Law360 (July 8, 2021, 9:54 PM EDT) -- A New York federal judge on Thursday criticized the U.S. Department of Homeland Security for its "flawed" defense against litigation challenging the Trump administration's decision to exclude New York residents from trusted traveler programs like TSA Pre-Check, but said she would not sanction the DHS on her own initiative.
In a 33-page order, U.S. District Judge Jesse Furman said the government should have undertaken "more thorough inquiries" into the information that various state departments of motor vehicles share with federal immigration agencies, well before it defended its TTP ban in New York based on the erroneous argument that it needed DMV...
