Its his considered opinion as evidenced by the Superseding Indictment that all four charges remain viable, provable, and hes going to proceed to trial on all four charges and thats a good day for the prospect of accountability. In fact, if there were to be a Superseding Indictment, wouldve thought that would be the reason to do it. We got those unindicted Co Conspirators remaining in the indictment. One has been removed. Speculation is that person who is now out of the case was Jeffrey Clark who was a Justice Department official who came close to being the acting Attorney General. He is out because they conduct is official conduct. The others remain. Speculation being Rudy Giuliani and john eastman and some of the others. Those five unindicted Co Conspirators are still there. I speculated that the reason they were not named as defendants and were referred to as unindicted coconspirators was to streamline the case or perhaps it could go to trial before the election. Now we know thats not possible, its a little curious that they still have not included and named them as defendants. I dont know the reason. Perhaps some are cooperating or perhaps they want to keep their focus on donald trump. I dont know the reason. The prior reason to streamline the case and get it on the calendar quickly no longer seems to be whats driving it. Glenn, lets talk next steps in the process. A lot of us were waiting for an evidentiary hearing are hearing of sorts to be ordered by judge chutkan in advance of any type of motion. Can we anticipate donald trump filing a motion to dismiss this version, Superseding Indictment . Can we expect once the motion to dismiss is denied that the evidentiary could still take place . They could. I think Donald Trumps motions to dismiss will come early and often and they will be rejected by the judge one after another. I think we will see some kind of a hearing whether its evidentiary hearing where you have some of the Many Republican witnesses who testified before the grand jury about Donald Trumps crimes, whether they take the stand in a public courtroom for its time by proffer where the parties offer, this is what the evidence is and this is why we think it survives are trumps lawyers will say it does not survive in the Supreme Court Immunity Ruling. Democrats worn in the suit that the measure would invite chaos to the electoral certification process. Thats why so many are pushing back. Its important to recognize this is not a partisan issue. This is a democracy issue. Its a simple matter of ensuring that the Election Results are counted in a timely way and without any Election Sabotage or interference. Rick, you wrote to great piece in politico in january of this year about how you had some optimism going into the november election this year about a fair vote. Consider the following. Three maga members in georgia the past these two rules. You have these rules coming from the republican state chair of georgia, sending the proposed language for these rules. Do you still have that optimism going into november . I do have the optimism not because i think these officials will do the right thing but because i think theyre more safeguards in place. People are focused on these issues. People recognize that its not necessarily going to be smooth and it does not end on election night. We have to ensure that every eligible voters vote will count. We will properly understand what the roads were and that will be translated into congress determining who one coat the Electoral College vote in the winter being able to take power. These are things we used to take for granted but after 2020 we have to be vigilant. There are safeguards. Congress pass some laws and the Supreme Court decided a case that helps. There are things that have been done that put us in better shape, and were not in the middle of a pandemic so its not a moving target. There are bad actors but we are better prepared than we were in 2020. Lets call out the bad actors. Its not just donald trump. The Supreme Court, third president ial election. The Voting Rights act was struck down. This is not something that happened overnight. Its a train that has been barreling down against democracy over years and its been buttressed by really bad decisions that come from the highest court in the land. Thats right. When the Supreme Court gutted the Voting Rights act in 2013 in a case out of alabama, we saw a deluge of Voter Suppression laws. Since 2020 alone, there have been 100 laws passed that make voting more difficult. Over 28 states have passed laws that make voting more difficult and georgia is the latest one. Again, its Election Interference. So many people are aware of this and are pushing back. A letter was sent monday to the governor, to the secretary of state, to the chair of georgias Election Board demanding that the Attorney General of georgia issue an opinion explaining the unlawfulness of these new rules. We were joined by nearly a dozen groups, most local from georgia, people are aware of this attempt. We are watching it. We are ready to pounce because we are not going to see this election stolen. Certainly not in a state where there is that many black voters who have always been targeted by Voter Suppression laws. This is the latest one and we will push back. I think theres conflation with going on with Election Certification. I think people look at them Vice President mike pence, january 6 and the certification of Election Results, but the reality is in states across our great country, Election Certification is ministerial. Its something that needs to happen on and administrative level. There is no independent substance and verification by State Election Board Members as to the Election Results. Its an attempt to subvert the states own law in georgia which requires that elections be certified. If this happens you will see state forts in Federal Court step in. Not only is it interfering that the Legislature Put in place and something donald trump talked a lot about, but also the voters right to vote. If there is such a delay that you couldnt send it to congress, all of georgias voters would be disenfranchised and i dont think the courts will stand for that.
