certifying the results, but the rules dont explain what reasonable actually means. The lawsuit alleges that even individual Board Members can have the power to delay certification while they hunt for Election Irregularities and then a Battleground State like georgia that could mean holding up not just the state results, but potentially, then, National Results as well. All of it coming as trump keeps fueling the idea that the only way he can lose is if democrats cheat. Our primary focus is not to get out the vote, its to make sure they dont cheat because we have all the votes you need. You can see it. Every house along the way has signs, trump, trump, trump, trump. Theyre vicious people but they are not talentsed people other than in that way n that way theyre talented, theyre very talented on cheating in elections. If we win nevada were going to win the whole thing and i dont know how the hell we can lose it. Ive never seen such support. Make sure your vote is eek ur because, remember, they cheat like hell. I want to bring in msnbc Legal Correspondent lisa rubin. And nbcs Vaughn Hillyard is with me on set. So, lisa, the secretary of state said this is a recipe for chaos. What do we know . What can you tell us . Well, first of all, chris, this is a potential recipe for chaos because georgia has 159 counties and the lawsuit is about, as you noted, two different rules passed by the Georgia State election board that impact how county Election Boards conduct their own processes prior to certifying Election Results. Not only would it allow individual County Boards to conduct reasonable inquiries prior to certifying their results, but it also would empower local Board Members, again, in each county to demand any and all electionrelated documentation prior to certification and that bumps right up against a provision of georgias statutory law that says counties must certify their Election Results by a time and date certain. So through this lawsuit the Democratic National committee, the Democratic Party of georgia, a variety of countylevel election Board Members, even voters in two Georgia Statehouse candidates are asking for a declaration that to the extent that these rules are inconsistent with that certification mandate, that they be enjoined so that the election can go forward without any uncertainty about when these countylevel results must be certified. Okay. Vaughan, just to complicate this even further, its not just democrats filing this lawsuit, you have lucy mcbath, a member of congress who are calling for some republicans to be taken off these boards, they say they are anything but looking for a free and fair election. They think there have been actually ethical violations. Even the republican governor, brian kemp, is looking into this situation. So lots of moving parts. Its a Republican Brian Kemp who may be the one standing in the way yet again for these maga republican election Board Members. You are looking at Governor Kemp who at the urging of democratic lawmakers and Brad Raffensperger has also pushed back against the actions of these republican Board Members, Governor Brian Kemp in the last 24 hours asking his Attorney General whether he under Georgia State law is constitutionally obligated and has the ability to seek the removal of these Board Members and if the ag comes back to him and says that the state law does do that at that point in time Governor Kemp could go and hold a hearing through an administrative judge to have both sides Hearing Arguments on this and potentially remove those republican Board Members. Worth reminding 70 days until the election. Maya, the state Republican Party chairman tried to defend these rules telling news week, quote, these Common Sense Changes will benefit all georgians regardless of political affiliation and they are designed to increase transparency and Public Confidence regarding our election. What do you say to that . I say, look, i mean, what we have seen, i think, over and over and i think its important that we look at this not just as an individual, this set of rules and this lawsuit, but as a part of really what is a larger effort to actually undermine Public Confidence in our elections over and over again weve seen in the clips that you just played donald trump going out of his way to sow the fear that peoples votes wont be secure, that something is going to happen. What we are seeing is an effort and this is where it slots in with what really becomes this almost sort of constellation of disinformation that is to undermine faith in our democracy and in a fair and free election. So, lisa, this is, indeed, part of a much larger effort, we played all of that sound of donald trump casting doubt on the 2024 election, but even back in july the Executive Director of the heritage foundations oversight project said, and im quoting here, as things stand right now there is a zero percent chance of a free and fair election. The Washington Post also wrote that according to rnc cochair lara trump before any ballots are even cast the rnc has 90 active lawsuits, cases, and is publicizing them even if they didnt file the case themselves. So is it clear how much of this is legal wrangling and how much is political wrangling . Its not and i think, chris, like many things with former President Trump they collapse into one here. Because on one hand your right to say that these two new rules are sort of being offered to give individual county Board Members the pretext or the evidence the evidence necessary to delay certification, which could prevent even georgia from sending all of its results to the country, but i do think that there is another piece of this that is in search of evidence for a national narrative. You will recall that during the 2020 election there were over 60 lawsuits in the post election phase designed to help former President Trump overturn results in one way or another. All of those lawsuits failed largely because they had no evidence. The second of the two rules thats been contested in this election, the one that allows individual county Board Members to demand any and all electionrelated documentation, that may be far less about georgia and individual countylevel results than it is about fueling a stop the steal narrative once again in advance of the election not just after it to try and give folks the tools or the evidence that they think they will need to show that the election was rigged, even in the absence of any evidence that it, in fact, was or will be. Lisa, thank you for that. Vaughan, give us again a look at the bigger picture. I mean, donald trump obviously fits into this in a very big way, but to lisas point those suits that came after the 2020 election failed one after the other after the other after the other. Do these folks think that somehow this time it could be different . Are they more convinced now that they might lose and theyre getting their ducks in a row, so to speak . Give us the lay of the land. Right. Number one, donald trump was criminally charged for allegedly trying to overturn georgias Election Results, number one. Number two, in 2022 he tried to house brian kemp as governor by backing a republican challenger to him in the primary. That challenger lost to kemp by 55 percentage points. So donald trump lost