Marc, you are one of the busiest men i know so im grateful for you taking the time to join us today. I wanted to start off to explain to our viewers, there is a brief Part Strategy that republicans have deployed to subvert this years election. Walk our viewers through that. Thanks for having me. A big fan of yours. The republican plan for 2024 is first to make it harder for you to vote. If you are up there watching this, you should know that the republican party and its lawyers are in courthouses around the country trying to make it harder for you to cast your ballot and to register and for your vote to count. That is the cornerstone of their program. The second is that they want to be able to harass and intimidate voters and be able to challenge their ballot. It sounds like a lot of hyperbole. Right now the republican party and their allies are in Court Thing they have a first Amendment Right to harass voters and intimidate election officials and they are promoting laws and court cases to allow them to submit long spread ships spreadsheets of names and asked those people to be removed so they cannot vote. The third part of the plan that they have as we have seen with states In Georgia is to challenge the certification process. Too essentially, after all the ballots have been cast and put a thumb on the scale and whether they certify after results or certify them on time. Or whether they empower their Election Deniers and local office to subvert the results. The Harris Campaign is having you oversee potential recounts of for Election Day and why is it so important to be ready . To have the legal team ready to go, especially with her campaign . Let me say it is an honor to be part of a large team of lawyers who are working for the Vice President. I was proud to represent Kamala Harris in the u. S. What we see by republicans is a political party that has stopped doing get out the vote. Stop saying that they need to encourage people to vote instead, Donald Trump has told the rnc to focus on the Voter Suppression and other tactics. There will be lawyers ensuring that the process is fair and everyone can cast their ballot. I think that is part of the essence of democracy. The 200th case, this is the Milestone Case that deals with electronic i. D. S at the university of North Carolina that university took the time to ensure that electronic i. D. , those used by students and faculty could count for purposes of providing and verifying identity to vote. Why should americans are not at the unc or in North Carolina care about litigation that is being brought by the rnc in that state to prevent users of electronic i. D. S to use those when they go to vote . The reason why everyone should care about this is because it puts too bad of a lie that will republicans want is just i. D. North carolina has one of the strictest i. D. Requirements in the country. The university of North Carolina is not just some college or university. It is the Flagship University of the state of North Carolina. The i. D. That the unc put together is a state issued i. D. This is exactly what it is republicans claim they want. They want people to use state issued i. D. S. The university of North Carolina issued state issued i. D. S in electronic form to faculty and students in the rnc is still stewing over that. It is not about them wanting election integrity. They do not like any that students are able to vote they think though students may vote against their interest and they are looking to disenfranchise those students. It will not work and they will lose the case. Marc, we obviously are interested in what happens in the race to the White House. Things that are happening, i like to say democracy is local. People dealing with democracy with things that are down the street when they go to pull a permit to build a House Or Deal with the dogcatcher. The reason why i bring this up is because you were instrumental in ensuring the amendment three in missouri, the idea of having access to reproductive freedom and having it on the ballot in november. You were instrumental in showing it got back there. We have amendment four in florida with the same idea. Why is it that your battles are not just national . Some of the battles that you are doing legally are happening with in peoples backyards in their own states . First of all let me say, it was other lawyers who brought the case in missouri. Credit to them. I do not want to take credit for your work. Your point is still taken. Most of Election Administration is at the local level. We dont administer elections at the federal level and we do not do most of our democracy at the federal level so much takes place at the state devil, at the local level with ballot initiatives, with referenda and with the rules about how people registered to vote and how they vote and have the votes counted. If we are not paying attention to what is happening in the local courthouses or what is the local canvassing boards, in the shopping centers work people collect signatures, we are missing out on where most of democracy takes place. Marc, before we let you go we look at georgia as one of the big Battleground States but one of the most active legal states when it comes to voter integrity. A Bench Trial has been scheduled to occur in october dealing with the attempts by the Georgia State Election board to create more obstacles to certifying elections. Talk about what our viewer should see and it will be broadcast we can see it and listen to it as it happens in real time, that Bench Trial. Which is really great, by the way. Katie, i know you have been a fan of this as well. More courts should open up their proceeding so people can see what is going on. You are right, georgia is one of the most heavily litigated states along with pennsylvania, wisconsin, arizona and nevada. Georgia is part of ground zero. It is there because the republicans took over the state Election Board. Donald trump called out three of the five members for passing a rule that is clearly aimed at trying to allow Election Deniers at the county level, who sit on the local boards to refuse to certify elections or certify in attic elections. And that is the reason why Donald Trump knows the names of three of the five Election Board members and called them pit bulls. The democratic national committee, kudos to them and their lawyers, brought their lawsuit because that rule by the board is contrary to state law. I am confident that the dnc will win that case and we will have accurate election certified november In Georgia. There are couple defendants that did not join in and that is the reason why the case still perceived in front of mcafee. Can we explain in more detail why mcafee thought that some of these charges actually should be dismissed . The defendants here wanted all of these charges dismissed. They said that they could only be brought in Federal Court. The judge looked at the charges and as to the most important one, the rico count, this conspiracy to interfere with the Vote Count In Georgia, he blessed that count and that it could go forward. That is the headline here. There were three charges that were dismissed. What involved Baltz Record that had been filed. What involved the conspiracy around those records and what involved an attempt to commit that crime. That very slender slice of the pie is what the judge took out of the indictment. Most of it goes forward. Some of the headlines are suggesting that she, quote, skipped out or ignored the subpoena, which would be outrageous for a Law Enforcement Official to do. Talk about why those headlines are misleading, joyce. They really are. Fani willis was not pulling a Steve Bannon. She was not flouting the authority and ignoring subpoenas in defiance of the rule of law. Her lawyer, a former georgia governor, a lawyer who is highly esteemed, is challenging the subpoenas. But you have to understand is the political context. I live in alabama, we are next door neighbors would georgia like my home state, georgia is a republican led state. This committee that issued the subpoena to Fani Willis is a lot like when jim Jordan Representative in congress creates a weaponization of Government Committee and claims that democrats are weaponizing government on the federal level and tries to pry into what prosecutors are doing. This Georgia Subpoena is similar. It is a violation of separation of power. It is an effort by the legislative branch to peer into what a prosecutor is doing. Her lawyer has moved to squash the subpoena. She did not defy it. She is going through the legal process that youre supposed to use when you are subpoenaed and believe it is wrongful. You brought up Steve Bannon i think i could bring up Jim Jordan as an example too, who never complied with his subpoenas. Let us Switch Gears and talk about alberto gonzales. He has his own fame as when he served as an Attorney General but also as white House Counsel. One of all people i know who served both of those roles. I posted on my social Meeting Yesterday the following quote. As united states approaches a critical election i cannot sit quietly as Donald Trump, the most serious threat to the role of law in a generation, returns to the White House. Though i am a republican i decided to support Kamala Harris for president. Joyce, let us talk about this and because of this. Not just political significance. I find this to be compelling, how it lands on undecided voters and republican voters is an entirely different story but i think for pete in the justice department, this was an important statement to hear. You noted there has been indictment by the doj of the leaders of the taran graham collective, a transnational Terrorist Group that promotes white Supremacists Exhilaration is them. Joyce, as we see Donald Trump openly flirting with White Supremacists and what other Conspiracy Theories like Laura Loomer and nickfuentes and others. It is a prosecution designed to send a message to people that if engage in this sort of contact, doj is looking. I love how you tackle legal issues. I think part of the strong disapproval of the Courts Performance comes from the fact that as you last pointed to at the 54 believing the court reflects the politics of the president that appoints them, that instead of the Supreme Court being an independent Body Making Decisions that are soundly based on a reasonable legal judgment, it has become highly politicized. You couple that with public perception that the court is highly ethics challenged and totally out of step on two of the most important social issues that the country confronts, Abortion And Gun control. You really have a formula for seeing how a president of the united States Appointment of justices can totally shape the politics of some of our most important issues. Tom, what i also liked about this poll is that it does deeper than what is your opinion on the Supreme Court. It exports him the most significant opinions that have come out recently like the president ial immunity ruling. I was marveling at the Gender Divide i saw hubert 27 of an approved of the Immunity Decision while 44 of men gave their approval for that immunity ruling. What does that say about how women are viewing scotus and also the idea of giving so much power to one individual, who historically, has only been a man . Were seeing great Gender Divide when it comes to perception of the courts just as we are generally politically when you look at the numbers of harris versus trump, massive Gender Divide in terms of where support lies. While you see brought support for certain ways of changing the composition of the court, Term Limits in particular, and limiting a supreme Court Justice s active term to 18 years. You really see the Gender Divide even greater when it comes to more radical ways of changing the composition of the court, namely expanding the court by four justices. There you see women very much supporting that if it would help overturn Supreme Courts decisions on Abortion And Gun control while men oppose an expansion of the court. Im glad you brought that up because i wanted to ask you more about that. The majority of the respondents on this poll exposed expansion to 13 justices. When you frame it like you just did, bring the question of expansion in terms of Hot Button issues with Abortion And Gun control, more than two thirds of democrats ended up supporting expansion of the court. Let us be clear, Term Limits are good but Court Expansion Isnt unless you presented through the lens of a hot Button Topic . I think there is something to that. Reform is more popular if it is not tied to a specific issue or outcome. Certainly, you would have to read the results of broader reform for Term Limits then for increasing the number of justices on the court. Women understand that if you are going to affect change on the abortion issue, there is really very little ability to do that by changing Term Limits. Beckett take a full generation to change the composition of the court. The average number of years that a supreme Court Justice used to serve from 1790 to 1970 was 15 years. From 1970 on, the average term of a justice is 26 years. It will take a long time for the composition to change. By importing four new justices Kamala Harris won and held the senate, even if it is a 50 50 senate with walz as Vice President , you could end up with the ability to appoint four new justices. That seems to be the only near Term Way you could affect Supreme Court decision. Unbelievable and i love this conversation.