again on that merritt. But when you are looking here at just take fulton county, there was one Election Board Member who refused to certify fulton countys primary results this last may here. So they are very well understanding of the levers of what it takes to certify Election Results and i want to let you listen to donald trump because its not just the levers, but its also the names of the individuals in those very positions. Take a listen to him at the Georgia Rally earlier this month talking about those three republicans. Now we have two things we have to do. We have to vote and we have to make sure that we stop them from cheating because they cheat like dogs. I dont know if youve heard, but the Georgia State election board is in a very positive way. This is a very positive thing, marjory. They are on fire. They are doing a great job. Three members, janice johnson, Rick Jeffries and janelle king, three people, are all Pit Bulls Fighting for honesty, transparency and victory. They are fighting. Those are three otherwise very not Public Officials and yet donald trump was very well aware of their names and at least one of the individuals who was at that very rally in georgia earlier this month. And the marjory he was referencing of course was Marjorie Taylor greene. Maya, i talked to the chair of the georgia Republican Party congresswoman Nikema Williams at the dnc last week and we talked about the preps for the election as your cat makes yet another appearance on Chris Jansing. I love this so much. I think it was the last time we were talking about cat lady. Anyway, lets go back to the chair of georgia democrats and this is how theyre getting ready for what they know is coming. We have Volunteer Attorneys in all 159 counties making sure that when voters turn out to cast their vote theyre actually counted. So 159 volunteers, are you looking at potentially hundreds of attorneys who are ready to go on Election Night . Hundreds of attorneys already ready to go. So they are trained, were already fielding questions as people are hearing about maybe being dropped from the voter rolls. We can make sure were addressing that in realtime leading up to the election. It raises the question what the heck is Election Night going to look like. I think we have to sort of steel ourselves for some chaos because truthfully that is what seems to be part of the strategy that the republicans are trying like hell is that if they can they can sort of sow enough chaos, they can create enough of the fear that, you know, this potentially you throw enough stuff, something might stick, at least enough to delay. So i think what we have to prepare ourselves for is the possibility that results are coming back right away, that people are going to need to be patient, theyre going to need to you know, if theyre being told that they are not on voter rolls but they know that they are, to, you know, sort of stay, to work through the process to make sure that their votes are counted. But i think the other issue to think about, and this is the tough part, is thats Election Night. I think part of the concern that were dealing with is that in advance of that this is all part of a strategy to also further suppress Voter Turnout because people feel like no matter what, its not going to be fair, things are you know, things are going to be thrown into disarray, theres going to be, you know, lawsuits regardless. That makes people less likely to participate. So whats really disturbing, i think, in this moment is that some of the damage is already being done and thats what we have to guard against. Kamala harris right now is the star at the center of the ad wars, many of the political ads that are airing right now both tv and digital are about trying to define who she is and if you didnt know any better youd think this had to be two different human beings. Before she was the most liberal u. S. Senator Kamala Harris was the liberal San Francisco prosecutor, the most progressive in all of california. She led an ms 13 Gang Member Go who then murdered a father and his two sons. She was the daughter of a working mom and she worked at mcdonalds while she got her degree. Nbcs Aaron Gilchrist is covering the white house for us, also with us john kasich, an msnbc political analyst. Lets start with that slice of the ad money which is defining Kamala Harris. Look, there are people out there not paying attention and while defining a candidate is nothing new in politics, defining someone who has come to the race this late is a new challenge. So talk to me about what you see and what you think money might be able to buy. Well, look, first of all, there isnt any reason to define donald trump, everybody in america has an opinion about him. No reason to spend a lot of money talking about that. When it comes to Kamala Harris shes largely unknown still, shes sort of shes really not defined. So as a result of that people can attach whatever feelings or thinking they have to her and say, well, thats who she is. So now what the trump people are beginning to do is to say, no, let us tell you who Kamala Harris s let me give you the whole script here. Let me give you the whole history. So thats the battle that we are on to. Of course, the earned media is going to matter a lot. Pretty soon kamala is going to have to sit down for interviews and run the Media Gauntlet and see how she can carry herself. If she does well thats going to be big kudos for her, if she stumbles and doesnt do well thats a whole new ball game. We have to wait and see. Its all about how people are going to define who she is and how is she going to define herself in specific terms. Like the New York Times said here are 21 questions she should have to answer. Its all interesting. There was also really interesting article today in the times by nate cohen who goes through trumps many attempts to define harris in a negative way, race, gender, her intellect, arguing none of them have landed, but he points to a new line of attack that shes just more of the same failed Biden Harris Administration policies. Could the Harris Campaign run into trouble trying to show she is a change agent if trump is able to tie her to for lack of a better phrase the same old joe biden . I think shes going to try to distance herself from joe biden in a number of ways and were beginning to see that happen. You know, on one hand she said i was there for every crossed t and dotted i, but now shes beginning to say, well, this is where i am on, for example, inflation. Ive been arguing for months now that the Biden Administration was in denial about the problem of inflation and how it affects average folks. Shes not doing that. Shes saying prices are too high. So shes sort of and thats not disloyal, she is the Vice President not the president , but she is now trying to lay out an agenda. She said she is not for medicare for all anymore but people are going to ask her that. The other thing theyre going to ask her in my opinion, you were there for three and a half years, why didnt you do more then and she will have to answer that. There will be tough questions and some roads for her to cross but we will see how she does. If she stumbles shes got a problem. The next month is going to tell us a lot, interviews, the debate, obviously.
